Commonwealth v. Gosselin

Summary:

A woman was convicted of unlawful taking or possession of game or wildlife for owning a domesticated squirrel.  The Court of Appeals reversed the conviction  They reasoned since the squirrel was domesticated in South Carolina, and South Carolina does not have any prohibition against the taking and domestication of squirrels, the trial court could not rely on the Pennsylvania statute prohibiting such.

State v. Saurman

Summary:

The court reaffirmed the tenet that it is a proper exercise of state police power to adopt measures to protect wild animals as a resource for all citizens.  In doing so, the court held that it was a proper exercise of police power for the legislature of Ohio to enact a wild animal "shining" prohibition.  Appellants challenged the law as unconstitutional because it ostensibly outlawed otherwise innocent conduct, as an individual can shine for wild animals without the purpose of hunting those animals.  The court disagreed, finding that the statute's purpose was to counteract the problems related to enforcement, since it was difficult to ascertain which individuals shining from vehicles also carried hunting implements.

Barrett v. State

Summary:

This case concerns a New York law that protected beavers and their habitat in New York by stating that no one "shall molest or disturb any wild beaver or the dams, houses, homes or abiding places of same."  The claimants owned land that endured considerable commercial destruction due to the beavers that were present.  Claimants were initially awarded damages and alleged on appeal that the law represented an unconstitutional exercise of police power and, that, since the beavers were "owned" by the state at the time of the destruction, the state is liable for the damage.  The Court disagreed, finding the ownership of wildlife is in the state in its sovereign capacity, for the benefit of all the people.  As a result, the state was acting in its proper police power authority and is not liable for the damage that ensued from "liberating" the beaver.

Summary:

Defendant was convicted of two counts of cruelty to animals, two counts of unlawful hunting, and negligent use of firearm. On appeal, the Supreme Court held that "any animal," within meaning of animal cruelty statute, applied only to domesticated animals and wild animals previously reduced to captivity, and thus, the animal cruelty statute did not apply to defendant's conduct in snaring two deer.  The court also held that even if the Legislature had intended to protect wild animals in Section 30-18-1, New Mexico's laws governing hunting and fishing preempt the application of Section 30-18-1 to the taking of deer by Cleve in this case.

Citizens for Balanced Use v. Maurier

Summary:

Upon the Montana Department of Fish, Wildlife, and Parks’s decision to relocate a brucellosis-free herd of bison out of Yellowstone National Park and into tribal lands, plaintiffs sought an injunction to halt this movement until the department complied with MCA § 87-1-216.  The District Court granted the plaintiffs a preliminary injunction.  Upon appeal by defendants and defendant intervenors, however, the Supreme Court of Montana held that MCA § 87-1-216 did not apply and that the District Court relied on erroneous grounds for issuing a preliminary injunction under MCA § 27-19-201(2). The case was therefore reversed, the preliminary injunction vacated and the case was remanded back to the District Court.

State v. Shook (Unpublished)

Defendant Shook (a non-tribal member) shot and killed a whitetail buck on private property within the exterior boundaries of the Flathead Indian Reservation. Under Wildlife and Parks Commission hunting regulations, big game hunting privileges on Indian Reservations are limited to tribal members only, thereby closing the hunting season to non-tribal members.  On appeal, Shook contended that the regulation was a violation of equal protection because it discriminated based on race.  The court disagreed, finding the classification was political rather than racial because it was established through treaty with the federal government and recognized the unique federal obligation toward Indians.  Thus, the court found the regulation was an "entirely rational" means to preserve wildlife populations for hunting by Indians.

State ex rel. Missouri Dept. of Conservation v. Judges of Circuit Court of Reynolds County

Summary:

Sixteen residents who violated portions of the wildlife code challenged the hearings that they received before a panel from the Department of Conservation, which were not conducted in an evidentiary fashion or recorded.  The Court found that, pursuant to the rulemaking authority granted under the State constitution to the Department of Conservation, the regulations provide for noncontested hearings unless the permitee is entitled by law to a contested hearing (a "contested case" is a proceeding before an agency in which legal rights, duties or privileges of specific parties are required by law to be determined after hearing).  The Court found that no such law applies to this case, citing a case that determined hunting is not a fundamental right.

After the Secretary of the Interior promulgated regulations establishing a game code regulating hunting on the reservation, the Arapahoe Tribe of Wyoming sued the Secretary and other federal officials, seeking declaratory and injunctive relief to prevent enforcement of the regulations.  At issue, was  a concern over the declining big game populations on the reservation and surrounding areas due to an unusually harsh winter and over-hunting.  The Court of Appeals held that the government had the right to enact the game code because the rights of two tribes overlapped with regard to a limited resource, and the "[g]overnment's right extends to preventing overuse by the Arapahoe of their shared right when that overuse endangers the resource and threatens to divest the Shoshone of their right."  Where there exists a risk of extinction, the government may enact interim game code measures to prevent the threat when the tribes fail to enact their own game codes.

Animal Lovers Volunteer Ass'n, Inc. v. Cheney

Summary:

Plaintiff Animal Lovers Volunteer Association (ALVA) brought suit against Defendants United States Fish and Wildlife Service, United States Navy and United States Department of Defense alleging that the EIS for trapping red fox at a national wildlife refuge violated NEPA, the National Wildlife Refuge System Administration Act (NWRSAA), and the APA. The agencies had recently begun trapping red fox at the Seal Beach National Wildlife Refuge in order to protect two endangered bird species on the Refuge, the California least tern and the light-footed clapper rail. On review of defendants' motion for summary judgment, the District Court held that the predator control program did not violate the NWRSAA and the APA. Further, plaintiff's claim that defendants' decision not to terminate oil production at the refuge, which they contended placed the endangered species at a greater risk than the predation by foxes, was based on substantial evidence that was supported by the findings in the EIS. The court found that a rational connection existed between the findings and the decision to allow the limited amount of oil production to continue. Thus, defendants' conduct complied fully with the requirements of the NWRSAA and the APA.

Summary:

This case was brought the Humane Society of the United States and various coalitions of homeowner/citizens against the United States Secretary of the Interior and the Director of the Fish and Wildlife Service to prevent the implementation of defendants' decision to permit limited public deer hunting on a national wildlife refuge in Fairfax County, Virginia. On cross motions for final judgment on the record, the District Court held that the suit under Endangered Species Act was precluded by failure to give proper presuit notice. The court stated that the ESA clearly states that “written notice” of the violation must be given to the Secretary and to the violator as a condition precedent to suit. The court also found that the FWS's decision took account of relevant factors and thus was not arbitrary or capricious.
