Summary: Under the Herptiles-Herps Act reptiles and amphibians are exempt from the definition of “aquatic life” under the Fish and Aquatic Life Code. All rules and enforcement actions under the Illinois Conservation Law and the dangerous animals statutes related to reptiles and amphibians are now covered exclusively by this Act.

WV - Exotic Pets - Article 34. Dangerous Wild Animals Act

Summary: The State of West Virginia found the possession of dangerous wild animals to present a serious public health and safety concern. Because of this, the state prohibits a person from possessing a dangerous wild animal unless the animal was owned prior to June 1, 2015 and the owner obtained a permit. Under this statute, a “Dangerous wild animal” means a mammal, bird, reptile, amphibian or aquatic animal, including a hybrid that is dangerous to humans, other animals or the environment due to its inherent nature and capability to do significant harm.

Eshleman v. Key

Summary: A county police officer failed to securely fasten her police dog’s portable kennel; the dog escaped as a result and attacked an 11 year old boy. The father of the boy sued the county police officer, alleging that she failed to restrain the dog. The officer moved for summary judgment on the ground of official immunity. The trial court denied her motion and the appeals court affirmed that decision. On issuing a writ of certiorari, the Supreme Court of Georgia reviewed the case. As a county police officer and dog handler, the Court stated the officer was responsible for the care and maintenance of the dog at all times, even when she was not working. For that reason, the allegation that she failed to secure the dog outside her home concerned her performance of an official function and was presumptively entitled to official immunity—with two exceptions to that presumption. Since the father had not contended that the officer acted with malice or with intent to injure anyone, the issue was whether the officer acted with negligence in the performance of a ministerial function. Since the county had not given the officer specific directions about the extent to which the dog should be restrained and since a generalized duty of care stated in a state statute and county ordinance was not enough to amount to a ministerial duty, the Supreme Court reversed the Court of Appeals’ decision.

Chadd v. U.S.

Summary: The issue in this case was whether the United States may be sued under the Federal Tort Claims Act (FTCA) for the actions of the National Park Service (NPS) relating to a mountain goat that attacked and killed a Park visitor. Wife of the visitor, on her own behalf and as representative of his estate, sued the NPS, claiming officials breached their duty of reasonable care by failing to destroy the goat in the years leading up to her husband’s death. The District Court dismissed the case due to lack of subject matter jurisdiction. On appeal, the court sought to determine whether an exception to the FTCA’s waiver of sovereign immunity applied. The court found the NPS’s management policies manual did not direct or mandate the NPS to take action to kill the mountain goat, and thus the NPS's management of the goat fell within the discretionary function exception. Further, the NPS’s decision to use non-lethal methods to manage a mountain was susceptible to policy analysis, which fell within the discretionary exception as well. The lower court’s decision was therefore affirmed. Senior Circuit Judge Kleinfield filed a dissenting opinion.

Gruber v. YMCA of Greater Indianapolis

Summary: An eleven-year-old boy was at a YMCA camp when a pig—which had never injured anyone or exhibited any dangerous propensities—stuck its head between the bars of its pen and grabbed the boy's hand, causing injuries. The boy and his mother sued the camp, and the camp filed a motion for summary judgment. The trial court granted summary judgment in favor of the camp. On appeal, the boy and his mother asked the court to change the standard for liability of owners of domestic animals to that of strict liability when the animal was not a cat or dog. Since the Indiana Supreme Court precedent was clear that this general rule applied to all domestic animals—and not just cats and dogs—the court declined their invitation to alter the standard. The trial court's entry of summary judgment in favor of the camp was therefore affirmed.

Summary: Plaintiff was attacked and chased by a domestic goose in Defendant’s yard. As Plaintiff attempted to flee, she fell and broke her arm. Plaintiff sued Defendant in the County Court of Jackson County under a theory of premises liability and, alternatively, under the dangerous-propensity rule. The trial court granted summary judgment because it found that Plaintiff was a licensee on Defendant's property and that Defendant did not breach her duty of care toward Plaintiff. It also denied relief under the dangerous-propensity rule because there was no evidence that the particular goose that bit Plaintiff ever had exhibited dangerous propensities prior to the incident. Plaintiff appealed to the Jackson County Circuit Court, which affirmed. Plaintiff then filed the instant appeal. The Supreme Court of Mississippi held that, while Plaintiff cannot, as a matter of law, pursue her claim under her theory of general premises liability, she can proceed under the dangerous-propensity theory because the court found an issue of fact regarding whether Defendant was on notice of her geese's alleged dangerous propensity. Accordingly, the Supreme Court affirmed the trial court judgment in part, reversed it in part, and remanded for further proceedings.

Summary: These two Washington laws deal with the unauthorized feeding of large wild carnivores. A person may not negligently feed or attempt to feed large wild carnivores or negligently attract large wild carnivores to land or a building. If a person who is issued a written warning fails to contain, move, or remove the food, food waste, or other substance as directed, the person commits an infraction under chapter 7.84 RCW.

Summary: This Washington chapter passed in 2007 regulates the keeping of dangerous wild animals. By definition, a potentially dangerous wild animal includes, among others, lions, tigers, captive-bred cougars, jaguars, cheetahs, leopards, wolves, (but excluding wolf-hybrids), bears, hyenas, non-human primates, elephants, rhinoceroses, certain reptiles, and venomous snakes. A person shall not own, possess, keep, harbor, bring into the state, or have custody or control of a potentially dangerous wild animal. A person in legal possession of a potentially dangerous wild animal prior to July 22, 2007, and who is the legal possessor of the animal may keep possession of the animal for the remainder of the animal's life.
