SC - Restaurant, animal - 9-3 OUTDOOR PET DINING

Summary: This South Carolina regulation concerns outdoor dining with pets. The regulation first defines pets as domesticated cats, dogs, and ferrets. A retail food service establishment may allow customers to be accompanied by pets in an outdoor dining area provided the retail food service establishment complies with the requirements of this section and all other applicable sections of this regulation. Among other requirements include availability of cleaning supplies and sanitizers in the outdoor pet dining area, signage indicating that the area is "pet dining friendly," a separate outdoor entrance to the dining area, a requirement that owners keep pets restrained at all times, and a prohibition on pets on the table, countertop, or other food contact surface.

SC - Exotic pets - Chapter 2. Large Wild Cats, Non-Native Bears and Great Apes

Summary: This South Carolina chapter, effective January 1, 2018, makes it unlawful for a person to possess, keep, purchase, have custody or control of, breed, or sell within this State a large wild cat, non-native bear, or great ape, including transactions conducted via the Internet. A person in possession of such animal before January 1, 2018 who is the legal possessor of the animal may keep possession if he or she complies with seven conditions listed under Section 47-2-30. Authorities may confiscate large wild cats, non-native bears, or great apes held in violation of this chapter. Cities or counties may also adopt more restrictive ordinances than this chapter. A person who violates this chapter must be fined not more than $1,000 or imprisoned for not more than 30 days for a first offense, and must be fined not more than $5,000 or imprisoned for not more than 90 days for a second offense. Exempted entities include certain non-profit animal protection organizations, university research labs holding Class R registration under the AWA, any person who possesses a valid USDA Class A, B, or C license in good standing, and circuses that are incorporated and hold a Class C license under the AWA that are temporarily in this State, among others.

Summary: The South Carolina Emergency Management Division (SCEMD) is the state agency with the responsibility for the development, coordination, and maintenance of the South Carolina Emergency Operations Plan, Hurricane Plan, Earthquake Plan, Terrorism Plan and other selected plans. Annex 17 is the main document covering animals in disaster situations for the state.

Williams v. Lexington County Bd. of Zoning Appeals

Summary: Appellant sought review of the circuit court's order upholding the Lexington County Board of Zoning Appeals' unanimous decision that the county zoning ordinance prohibits Appellant from operating a dog grooming business at her home. The appeals court found that the word kennel, as used in the Lexington County Zoning Ordinance for Resident Local 5 (RL5), included dog grooming. Since Appellant’s dwelling was zoned RL5 and the ordinance prohibited kennels in RL5, the appeals court upheld the circuit court’s decision.

SC - Lien, boarding - § 29-15-60. Animal boarding facilities; liens upon animals for boarding expenses.

Summary: This South Carolina law states that the owner of an animal boarding facility, at the end of an agreed upon term of boarding, shall have a lien upon any animal which is left for upkeep until the cost has been paid by the owner of the animal. The owner of the animal shall also be responsible for payment of the cost of care for the animal after notice of the lien. If the owner of the animal has not paid the cost after actual notice of the lien within ten days of such notice, the animal boarding facility owner may sell the animal after having advertised the time and place of the sale at least seven days before the sale is to be held.

In the state of South Carolina, there is no specific law that mentions great apes or contains an outright ban on private ownership of great apes. Any protection great apes receive in the state is due to their status as federally-protected endangered species. Regulations issued under the authority of the South Carolina Nongame and Endangered Species Conservation Act ban the possession of federally-listed endangered or threatened species except by scientific or conversation permit issued by the South Carolina Department of Natural Resources. It passed with 89% voting "yes."

SC - Domestic Violence - Protection from Domestic Abuse Act

Summary: South Carolina now allows a judge to issue a protective order that prohibits the harm or harassment against any pet animal owned, possessed, kept, or held by the petitioner; any family or household member designated in the order; or the respondent if the petitioner has a demonstrated interest in the pet animal.The law also allows the judge to issue a protective order that provides for temporary possession of the personal property, including pet animals, of the parties and order assistance from law enforcement officers in removing personal property of the petitioner if the respondent's eviction has not been ordered.

A permit may be granted only after the investigations and inspections of the wildlife have been made as the department considers necessary and the department approves the possession, transportation, or importation into the State. Sec. 50-11-1765 provides that it is unlawful to sell live wolves or to ship, import, or possess live wolves into this State without a permit.
