Summary: The Plaintiff brought an action of ‘tutela’ (Constitutional mechanism that is preferential and summary created for the purpose of protection of fundamental rights) against Corporación Autónoma Regional de Caldas ‘CORPOCALDAS’, arguing that ‘CORPOCALDAS’ had violated the fundamental rights to health, personal integrity, life and human integrity of the Plaintiff’s wife, who became severely depressed when the Defendant confiscated an amazonian parrot she kept as her pet. The Plaintiff argued that the parrot was the only company the Plaintiff’s wife had for over five years, and that the confiscation of their parrot, was a violation of the Plaintiff's wife's fundamental rights. Furthermore, the Plaintiff argued that his wife was 65 years old, had raised the parrot that was never abused or neglected and who was allowed to move freely as her wings were never trimmed. The Plaintiff sought the the return of the parrot by the environmental authority ‘CORPOCALDAS’ to his wife, as well as the granting of the parrot’s title to her. The Court was able to find that the Plaintiff’s wife’s health was indeed diminished after the confiscation of the bird and the she had to undergo treatment as a result of it. However, the court found that the Plaintiffs were unable to provide evidence tending to prove that they had acquired the animal in a legal manner, as no permit, hunting license, or evidence that the parrot was obtained from a legal breeder were provided. The court determined that CORPOCALDAS did not overstep its responsibilities, as it is its duty to protect the wild fauna of the nation. Touching on the issue of whether the the fundamental rights of the plaintiff had been violated, the court concluded there was not such violation, as the environmental authority’s action was legal, reasonable, necessary and legitimate, and the Plaintiff did not obtained the parrot in accordance with the requirements legally established. In this case, the collective right to a healthy environment prevailed over the personal interest of the Plaintiff. The Constitutional Court affirmed the judgment of the ‘Juzgado Segundo Laboral del Circuito de Manizales’.

Colombia, LEY 611, 2000

Summary: Ley 611, 200 regulates the usage and management of terrestrial and aquatic fauna, and their products. To accomplish this goal, this law permits such use and management to be done through direct harvest of species in their environment, or through zoo breeders of open and/or close cycle. It requires terrestrial and aquatic fauna to be used to obtain economic gain in a way that does not lead to the diminishment of the different species populations in a long term. To do so, this law requires the acquisition of operating licenses before the breeders begin their operations.

Ley 611, 200 regulates the usage and management of terrestrial and aquatic fauna, and their products. Friends of Animals v. United States Fish & Wildlife Serv.

Summary: Friends of Animals, a non-profit animal advocacy organization, sued the United States Fish and Wildlife Service when the Service began issuing permits that allowed the scientific taking of barred owls, both lethally and non-lethally, for the purpose of preserving the habitat of the northern spotted owl, a threatened species. The two species compete with each other in the same territory within Oregon and Northern California. Friends of Animals alleges that these permits are a violation of the Migratory Bird Treaty Act (MBTA), which limits the removal of birds from their habitat only for scientific purposes. The theory set forth by the plaintiff is referred to as the ‘same-species theory,’ meaning that the removal of a bird must be for the scientific purposes pertaining to the very species that was taken. This theory is based on language found in the Mexico Convention which is referenced in the MBTA. The lower court granted FWS' motion for summary judgment. On appeal, the Ninth Circuit affirmed the district court, holding that the plain text of the MBTA and Mexico Convention do not demand the same-species theory in the removal of a bird. Specifically, the court concluded that the “used for scientific purposes” exception in Article II(A) of the Mexico Convention includes taking birds to study whether their absence benefits another protected bird species.

Colombia, DECRETO 1608, 1978

Summary: Decreto 1608 regulates the Code of Natural Renewable Resources and environmental protection regarding terrestrial wildlife, as well as all the activities and products relating to this resource. Even though Decreto 1608, lays out general dispositions for the conservation and protection of terrestrial wildlife, Article 5 establishes that Decreto 1608 applies to “the management of cetaceans, sirenians, pinnipeds, marine and semi-aquatic birds, sea turtles and fresh or brackish water, anuran batrachians and all other species that do not complete their life cycle in the aquatic environment, but that depend on it for their subsistence.” In order to guarantee the efficient use of wildlife and its products, Decreto 1608, requires specific licenses for the exploitation of wildlife and its products. It establishes the parameters and limitations for the activity of hunting and the granting of licenses for this purpose.

Safari Club International v. Zinke

Summary: This case dealt with an action brought by an organization of safari hunters and firearm advocacy association under the Administrative Procedures Act (APA) and the Endangered Species Act (ESA) against the U.S. Fish and Wildlife Services (FWS), challenging the decision to suspend imports of sport-hunted African elephant trophies from Zimbabwe. The U.S. District Court for the District of Columbia entered summary judgment in FWS's favor, and the organization and association appealed. Under the ESA, sport-hunted African elephant trophies may only be imported into the United States if, among other things, the FWS makes “[a] determination ... that the killing of the trophy animal will enhance the survival of the species”. The Court of Appeals held that 1) FWS's interpretation of Special Rule forbidding import of sport-hunted elephant trophies was permissible; 2) FWS could base finding that killing of African elephants did not enhance species' survival on absence of evidence that sport hunting enhanced survival of species; 3) FWS's conclusion that it lacked evidence to make finding that killing African elephants in Zimbabwe would enhance survival of species rebutted any presumption that importation did not violate any provision of ESA or regulation issued pursuant to ESA; 4) removal of enhancement requirement from Convention on International Trade in Endangered Species of Wild Fauna and Flora did not require FWS to reconsider Special Rule; 5) finding constituted rule rather than adjudication; and 6) FWS's failure to engage in notice-and-comment prior to finding was not harmless error. Affirmed in part and reversed in part, and remanded so the FWS can initiate rule making to address enhancement findings for the time periods at issue in this case.

WA - Wolf - Chapter 16.001. Wolf-Livestock Management

Summary: These statutes create the northeast Washington wolf-livestock management grant within the department of agriculture. Further, a four-member advisory board is established to advise the department on the expenditure of the northeast Washington wolf-livestock management grant funds. The board must help direct funding for the deployment of nonlethal deterrence resources, including human presence, and locally owned and deliberately located equipment and tools. In addition, the northeast Washington wolf-livestock management account is created as a nonappropriated account in the custody of the state treasurer.

Sturgeon v. Frost

Summary: In this case, Sturgeon sought to use his hovercraft in a National Preserve to reach moose hunting grounds. Sturgeon brought action against the National Park Service (NPS), challenging NPS’s enforcement of a regulation banning operation of hovercrafts on a river that partially fell within a federal preservation area in Alaska. Alaskan law permits the use of hovercraft, NPS regulations do not; Sturgeon argued that Park Service regulations did not apply because the river was owned by the State of Alaska. Sturgeon sought both declaratory and injunctive relief preventing the Park Service from enforcing its hovercraft ban. On remand, the Court of Appeals held that regulation preventing use of hovercraft in federally managed conservation areas applied to the river in the National Preserve. While the hovercraft ban excludes "non-federally owned lands and waters" within National Park System boundaries, this court found that the waterways at issue in this case were within navigable public lands based on established precedent. The district court's grant of summary judgment to defendants was affirmed.

GA - Hunting - § 27-3-28. Possession of wildlife accidentally killed by motor vehicle

Summary: This Georgia states that except as otherwise provided in this Code, any person may lawfully possess native wildlife which have been accidentally killed by a motor vehicle. However, the person taking possession of a bear accidentally killed by a motor vehicle shall notify a law enforcement officer within 48 hours after taking possession of the bear; and this Code section shall not authorize any person to take possession of any animal of a species designated as a protected species under Article 5 of this chapter or under federal law.

New Mexico Department of Game and Fish v. United States Department of the Interior

Their goal was to increase the recovery of the wolf population more rapidly. The Plaintiff, New Mexico Department of Game and Fish ("Department") brought action against FWS and the United States Department of Interior. The Department requested declaratory and injunctive relief to prohibit FWS from releasing more Mexican gray wolves within New Mexico’s borders. Other wildlife organizations and various states also intervened as Defendants. The United States District Court for the District of New Mexico, entered an order granting the Department a preliminary injunction. The Defendants appealed. The United States Court of Appeals, Tenth Circuit, reversed and remanded. The Court held that: (1) the Department failed to establish a significant risk of irreparable injury to its wildlife management efforts, and (2) the Department failed to establish a significant risk of irreparable injury to New Mexico’s sovereignty.

United States v. Charette

Summary:

In this case, Brian F. Charette filed an appeal after he was sentenced to six months of imprisonment and ordered to pay $5,000 in restitution for shooting and killing a grizzly bear in violation of the Endangered Species Act. Charette argued three issues on appeal: (1) that the trial court's denial of a jury trial violated his constitutional rights; (2) that the trial court erred in defining the elements of his charged offense; and (3) that the trial court erred in denying Charette's Rule 29 motion for a judgment of acquittal. The court found that the trial court did not err in denying a jury trial because Charette’s offense was considered a petty offense because it carried a maximum sentence of six months. For all crimes that are considered petty offenses, the Sixth Amendment right to a trial by jury is not triggered. Lastly, the court addressed Charette’s Rule 29 motion which calls for an acquittal if the essential elements of the offense are not proven beyond a reasonable doubt. In order for someone to be convicted of knowingly taking an endangered species the government must prove beyond a reasonable doubt, that: (1) the defendant knowingly killed the animal; (2) the animal was engendered; (3) the defendant had no permit to kill the animal; and (4) the defendant did not act in self-defense or defense of others. Charette argued that the government failed to prove that he did not have a permit to kill the grizzly bear. The court ultimately found that the government did prove this element on the basis that Charette told officers that he did not report shooting the bear because he did not want to deal with the “hassle.” The court found that it was reasonable to believe that had Charette had a permit to kill the grizzly bear, he would not have found reporting it to be a hassle and therefore the government sufficiently established this element. As a result, the court affirmed the lower court’s decision.
