Justice by and through Mosiman v. Vercher

Summary: The Oregon Court of Appeals, as a matter of first impression, considers whether a horse has the legal capacity to sue in an Oregon court. The Executive Director of Sound Equine Options (SEO), Kim Mosiman, filed a complaint naming a horse (“Justice”)as plaintiff with the Mosiman acting as his guardian, and claiming negligence against his former owner. In the instant appeal, Mosiman challenges the trial court's grant of defendant's motion to dismiss. In 2017, defendant's neighbor persuaded defendant to seek veterinary care for her horse. The veterinarian found the horse to be about 300 pounds underweight with significant walking difficulties and other maladies. The horse was voluntarily surrendered to Mosiman who eventually nursed the animal back to good health. In 2018, Mosiman filed a complaint on Justice's behalf for a single claim of negligence per se, alleging that defendant violated the Oregon anti-cruelty statute ORS 167.330(1) by failing to provide minimum care. Defendant moved to dismiss the complaint on the grounds that a horse lacks the legal capacity to sue and the court granted dismissal. Specifically, the trial court expressed concern over the "profound implications" of allowing a non-human animal to sue and stated that an appellate court could come to a different conclusion by "wad[ing] into the public policy debate involving the evolution of animal rights." Here, the appellate court first found no statutory authority for a court to appoint a guardian for an animal because "a horse inherently lacks self-determination and the ability to express its wishes in a manner the legal system would recognize." The animal has a "distinctive incapacity" that sets it apart from humans with legal disabilities that require appointment of a legal guardian. The court reaffirmed the law's treatment of animals as personal property and found no support in the precedent for permitting an animal to vindicate its own legal rights. While Oregon's animal welfare laws recognize animals as beings capable of feeling pain, this makes them a special type of property and imposes duties on the human owners rather than rights to the animal victims. The court held that only human beings and legislatively-created legal entities are persons with the capacity to sue under Oregon common law. The court emphasized that this holding does not prevent Oregon laws from ever recognizing an animal as a legal person, but the courts are not the appropriate vehicle to do that. Accordingly, this court affirmed the trial court's judgment dismissing the complaint with prejudice.

Nonhuman Rts. Project, Inc. v. Breheny

Summary: This New York case centers on a petition of habeas corpus for an elephant named "Happy" who is housed at the Bronx Zoo. Petitioner Nonhuman Rights Project is a not-for-profit corporation with a mission of seeking to establish that “at least some nonhuman animals” are “legal persons” entitled to fundamental rights, including “bodily integrity and bodily liberty.” In 2018, petitioner commenced this habeas proceeding in Supreme Court against respondents James J. Breheny, Director of the Bronx Zoo, and the Wildlife Conservation Society, the organization that operates the Zoo. Petitioner sought a writ of habeas corpus “on behalf of Happy,” an Asian elephant that petitioner claimed was unlawfully confined at the Zoo in violation of her right to bodily liberty. Happy has resided at the Bronx Zoo for the last 45 years and has been held in captivity since she was approximately one year old. Petitioners request that she be transferred to an “appropriate sanctuary" where she could potentially be integrated with other elephants. To support its request, petitioner proffered affidavits from several experts specializing in elephant study and care attesting to the general characteristics of elephants. The Zoo respondents opposed petitioner's application and requested dismissal of the petition for lack of standing and failure to state a cause of action. Specifically, respondents argued that there was no legal basis for habeas relief and that Happy's living conditions comply with all relevant laws and accepted standards of care. The Supreme Court dismissed the petition on the ground “that animals are not ‘persons’ entitled to rights and protections afforded by the writ of habeas corpus” and that habeas relief is not available for an animal. On petitioner's appeal, the Appellate Division unanimously affirmed, reasoning that “the writ of habeas corpus is limited to human beings.” While the court acknowledged that the law recognizes that animals are not mere "things," and existing animal protection laws underscore this conclusion, the scope of habeas corpus does not include animals. The court lastly noted that " this case has garnered extraordinary interest from amici curiae and the public . . . Though beyond the purview of the courts, we appreciate that the desire and ability of our community to engage in a continuing dialogue regarding the protection and welfare of nonhuman animals is an essential characteristic of our humanity. Such dialogue, however, should be directed to the legislature." As such, the order of the Appellate Division was affirmed

Animal Legal Def. Fund v. Vaught

Summary: Several animal advocacy organizations filed a complaint against the Vaughts and Peco Foods, Inc. seeking an order that would prevent defendants from bringing a civil suit under Ark. Code Ann. § 16-118-113 (colloquially known as Arkansas' "ag gag" law). The statute at issue provides a civil cause of action for unauthorized access to protected properties described under the law. Plaintiffs claim that the statute violates their right to free speech under the First Amendment by chilling them from engaging in activities protected under the First Amendment. In particular, the plaintiffs have "specific and definite plans" to investigate the defendants' chicken slaughterhouses and pig farms by sending undercover investigators to seek employment with defendants and collect information in an effort to support their mission to "reform[] animal agriculture." The district court found that plaintiffs failed to establish Article III standing to sue, finding that the injury at hand was too speculative. On appeal here, the court noted found that plaintiffs established the three primary elements of standing from the Lujan case ("(1) an injury in fact, (2) a causal relationship between the injury and the challenged conduct, and (3) that a favorable decision will likely redress the injury."). First, but for the statute, plaintiffs allege that they would engage in the protected constitutional conduct. Second, the plaintiffs adequately outlined their intention to engage in a course of conduct that is proscribed by the statute. Finally, the court found a credible threat of enforcement that was objectively reasonable. This is bolstered by the fact plaintiffs have successfully engaged in the conduct at other facilities in the past. While defendants contend that there is no credible threat that they would enforce the statute because these organizations would not find entry to their facilities worthwhile. However, plaintiffs presented allegations that indeed they would be interested in documenting the plaintiffs' operations because of the conditions of pigs in "nearly immovable quarters" and the use of controversial methods of slaughter. The court was equally unpersuaded by defendants' claims that there is no injury in fact since plaintiffs are not poised to publish any information gathered from their facilities. Additionally, plaintiffs sent letters to defendants asking them to waive their rights to sue and neither defendant responded. Thus, the complaint sufficiently established a case or controversy. The lower court judgment was reversed and the case was remanded.

Farm Sanctuary v. United States Department of Agriculture

Summary: Plaintiffs (nonprofit organizations working to protect animals, people, and environments from industrial animal agriculture) filed suit against the USDA and FSIS challenging the implementation of the Modernization of Swine Slaughter Inspection rule, 84 Fed. Reg. 52,300 (Oct. 11, 2019) ("Slaughter Rule”). Plaintiffs contend that the rule allows nearly all pigs in the U.S. to be slaughtered as "unlimited speeds," thereby posing risks to animal welfare and consumer safety. Plaintiffs' lawsuit was later amended to add a claim that challenges Defendants' failure to ban the slaughter of non-ambulatory or "downed" pigs in the rule. Defendants filed motions to dismiss on the grounds that Plaintiffs have no standing to sue. Plaintiffs contend that they have been injured by Defendants' implementation of the Slaughter Rule. Specifically, Plaintiffs argue that the authorization of the high-speed slaughter rule directly conflicts with their organizational missions and redirects resources to counteracting the Slaughter Rule instead of other activities like rescue of animals and advocacy. Some of the plaintiff organizations further allege that their members include consumers who eat pork products and are concerned about the increased health risks they face from consuming products from pigs who have not been adequately inspected as well as impacts to the environment from increased slaughter. In addition, Plaintiffs allege that the FSIS is not consistent in its treatment of downed pigs versus downed cattle, and that downed pigs are inhumanely forced to rise/stand for slaughter resulting in potential exposure to the public of disease and other public health risks. The court first took up Defendants argument that Plaintiffs lack both organizational and associational standing. The Court has reviewed the amended complaint in light of this Second Circuit precedent and finds that Plaintiffs have plausibly alleged that they have been forced to divert resources from mission-critical activities to oppose the Slaughter Rule. In other words, Plaintiffs have plausibly alleged that Defendants’ unlawful practices have impaired and frustrated their ability to engage in mission-related activities and caused a consequent drain on their limited resources, which “constitutes far more than simply a setback to the organization's abstract social interests" sufficient to survive a motion to dismiss. Taking Plaintiffs allegations in their pleadings as true, the Court finds that the amended complaint contains allegations sufficient to support organizational standing. Having found that Plaintiffs have organization standing, the Court need not reach the issue of associational standing. Accordingly, Defendants’ motion to dismiss is denied. Finally, as to the 2020 Action concerning the downed pigs, the Court found that The Court reaches the same conclusion it did in the 2019 Action: that at this stage of the case, Plaintiffs have alleged organizational standing. The Court notes that several other Plaintiffs have submitted declarations from their members, which further explain how those organizations have sustained an injury-in-fact. Plaintiffs have plausibly alleged that they provide additional services beyond mere issue advocacy, that these services have been impaired by Defendants’ actions, and that they have been forced to shift their resources away from those services to oppose the slaughter of downed pigs. Defendants' motions to dismiss were denied.

Kasey v. Beshear

Summary: Appellants, Teresa's Legacy Continues, Inc., a non-profit organization of concerned citizens and taxpayers in Kentucky sued the Governor and Commissioner of Agriculture alleging failure to monitor or enforce compliance with animal shelter statutes (KRS3 Chapter 258, Animal Control and Protection). The appellants contend that in 120 of Kentucky's counties, only 12% are in compliance with the statutes and over 50% are in violation of at least three statutes. In lieu of filing an answer, the appellants filed a motion to dismiss based largely on appellants' lack of standing. In response, the appellants claimed standing based on actual damage and argued that they have "a real and substantial interest in the outcome" because post-tax funds that are supposed to be for shelters will "unjustly enrich[]" the Commonwealth. The circuit court dismissed the complaint for lack of standing in 2018 and this appeal followed. On appeal, this court held that the failure to enforce Kentucky laws is not the particularized injury contemplated under the Lujan test. In fact, the court declined to expand the doctrine of standing to include an injury based on the appellants voluntary expenditure of personal time and resources to care for abandoned animals when they were under no legal obligation to do so. As to the asserted taxpayer standing, the court found that appellants failed to allege in circuit court that funds were being illegally expended and thus, could not consider this argument for the first time on appeal. Further, the animal shelter statutes at issue require only that the Governor and Commission of Agriculture disburse the funds and had no control over the oversight of funding (that goes to the governing board of each county). Thus, the cause of appellants' injuries could not be traced to the appellees. Lastly, the court acknowledged that while appellants have attempted to show standing via citizen and taxpayer status, Kentucky law has not previously considered that avenue. Said the court, "[p]erhaps, given the right facts and circumstances, one could obtain such standing. However, for the reasons set forth above, we cannot say the Appellants have properly pled it here." Affirmed.

Summary: The Animal Legal Defense Fund (“ALDF”), Center for Food Safety (“CFS”), Shy 38, Inc. and Hope Sanctuary are interest groups that aim to protect and advocate for animals and the environment. These interest groups filed suit on December 4, 2018 against the Governor and Attorney General of Kansas seeking a declaratory judgment that the Kansas Animal and Field Crop and Research Facilities Protect Act was unconstitutional. The Act made it a crime to damage or destroy an animal facility or an animal, exercise control over an animal facility or animal from a facility, take photos or videos at an animal facility that that is not open to the public, and remain at an animal facility against the owner’s wishes. Both parties filed cross-motions for summary judgment. ALDF desired to conduct an undercover investigation in Kansas but refrained from doing so out of fear of criminal prosecution under the Act. The Plaintiffs alleged that the Act violated their First Amendment right to freedom of speech. To be subject to criminal prosecution under subsection (a) of K.S.A. 47-1827, the ALDF investigator had to cause physical damage to an animal or the animal facility or its property. The Plaintiffs did not allege that the ALDF investigator intended to cause such physical damage so the ALDF investigator was not at risk of criminal prosecution under the provision and, therefore, ALDF did not demonstrate standing to challenge subsection (a). ALDF alleged sufficient injury to support standing to challenge subsections (b), (c), and (d) of the Act. CFS, Shy 38, and Hope Sanctuary also had standing to challenge those subsections. The Court found that subsections (b), (c), and (d) regulated speech rather than conduct and was content-based rather than neutral-based. The Court ultimately concluded that the Plaintiffs were entitled to summary judgment on their claim that subsections (b), (c), and (d) violated the First Amendment. The Defendants were entitled to summary judgment on their lack of standing claim for subsection (a) and K.S.A. 47-1828.

Goldman v. Critter Control of New Jersey

Summary: Plaintiff, Stuart Goldman, was the former chief humane law enforcement officer for the Monmouth County Society for the Prevention of Cruelty to Animals. Plaintiff alleged that in May of 2015, he learned from a resident of Matawan that Critter Control of New Jersey had trapped a female adult raccoon and removed it from the roof of a house. A few days later, baby raccoons were found in the gutters of that same house. Those baby raccoons allegedly went without sustenance for a week. Plaintiff filed a complaint against Critter Control for violation of New Jersey law. The case was dismissed with prejudice and the court stated that the statute only provided for organizations to seek a civil remedy under the New Jersey statute and that Plaintiff had brought his complaint in his individual capacity and, therefore, lacked standing. Plaintiff had also filed a second case in which the he alleged that Simplicity Farms was mistreating horses. This was ultimately dismissed by the trial court. Plaintiff appealed both cases which were ultimately consolidated on appeal. Plaintiff contended on appeal that he had standing to sue in the name on Monmouth SPCA as a qui tam action and that the court erred by not granting his motion for reconsideration to allow him to amend the complaint with the proper caption. Plaintiff also contended that his complaint against Simplicity Farms should not have been dismissed. Plaintiff argued that the N.J.S.A. 4:22-26 authorized qui tam suits because it provided that “any person in the name of the New Jersey [SPCA] or county SPCA can sue for civil penalties.” Based on the legislative history and the amendments to the PCAA, the Court concluded that the PCAA did not authorize qui tam lawsuits as the Plaintiff contended. The Court found no misapplication of discretion by the trial court denying Plaintiff’s motions to amend his complaints because the amendments would have been futile in light of his lack of standing. The Court affirmed the judgment of the trial court.

The Animal Legal Defense Fund (ALDF) alleged that OGF’s failure to abide by the Federal Endangered Species Act, as well as alleged violations of Washington State animal cruelty laws created a public nuisance. OGF admitted one of the allegations, specifically, that they are not accredited but possess or display Roosevelt Elk. That was an admitted violation of Washington law which makes it unlawful for a non-accredited facility to possess such a species. That single admission supported ALDF’s public nuisance claim in addition to all of the other alleged state violations. The court stated that ALDF met the "low bar" of standing in a public nuisance context. Accordingly, OGF’s Motion to Dismiss was denied.

Rowley v. City of New Bedford

Summary: This opinion concerns the City of New Bedford, Massachusetts' motion to dismiss plaintiff Rowley's (formerly plaintiff "Friends of Ruth & Emily, Inc.") citizen suit for injunction under the federal Endangered Species Act. Plaintiffs allege that two Asian Elephants, Ruth and Emily, were mistreated by the Buttonwood Park Zoo in New Bedford by chaining their legs, housing them in inadequate facilities, failing to provide proper socialization, and failing to provide adequate veterinary care, which gives rise to a "taking" under Section 9 of the ESA. Rowley claims that she is a member of the zoological society there and visits the elephants on a "near daily basis," resulting in “an aesthetic, emotional, and spiritual relationship with Ruth and Emily over the years.” The United States District Court for the District of Massachusetts asked both parties to brief on the issue of standing for the instant action. The court first noted that the ESA expressly authorizes citizen suits for injunctive relief. To survive a motion to dismiss, Rowley must, through facts, clearly demonstrate standing, and then the court must analyze those facts under a multi-pronged approach. To begin, the court distinguished cases that established the proper "animal nexus" for injury in fact with those that did not meet that finding. Here, Rowley's complaint established injury in fact because she lives in New Bedford, is a member of the Zoo's Zoological Society, and observes the elephants on a near daily basis. Rowley alleges that the maltreatment of Ruth and Emily injures this ability because she observes their ongoing suffering while in substandard captivity. The court was not persuaded by New Bedford's claim that Rowley has not established injury in fact because she has no specialized training in wildlife or animal welfare. In fact, this claim ignored precedent from this very circuit that "aesthetic injury" can be established by viewing animals in inhumane conditions. In addition, the court rejected New Bedford's "nonexistent requirement into the injury in fact analysis" that Rowley must have observed or will observe Asian elephants in their native habitats. As a result, the court found Rowley properly established injury in fact. As to the next requirement of causation, the court found that Rowley sufficiently alleged that the Zoo's actions caused the harm complained of for purposes of surviving a motion to dismiss. Finally, as to redressability, the court found that Rowley's request for a declaratory judgment as to the Zoo's treatment of Ruth and Emily, and an injunction prohibiting the Zoo from euthanizing the elephants met this prong. New Bedford's contention that Rowley's further suggestion of moving the elephants to a sanctuary in Tennessee impaired her redressability argument because Rowley did not propose how the cost of relocation would be funded was also rejected. At this stage, the court does not need to determine whether this solution is necessary or feasible. The District Court ultimately held that Rowley demonstrated sufficient standing to pursue her claims. Hence, New Bedford's motion to dismiss was denied.
