LEY Nº 27596, 2001- Peru

Summary: La Ley 27596 regula la crianza, adiestramiento, comercialización, tenencia y traslado de perros potencialmente peligrosos, con el fin de proteger la integridad, salud y tranquilidad de las personas. La ley prohíbe fomentar cualquier forma de agresión canina y hace especial referencia a las peleas de perros. En general, los propietarios de perros potencialmente peligrosos deben ser competentes y estar físicamente capacitados para cuidar del perro, lo que incluye proporcionarles un adiestramiento adecuado. En caso de perro callejero, el perro debe ser acogido por el municipio en cuya jurisdicción se encuentre y reinsertado en la comunidad mediante programas de atención a los animales, siempre que no se considere agresivo. La ley también describe el procedimiento para tratar a un perro que ataque a otro ser vivo o mate a un animal, y las correspondientes consecuencias de tales sucesos. CO - Animal control - Ley 2054 de 2020

Summary: This law modifies Law 1801 of 2016. It imposes the duty on all districts or municipalities to establish an animal welfare center, municipal shelters, or transitory homes to take domestic animals to the extent possible according to the financial capacities of the territorial entities. If the district or municipality does not have these centers, it must support the efforts of private animal shelters or foundations that receive domestic animals. If the animal has not been claimed by his or her owner or keeper after thirty days, the animal will be declared abandoned, and the authorities will proceed to promote his or her adoption. This law also establishes that domestic animals or pets cannot be restricted from common areas in apartment buildings. Dogs have to be leashed, and in the case of potentially dangerous dogs, they have to be muzzled, and the owner must have the corresponding license in accordance with the law.

SC - Exotic pets - Chapter 2. Large Wild Cats, Non-Native Bears and Great Apes

Summary: This South Carolina chapter, effective January 1, 2018, makes it unlawful for a person to possess, keep, purchase, have custody or control of, breed, or sell within this State a large wild cat, non-native bear, or great ape, including transactions conducted via the Internet. A person in possession of such animal before January 1, 2018 who is the legal possessor of the animal may keep possession if he or she complies with seven conditions listed under Section 47-2-30. Authorities may confiscate large wild cats, non-native bears, or great apes held in violation of this chapter. Cities or counties may also adopt more restrictive ordinances than this chapter. A person who violates this chapter must be fined not more than $1,000 or imprisoned for not more than 30 days for a first offense, and must be fined not more than $5,000 or imprisoned for not more than 90 days for a second offense. Exempted entities include certain non-profit animal protection organizations, university research labs holding Class R registration under the AWA, any person who possesses a valid USDA Class A, B, or C license in good standing, and circuses that are incorporated and hold a Class C license under the AWA that are temporarily in this State, among others.

Hauser v. Ventura County Board of Supervisors

Summary: The plaintiff in this case applied for a conditional use permit (CUP) to keep up to five tigers on her property, but the county planning commission and board of supervisors denied her application. In her application, plaintiff indicates that the project would include three tiger enclosures, a 13,500-square-foot arena with a roof over 14 feet in height at its highest point, with the area surrounded by an eight-foot-high chain link fence encompassing over seven acres. The captive tigers would be used in the entertainment industry: movie sets, television commercials, and still photography. In denying the application, the Board found that the plaintiff failed to prove two elements necessary for a CUP: the project is compatible with the planned uses in the general area, and the project is not detrimental to the public interest, health, safety or welfare. The court noted that plaintiff bears the burden of demonstrating her entitlement to the permit. In fact, the court noted that while plaintiff claims "an unblemished safety record," she submitted videos showing tigers "roaming freely in the backyard of her Beverly Hills home" and tigers posing with plaintiff and her sister on the beach. The court observed that, "[h]er well-intentioned desire to own [the tigers] does not trump her neighbors' right to safety and peace of mind." The judgment of the lower court was affirmed.

Hetrick v. Ohio Dep't of Agric.

Summary: In this case, the court of appeals reversed the trial court's decision to grant appellee Hetrick's dangerous wild animal (DWA) permits. Hetrick was the owner of DWA's on his property, and according to an Ohio law he was required to register the DWA's and apply for permits before a certain statutory deadline. This court held that the trial court abused its discretion in finding that the Ohio Department of Agriculture (ODA) lacked a statutory basis to deny the application for a rescue facility permit on timeliness grounds but did not err in so finding on caging and care grounds. Further, the court reversed, in part, the judgment of the Wood County Court of Common Pleas in the rescue facility permit case; reversed, in toto, the judgment of the lower court in the wildlife shelter permit case; and with this decision, reinstated the ODA's denial of both permits. Judgments reversed.

Gilreath v. Smith

Summary:

While pet sitting for Defendants Bruce and Jodi Smith, Plaintiff Josephine Gilreath was attacked and injured by the Smiths' rooster, which caused a serious infection with long-term consequences. Plaintiff Gilreath filed suit, but the trial court granted summary judgment in favor of the Defendants on the ground that Gilreath assumed the risk. Gilreath appealed to the Court of Appeals of Georgia. The Court of Appeals affirmed the trial court and reasoned that Gilreath assumed the risk of injury based on the state statutes of owners of land under OCGA § 51-3-1, as keepers of a vicious or dangerous animal under OCGA § 51-2-7, and as required by a Roswell city ordinance. The Court reasoned that at prior pet-sittings at the Defendants home, Gilreath had been warned that the rooster would attack and that a garbage can lid was useful for controlling the rooster. Second, Gilreath has not raised an issue of fact regarding whether the Smiths had superior knowledge of the risks associated with the danger. Gilreath, a professional pet sitter with at least nine years of experience, admitted that she had a responsibility to educate herself about the animals she takes care of yet she failed to do so for roosters. Third, Gilreath admitted that she chose to take the job knowing that she had been told that the rooster would attack. Gilreath also contends that the Smiths violated a Roswell city ordinance, but she failed to introduce a certified copy of the ordinance and thus failed to prove this claim.

Coe v. Lewsader

Summary: In this case, Ryan and Hillary Coe filed suit against Eric and Trish Lewsader for damages resulting from an accident involving the Lewsader’s dog. Ryan Coe was driving his motorcycle while intoxicated on a public highway when he hit the Lewsader’s dog that was lying in the middle of the street. Coe suffered severe injuries as a result of the accident and filed suit against the Lewsader’s according to Section 16 of the Illinois Animal Attacks or Injuries statute. According to the Act, “if a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages.” In order to be awarded damages under the Act, the Coe’s needed to establish “some overt act” of the Lewsader’s dog . As a result, the question before the court was whether or not the Lewsader’s dog was acting overtly when it was lying in the middle of the street at the time of the accident. Ultimately, the court held that the dog was not acting overtly by lying in the middle of the street. Also, the court rejected the Coe’s argument that the dog had acted overtly when it walked into the street before lying down. The court rejected this argument because the overt act needed to take place at the time of the injury, not before. As a result, the court found that the Lewsader’s were not liable for civil damages under the Act because the dog had not acted overtly at the time of accident and therefore the Act did not apply in this situation.

Jackson v. Mateus

Summary: Plaintiff filed suit against the defendant after she was bitten by the defendant’s cat and required medical attention as a result of the bite. Plaintiff found the defendant’s cat on her property and mistakenly started petting the cat, thinking that it was one of her own cats. As plaintiff was petting the cat, it bit her causing her injury. Plaintiff filed a negligence claim against defendant for not restraining the cat. The court held in favor of the defendant because the court found that this incident was not foreseeable and because it was not foreseeable, the defendant did not owe a duty to restrain the animal under the common law, municipal law, or state law.

Boyer v. Seal

Summary: In this case, plaintiff filed suit against her daughter under Civil Code article 2321 after her daughter’s cat accidentally tripped plaintiff causing injury to her wrist and back that required medication and hospitalization. Under Civil Code article 2321, plaintiff must show that the domestic animal created an “unreasonable risk of harm” and that any damage that occurred was a direct result of that harm. Additionally, the plaintiff does not need to show that the animal was acting aggressively or was inherently dangerous to collect damages under the code. The court held that plaintiff did not meet this burden of showing an “unreasonable risk of harm” because the cat “getting underfoot and accidentally tripping the plaintiff was not an unreasonable risk.”

Plaintiff suggests that liability should be based on a theory of negligence per se. Due to defendant's violation of city ordinances related to proof of rabies vaccination, he should be liable for damages. The court, however, rejected this, as Louisiana law does not recognize statutory negligence per se. Instead, in looking at negligence based on the set of facts, the court found plaintiff did not meet her burden. The trial court's decision was affirmed.
