Ethical Management of Invasive Species The Burmese Python

Summary: Burmese pythons and other invasive species wreak havoc on local environments and threaten biodiversity globally. Beginning with an overview of the unique challenges posed by the Burmese python in Florida, this article addresses invasive species laws and management that currently exist both in the United States as well as across the globe. The current method for addressing the complications created by the pythons is to capture and destroy them. This process is not the most effective means of addressing biodiversity loss as Burmese python populations are now declining in its native habitat due to overexploitation. The following discussion proposes that these pythons not be captured and killed, but rather humanely captured then released back into its native habitat. This is a logical alternative because (1) capture and release is a more ethical solution and (2) capture and release promotes biodiversity. In addition to managing the current threat of these invasive species, countries must also work to prevent the future growth of unwanted populations. In order to successfully rid South Florida of the Burmese python, while preventing the future spread of invasive species, the laws that allow these invasions to happen must change. This article will explore state and federal controls regarding the management of invasive species as well as offer solutions to strengthening these protections.

Colucci v. Colucci

Summary: This Maine case is an appeal of a divorce proceeding where one party argues the court erred in awarding the parties' dogs to another. In 2017, Suan Colucci filed a complaint for divorce against her husband, Stephen Colucci. In 2019, the court entered a judgment granting the divorce and awarded both dogs “set aside to [Susan] as her exclusive property.” On appeal by Stephen, this court found that undisputed evidence established that "Louise" the dog was acquired five years before marriage, and thus, was nonmarital property. Because no evidence was presented to which of the parties actually acquired Louise in 2010, the judgment was vacated and remanded for further proceedings to determine ownership of Louise.

Dallas Safari Club v. Bernhardt

Summary: Individual elephant sport hunters and their hunting organizations (“Plaintiffs”) filed suit against the United States Fish and Wildlife Service (the “Service”) seeking to import their sport-hunted elephant trophies from Africa into the United States. The Plaintiffs moved for a preliminary injunction requiring the Service to process pending and subsequently filed permit applications. The African Elephant is listed as a threatened species under the Endangered Species Act (“ESA”) and is also a species that is regulated by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (“CITES”). All African elephant trophy imports require the Service to make an enhancement finding, meaning that the killing of the trophy animal will enhance the survival of the species, and issue an ESA permit. Additionally, certain African elephant trophy imports require a non-detriment finding and a CITES import permit. Historically, the Service made periodic countrywide enhancement and non-detriment findings, however, this came to a halt due to a Presidential tweet surrounding media criticism over the Service’s decision to lift the suspension on Zimbabwe’s ESA enhancement finding. The Court found that injunctive relief was not warranted because the Plaintiffs failed to show irreparable harm as to any Plaintiff. The individual Plaintiffs argued that they had suffered both emotional harm and economic harm. However, the Plaintiffs were on notice that their applications could take a significant amount of time to process. Additionally, the emotional distress claimed by the Plaintiffs would be alleviated when the Service issues a decision either granting or denying their permit applications, therefore, the harm that the Plaintiffs were claiming was not irreparable. The Court found that the individual hunter Plaintiffs’ alleged emotional and economic injuries were insufficient to warrant a preliminary injunction. The organizational Plaintiffs argued that they each were suffering irreparable harm derivatively because the Service’s delay in processing permit applications would decrease the popularity of sport hunting in Africa and cause a decrease in funding for conservation efforts. The problem was that the organizational Plaintiffs offered no proof to substantiate this argument. The Court ultimately held that in light of the disruptions caused by COVID-19 and the diminished capacity of the Service to process permit applications during this unprecedented time, it would be unwise and not in the public interest to order the expeditious processing of sport trophy permit applications. The Court denied Plaintiffs’ Motion for a Preliminary Injunction.

Tranchita v. Dep't of Nat. Res.

Summary: Plaintiff Tomi Tranchita alleged that she cared for four abused and abandoned coyotes for 13 years. The coyotes were housed within a fully fenced-in backyard, ate appropriate food, and received medical care from a veterinarian. The Plaintiff possessed a United States Department of Agriculture (USDA) Class C exhibitor’s license which imposed restrictions on the licensee such as unannounced annual inspections by a veterinarian or specially trained animal expert. Plaintiff alleged that she had never been cited for any USDA violations and had passed all inspections. Plaintiff also held an Illinois state permit as a fur-bearing mammal breeder from 2011 to 2016, however, this permit lapsed after Plaintiff failed to pay the annual fee. On April 24, 2019, Illinois Department of Natural Resources (IDNR) executed a search warrant on Plaintiff’s premises. The coyotes were seized during this raid. Plaintiff was told that if she did not sign a relinquishment form that the coyotes would be euthanized or confined to a small space that would end up killing them. IDNR cited Plaintiff for lacking proper permits and for several criminal violations of the Wildlife code. Three of the four coyotes ended up dying from what was believed to be distemper. Plaintiff filed suit alleging claims under the fourth and fourteenth amendments. Plaintiff also filed an emergency motion for preliminary injunctive relief arguing that the coyote’s lives were at risk if they were not returned. Plaintiff alleged that she had a protected property interest in the coyotes pursuant to her federal exhibitor license. The trial court found that Plaintiff did not have a protected property interest in the coyotes because she did not possess the proper Illinois permit at the time of the seizure. The trial court subsequently denied her motion for a preliminary injunction. Plaintiff then appealed. The Court looked to state law to determine whether Plaintiff had a property interest in the coyotes. Under the Illinois Wildlife Code, a fur-bearing mammal breeder permit is necessary in order to possess or raise a coyote. Plaintiff was in violation of Illinois law the moment her permit lapsed in 2016. This made the coyotes contraband since they were possessed in violation of Illinois’ Wildlife Code. No person is permitted to assert legal ownership or a right to possession of property that is contraband. Plaintiff argued that her federal exhibitor’s license recognized a right of property in her coyotes, however, the Court found that the mere possession of a federal exhibitor’s license does not automatically vest a property right in the permit holder. The Court ultimately affirmed the judgement of the trial court.

New Mexico Farm and Livestock Bureau , et. al. v. U.S. Dep't of Interior, et. al.

Summary: The U.S. Fish and Wildlife Service ("Service") designated 764,207 acres in New Mexico and Arizona as critical habitat for the jaguar pursuant to the Endangered Species Act. The area was divided into six individual units. Units 5 and 6 were the ones at issue. Plaintiffs filed suit contending that the Service’s designation of Units 5 and 6 as critical habitat was arbitrary and capricious. The district court ruled in favor of the Service and this appeal followed. There was no concrete evidence that jaguars were present in Units 5 and 6 at any time before 1995. The Service’s reliance on sightings in 1995, 1996, and 2006 to support a conclusion of occupation in 1972 was not based on expert opinion. It was purely speculative. The Court agreed with the Plaintiffs that the Service’s designation of Units 5 and 6 as occupied critical habitat was arbitrary and capricious. The Court further found that in order for an unoccupied area to be designated as a critical habitat, the Service must first find that the designation of the occupied areas is inadequate to ensure conservation of the species. The Service addressed all units together, finding that to the extent they were occupied, they were essential for the conservation of the species. The Court ultimately found that the Service did not follow its own regulations or give a rational explanation for failing to do so and as a result, its designation of Units 5 an 6 as critical habitat was arbitrary and capricious. The decision of the district court was reversed and remanded.

Blankenship v. Commonwealth

Summary: Brandon Scott Blankenship showed up at Wally Andrews’ home although Blankenship had previously been ordered not to come onto Andrews’ property. Blankenship stood outside on Andrews’ property and continued to curse at Andrews and threaten to kill him. Andrews called law enforcement and when they arrived, Blankenship continued his cursing and yelling at the officers. Every time the officers attempted to arrest Blankenship he would ball up his fists and take a fighting stance towards the officers. At some point the officers released a police K-9 named Titan after Blankenship took off running. Blankenship kicked and punched Titan until he backed off. Titan ended up with a digestive injury in which he would not eat and seemed lethargic. Blankenship was indicted for three counts of assault and battery on a law enforcement officer, one count of assault on a law enforcement animal, one count of assault and battery, one count of obstruction of justice, and one count of animal cruelty. The Court struck one count of assault and battery on a law enforcement officer, the count of assault on a law enforcement animal, and the count of obstruction to justice. Blankenship was convicted of the remaining four counts and he appealed assigning error to the sufficiency of the evidence used to convict him. The Court found that Blankenship’s overt acts demonstrated that he intended to place the law enforcement officers in fear of bodily harm which in turn caused the officers to actually and reasonably fear bodily harm. The totality of the circumstances supported Blankenship’s conviction of assault and battery on both the law enforcement officers and Andrews. As for the animal cruelty conviction, the Court found that there was sufficient evidence from which the circuit court could find that Blankenship voluntarily acted with a consciousness that inhumane injury or pain would result from punching and kicking Titan. Blankenship had no right to resist the lawful arrest and his actions against Titan were not necessary, therefore, there was sufficient evidence to support Blankenship’s conviction for animal cruelty. The Court ultimately affirmed and remanded the case.

Scales v. State

Summary: Defendant, Jade Derrick Scales, was convicted of two counts of cruelty to non-livestock animals which constituted a state felony. Michelle Stopka had found two puppies in an alley and took them in. On February 8, 2015, Defendant confronted Stopka in her front yard holding a knife and wearing a mask and brass knuckles. Leonard Wiley, the man Stopka was residing with, confronted the Defendant and a brief confrontation ensued which resulted in both individuals sustaining a cut. Stopka soon discovered that both puppies had been sliced open and were bleeding. The puppies did not survive their injuries. Defendant’s sentence was enhanced to a second-degree felony based on the finding of use or exhibition of a deadly weapon during the commission of, or during immediate flight following, the commission of the offense and the fact that the Defendant had a previous conviction for a second-degree-felony offense of burglary of a habitation. Defendant was sentenced to seven years and a fine of $2,000. The Defendant subsequently appealed. The first issue raised on appeal by the Defendant was the deadly weapon finding which the the Court found was appropriate. The second issue regarded a jury instruction error. The Defendant contended that the trial court erred by failing to instruct the jury that a deadly-weapon finding is only appropriate when the weapon is used or exhibited against a human being. The Court found that although a deadly-weapon instruction should not have been given, the error was not egregious and therefore overruled the issue because a jury could have reasonably believed that the Defendant used the same knife to both inflict wounds upon the puppies and Leonard. The failure to provide such a jury instruction did not materially affect the jury’s deliberations or verdict. The third issue raised by the Defendant was that he was provided ineffective assistance of counsel. The Court overruled this issue as well. The Fourth issue raised by Defendant was that his prosecution was based on two identical indictments for the same conduct committed in one criminal episode which violated double jeopardy and due process principles. The Defendant did not preserve his claim of double jeopardy and the Court further found that two separate dogs were the object of the criminal act and each dog could have been prosecuted separately. No double jeopardy violation was found on the face of the record and, therefore, the Defendant did not qualify for an exception to the preservation rule. The fifth issue Defendant raised was that his sentence was illegal because the range of punishment for the offense for which he was convicted was illegally enhanced. The Court overruled this issue because his conviction was not illegally enhanced. The trial court’s judgment was ultimately affirmed.

Douglas Furbee, et al. v. Gregory L. Wilson, et. al.

Summary: Shelly Linder lived in an apartment complex with a no-pet policy. Linder asked if she could have an emotional-support animal and provided a letter from a licensed family and marriage therapist, which stated that Linder had a disability and required an emotional-support animal to help alleviate her symptoms. The letter did not identify a specific disability and the landlord subsequently requested more information from Linder. Linder did not provide any additional information and instead brought her cat into her apartment as her emotional-support animal. The landlord charged Linder a fine after discovering the cat on the premises and gave her seven days in which to remove the cat. Linder failed to comply which led to Linder’s eviction. The Indiana Civil Rights Commission filed a complaint against the landlord on behalf of Linder in Delaware Circuit Court alleging that the landlord failed to accommodate her request for an emotional-support animal in turn violating the Indiana Fair Housing Act. The trial court denied summary judgment for the landlord and this appeal followed. The landlord conceded that Linder was disabled and requested a reasonable accommodation, however, the landlord argued that it was not given enough information from which to “meaningfully” review Linder’s request. The Delaware Court of Appeals agreed that the Landlord did not have sufficient information to meaningfully review Linder’s request and because Linder did not inform the Landlord about her disability and her need for the cat, she was acting in bad faith. Assessing a Person’s Request to Have an Animal as a Reasonable Accommodation Under the Fair Housing Act

Summary: This guidance replaces HUD’s prior guidance, FHEO-2013-01,on housing providers’ obligations regarding service animals and assistance animals. In particular, this guidance provides a set of best practices regarding the type and amount of documentation a housing provider may ask an individual with a disability to provide in support of an accommodation request for a support animal, including documentation of a disability (that is, physical or mental impairments that substantially limit at least one major life activity) or a disability-related need for a support animal when the disability or disability-related need for the animal is non-obvious and not known to the housing provider. By providing greater clarity through this guidance, HUD seeks to provide housing providers with a tool they may use to reduce burdens that they may face when they are uncertain about the type and amount of documentation they may need and may be permitted to request when an individual seeks to keep a support animal in housing.

This guidance replaces HUD’s prior guidance, FHEO-2013-01,on housing providers’ obligations regarding service animals and assistance animals. In particular, this guidance provides a set of best practices regarding the type and amount of documentation a housing provider may ask an individual with a disability to provide in support of an accommodation request for a support animal, including documentation of a disability (that is, physical or mental impairments that substantially limit at least one major life activity) or a disability-related need for a support animal when the disability or disability-related need for the animal is non-obvious and not known to the housing provider. TX - Restaurant - § 437.025. Requirements for Dogs in Outdoor Dining Areas; Municipal Preemption

Summary: This Texas law from 2019 allows food establishments to permit customers to have dogs in outdoor dining areas under certain conditions. Among other things, the restaurant must post a conspicuous sign informing patrons that dogs are permitted, create access so dogs do not enter the interior of the restaurant, require customers to keep dogs on leashes and off tables and chairs, and make sure there is no food preparation in the dog-friendly dining area. A municipality may not adopt or enforce an ordinance, rule, or similar measure that imposes a requirement on a food service establishment for a dog in an outdoor dining area that is more stringent than the requirements listed in the statute.
