Wolff v. State

Summary: This Indiana case addresses the status of animals seized in conjunction with a criminal animal cruelty case. In his current appeal of this order, defendant first claims that the trial court erred in giving the animal rescue such authority because defendant paid $20,000 in bail. The appellate court found that this money was used to secure defendant's release from jail and he did not request that the jail bond be used for the care of the animals. The court found that the legislature clearly intended the bail and bond funds are used for "separate and distinct purposes," so there was no way for the trial court to automatically apply this money to the animal care costs. Defendant had to affirmatively exercise his rights concerning the disposition of the animals pending trial, which he failed to do. As to defendant's other issue concerning an investigation and report by a state veterinarian, the appellate court found defendant waived this issue prior to appeal. The decision was affirmed.

Summary: This Indiana law allows a court to grant ex parte orders for protection in cases of domestic or family violence. Effective July 1, 2017, a court may grant a petitioner the exclusive possession, care, custody, or control of any animal owned, possessed, kept, or cared for by the petitioner, respondent, minor child of either the petitioner or respondent, or any other family or household member. Additionally, the court may prohibit a respondent from removing, transferring, injuring, concealing, harming, attacking, mistreating, threatening to harm, or otherwise disposing of an animal described in subdivision (c)(5).

A "yes" vote is in favor of such a constitutional amendment and a "no" vote is against amending the state constitution.

G.M. v. PetSmart, Inc.

Summary: In this case, plaintiffs filed a suit for damages on behalf of their son against the defendant, PetSmat, Inc., after their son contracted rat bite fever from the pet rats his parents purchased from PetSmart. Plaintiff’s purchased the pet rats in September of 2011 and their son was diagnosed with rat bite fever in April of 2012. Defendants moved for summary judgement and the court granted the motion. Ultimately, the court found that the plaintiffs needed to provide evidence from expert testimony in order to establish that their son had contracted rat bite fever from the pet rats. The defendants established that rat bite fever could be contracted in other ways aside from rats, including mosquitoes and ticks. As a result, the court found it crucial to have expert testimony in order to determine whether or not the rat bite fever was actually contracted from a rat. Since the plaintiffs had not introduced any expert testimony or other evidence to establish that the rate bite fever in fact was contracted from a rat, the court dismissed plaintiffs claim and held for the defendant.

Summary: An eleven-year-old boy was at a YMCA camp when a pig—which had never injured anyone or exhibited any dangerous propensities—stuck its head between the bars of its pen and grabbed the boy's hand, causing injuries. The boy and his mother sued the camp, and the camp filed a motion for summary judgment. The trial court granted summary judgment in favor of the camp. On appeal, the boy and his mother asked the court to change the standard for liability of owners of domestic animals to that of strict liability when the animal was not a cat or dog. Since the Indiana Supreme Court precedent was clear that this general rule applied to all domestic animals—and not just cats and dogs—the court declined their invitation to alter the standard. The trial court's entry of summary judgment in favor of the camp was therefore affirmed.
