IN - Vehicle - Chapter 30. Immunity for Removing a Domestic Animal from a Locked Motor Vehicle

Summary: This Indiana chapter on pets in motor vehicles was enacted in 2017. Under the chapter, "domestic animal" means a dog, cat or other vertebrate animal kept as a household pet (not including livestock). Section 34-30-30-3 provides that a person who forcibly enters a motor vehicle to remove a domestic animal from a motor vehicle is liable for one-half the cost of repairing the damage to the motor vehicle caused by the forcible entry. To meet this immunity, the person must reasonably believe that the domestic animal is in imminent danger of suffering serious bodily harm. The person must do all the following first: (1) determine the motor vehicle is locked and forcible entry is necessary to remove the domestic animal; (2) call 911 or attempt to contact law enforcement/animal control; (3) use no more force than is necessary to remove the domestic animal from the vehicle; and (4) remain with the animal until first responders or law enforcement arrive. The statute gives complete immunity from the costs of damage to any first responder, law enforcement/animal control officer, public safety government employee, or veterinary professional. Finally, the chapter immunizes the owner of the domestic animal from liability for bites or physical injury to the rescuer.

AZ - Motor vehicle - 12-558.02. Limited liability; removing minor or confined animal from motor vehicle; definition

Summary: This Arizona law insulates a person from liability for civil damages when he or she uses reasonable force to enter a locked and unattended motor vehicle to remove a minor or confined domestic animal if certain factors apply. The person first must determine that the motor vehicle is locked or there is no reasonable manner in which the person can remove the minor or domestic animal from the vehicle. Before entering the vehicle, the person must notify law enforcement or first responders. No more force than is necessary to remove the animal or minor may be used and the person must remain with the minor or domestic animal until first responders arrive. For the purposes of this section, “domestic animal” means a dog, a cat or another animal that is domesticated and kept as a household pet.

Washington v. Olatoye

Summary: This New York case involves an appeal by a public housing tenant after his petition to declare his dog an assistance animal was denied and he was placed on probation with instructions to his dog from the premises. The denial stems from an incident where Petitioner's English Bulldog "Onyx" allegedly bit a NYCHA employee when the employee was delivering a hotplate to petitioner's apartment when petitioner was not home. After the incident, NYCHA notified petitioner that it would seek to terminate his tenancy for non-desirability and breach of its rules and regulations. Petitioner suffered from mental illness as well as a traumatic brain injury and was in the process of trying to register Onyx as an assistance animal, which was validated by a letter from the psychiatric support center where he received services. At a hearing, the NYCHA hearing officer sustained the charges against petitioner, required him to remove the dog from his apartment immediately and placed him on probation for one year. It did not address petitioner's request for an assistance animal as a reasonable accommodation and ignored the mental health records submitted into evidence. On appeal, this court first noted that housing providers are required to allow a person who proves their burden of showing that an animal assists them with aspects of their disability to keep an assistance animal. Here, the hearing officer engaged in no such analysis and relied on the "direct threat" exemption to the Fair Housing Amendments Act. Because there was no initial record that addressed petitioner's reasonable accommodation request, the appellate court was left with an insufficient record that precluded adequate review. Thus, the petition was held in abeyance and this court remanded the proceeding to NYCHA for a determination, on the existing record, in accordance with this decision.

Finn v. Anderson

Summary: This replevin action concerns ownership of an "indoor/outdoor" cat named "Sylvester" or "Marshmallow," depending on perspective. In September 2018, plaintiffs found an unidentified, thin, white cat hanging around their house looking for food. After several months of feeding the cat, in January 2019, plaintiffs decided to bring the cat inside and take it to a vet, where he was de-wormed, vaccinated, treated for fleas, microchipped, and dubbed "Sylvester." A few weeks later, Sylvester accidentally got out of plaintiff's house where plaintiff found out from a neighbor that the cat was taken back by the Defendant, who claimed that Sylvester is actually "Marshmallow" and had been plaintiff's indoor/outdoor cat since 2009. Plaintiff then filed a replevin action against defendant to recover legal possession of Sylvester, aka Marshmallow. The City Court, New York, Jamestown, Chautauqua County first noted that, regardless of how people feel about their dogs and cats, New York law treats them as personal property and even "chattel." While the court observed that the trend has been the "de-chattelization" of household pets in New York, it has not gone so far as to adopt a "best interests" standard to replace the superior possessory rights standard. The court noted that there is inherent difficulty in applying a best interests standard with pets because there is no practical way of gauging a pet's feelings and assessing its interests. The court further stated that New York Courts have developed a “quasi-interests based standard” for pets that considers highly subjective factors. Significantly, the court declared the following: "[w]hile it appears the Appellate Division, Fourth Department, has not addressed the issue, this Court concludes that it is time to declare that a pet should no longer be considered “personal property” like a table or car." Thus, using a "best for all concerned" articulated in Raymond v. Lachmann in 1999, this court weighed the factors whether to place Sylvester/Marshmallow with plaintiff or defendant based on the care provided by both parties. The court found, in a very close decision, that the “best interests of all concerned” test leaves the custody of the cat, Sylvester/Marshmallow, with the defendant. While the court was convinced that plaintiffs were genuinely concerned for Sylvester's/Marshmallow's welfare and spent time and money on his care, it appears that Sylvester/Marshmallow may have “voted with his feet” to return to his home of ten years with the defendant and her children. The Court found in favor of the defendant, and plaintiff's claim was dismissed.

NV - Bestiality - 201.455. Bestiality; penalties

Summary: This Nevada law, enacted in 2017, prohibits bestiality. Convicted violators face the relinquishing and permanently forfeiting ownership or possession of all animals which are in the same household as the person to an animal shelter, an organization that takes into custody animals which have been abused or neglected, or a society for the prevention of cruelty to animals. The court may also impose a possession ban on owning or keeping any animal for a period determined by the court. Those convicted must undergo a psychological evaluation and any recommended counseling and must pay all reasonable costs incurred for the care and maintenance of the animal involved in the crime and any other animal relinquished by the person. If the person convicted of the crime of bestiality is not the owner of the animal involved in the crime, reimbursing the owner of the animal for all medical expenses incurred for treating the animal.

NV - Sales, pet - 597.997. Prohibition on certain offers to lease living animal or goods

Summary: This Nevada law, enacted in 2017, prohibits a person from offering a lease on living animals for personal or household use, if the living animal is expected to have not more than a de minimis residual financial value at the end of the term of the lease or contract. The failure of a person to comply with this section constitutes a deceptive trade practice. A violation of this section constitutes consumer fraud for the purposes of NRS 41.600

Wilkison v. City of Arapahoe

Summary: Brooke Wilkison (Brooke) got an American Staffordshire Terrier (pit bull) in 2015. In 2016, the city of Arapahoe passed an ordinance regarding dangerous dogs which contained a restriction on owning a Rottweiler or an American Staffordshire Terrier within city limits. The ordinance allowed for dogs licensed prior to January 1, 2017 to be grandfathered in as acceptable. Brooke did not have his dog licensed prior to the that date. Law enforcement told Brooke he could not keep the dog. Brooke filed suit seeking a declaratory judgment and an injunction to prevent Arapahoe from implementing and enforcing the ordinance. The trial court found for Brooke and Arapahoe appealed. Arapahoe's first assignment of error is that the court erred by applying the Fair Housing Act (FHA) to the ordinance. The Court found that Arapahoe was not exempt from the strictures of the FHA. Arapahoe's second assignment of error was that the Court erred by enjoining enforcement of the ordinance against Brooke because Brooke's accommodation is not reasonable and necessary. The Court found that Brooke failed to meet his burden of proof that his requested accommodation is necessary for him to receive the same enjoyment from his home as a non-disabled person would receive. Brooke already owned another dog and the ordinance only covered certain dog breeds. Brooke's other claims for relief were remanded to the district court. In conclusion, the district court erred in entering a declaratory judgment and enjoining Arapahoe from enforcing the ordinance as applied to Brooke.

State v. Schuler

Summary: Appellant is appealing an animal cruelty conviction. A deputy dog warden received a report from a deputy sheriff who observed a pit bull on appellant's property who was unable to walk and in poor condition while responding to a noise complaint. Appellant released the dog to the deputy and the dog was later euthanized. While the deputy was on appellant's property she observed two other dogs that were extremely thin which prompted the deputy to return to the appellant's house the next day, but the appellant was in the hospital. The deputy later returned to the appellant's home a few days later and the appellant's ex-wife allowed the deputy to perform an animal welfare check on the property. Two Australian cattle dogs were very muddy and in an outdoor kennel with no food or water. Numerous chickens, rabbits, mice, snakes, and raccoons were also observed inside and outside the house all living in cramped, filthy conditions. The deputy went to the hospital and the appellant signed a waiver releasing the raccoons and snakes to the wildlife officer, but the appellant refused to release the other animals to the deputy. As a consequence a search warrant was obtained. "Two raccoons, 3 black rat snakes, 8 dogs, 7 chickens, 3 roosters, 17 rabbits, 5 rats, 200 mice, and 2 guinea pigs were removed from the property." Appellant was charged by complaints with five counts of cruelty to animals and two counts of cruelty to companion animals. An additional complaint was filed charging appellant with one count of cruelty to a companion animal (the euthanized pit bull). The appellant raised 3 errors on appeal. The first error is that the court lacked subject-matter jurisdiction to convict him of animal cruelty. The Court found that the complaint charging the appellant with animal cruelty in counts B, C, and D were not valid because it did not set forth the underlying facts of the offense, did not provide any of the statutory language, and failed to specify which of the 5 subsections the appellant allegedly violated. Therefore, the Court lacked subject-matter jurisdiction to convict the appellant and the animal cruelty conviction regarding the three counts for the rabbits was vacated. The second error appellant raised was that his conviction for cruelty to companion animals for the two Australian cattle dogs was not supported by sufficient evidence. The Court overruled appellant's second error because it found that the state had presented sufficient evidence to show that the appellant negligently failed to provide adequate food and water for the Australian cattle dogs. The third error the appellant raised was that the Court erred by ordering him to pay $831 in restitution. The Court also overruled appellant's third error since the appellant stipulated to paying the restitution. The judgment of the trial court was affirmed in all other respects.

Hollendale Apartments & Health Club, LLC v. Bonesteel

Summary: The Plaintiff owns and operates an apartment complex with a policy that prohibits defendants from keeping a dog on the premises. The Defendant, Bonesteel, began renting an apartment at Plaintiff's complex in 2011 under a one-year lease. Defendant continued to renew his one-year lease for additional one-year terms until 2014. Defendant's therapist sent a letter to the Plaintiff requesting an exception to the no dog policy so that the Defendant could have an emotional support animal. The Plaintiff denied the request but stated that it would allow a bird or cat or an early termination of Defendant's lease. The Plaintiff filed an action seeking a judgment declaring that the Plaintiff's refusal to permit the Defendant to have an emotional support dog was not in violation of the Fair Housing Act (FHA) and the Human Rights Law (HRL). The Plaintiff subsequently reduced the Defendant's lease renewal term to three months. The Defendant filed counterclaims on grounds of discrimination. The Supreme Court of New York also granted a motion allowing the Attorney General to intervene. The Attorney General asserted counterclaims on similar grounds to those raised by the Defendant. After a nonjury trial, the trial court issued a judgment that the Plaintiff's actions did not violate the FHA and the HRL. The Defendant then appealed. On appeal, the Supreme Court addressed the question of whether the Plaintiff's claims were justiciable even though the matter was not raised by the parties. Since the Plaintiff had already denied the Defendant's request for an exception to the policy when it filed the action and no harm to the Plaintiff occurred or was impending, it was essentially asking the Court to issue an advisory opinion which is not an exercise of judicial function. Therefore, the Court dismissed the Plaintiff's declaratory judgment. The Court then considered the Defendant's counterclaims since concrete injuries were alleged. The only two arguments addressed were whether the Defendant actually had a qualifying disability within the meaning of the FHA and the HRL and whether the accommodation requested was necessary to afford the Defendant an equal opportunity to use and enjoy his dwelling. The Court concluded that the Defendant met his burden to establish that he is disabled within the meaning of the FHA and HRL. The Court also found that the Defendant "offered sufficient evidence that having an emotional support dog would affirmatively enhance his quality of life by ameliorating the effects of his disability, and thus demonstrated necessity within the meaning of the FHA and the HRL." Lastly, the Court found that the Plaintiff retaliated against the Defendant by reducing his lease renewal terms to three months. Accordingly, Defendant was entitled to judgment in his favor on the retaliation counterclaims.

CA - Declaw, debark - § 1942.7. Conditions on occupancy based on declawing or devocalizing animals

Summary: This California law prohibits any owner or property manager from advertising a requirement, refusing occupancy of, or otherwise requiring a prospective tenant to declaw or devocalize any animal allowed on the premises. A city attorney, district attorney, or other law enforcement prosecutorial entity has standing to enforce this section and may sue for declaratory relief or injunctive relief for a violation of this section. Violation results in a civil penalty of not more than $1,000.

A city attorney, district attorney, or other law enforcement prosecutorial entity has standing to enforce this section and may sue for declaratory relief or injunctive relief for a violation of this section. Violation results in a civil penalty of not more than $1,000.
