NY - Research, animal - Article 5. Laboratories. Title I. General Provisions: State Laboratories; Approved Laboratories.

Summary: The group of statutes provides that the commissioner shall require laboratories and research facilities to treat all animals used in testing humanely, provide food and suitable housing, and that any experiments that inflict or involve pain shall be performed with anesthesia. Each research facility shall be inspected by the commissioner in order to ensure compliance with said rules. In addition, the statutes provide that alternative animal testing methods be utilized when the alternative has been scientifically validated and recommended by the Inter-Agency Coordinating Committee for the Validation of Alternative Methods (ICCVAM) and adopted by the appropriate federal agency.

Julie Marie Grizzel v. James William Hickey d/b/a S & S Farms; Ron Lee Omara and S & S Farms, Inc. aka S.S. Farms Linn County, I

Summary:

The plaintiff in this Oregon case brought an action alleging negligence and intentional infliction of emotional distress against the defendant, who was a licensed animal dealer. Plaintiff owned “My Girl,” a purebred cocker spaniel, whom plaintiff cared for and enclosed in a secure, fenced backyard. While My Girl was secure in her backyard, two other individuals seized her and transported her to defendant Hickey (who was known to be engaged in the business of selling animals to research laboratories).

Animal Legal Defense Fund; Animal Welfare Institute; Valerie Buchanan; Jane Garrison; Nancy Megna, plaintiffs-appellants v. Ann

Summary: In this federal action, plaintiffs (ALDF, the AWI, and three individuals) challenged the USDA's decision not to adopt a Draft Policy that would have provided guidance to zoos, research facilities, and other regulated entities in how to ensure the psychological well-being of on-human primates in order to comply with the Animal Welfare Act. While the district court found that the USDA's decision did not constitute a reviewable final agency decision, the Ninth Circuit Court of Appeals found that the lower court did indeed have authority under the Administrative Procedures Act to review the agency's decision not to create a policy. On June 4, 2007, the Court vacated the previous opinion and dismissed the appeal with prejudice. Two judges wrote separate opinions, concurring and dissenting in part.

ANIMAL LEGAL DEFENSE FUND, ANIMAL WELFARE INSTITUTE, COMPLAINT FOR VALERIE BUCHANAN, JANE GARRISON, AND NANCY MEGNA DECLARATORY

Summary: This action concerns a lawsuit filed by the Animal Legal Defense Fund (ALDF), et al, over the lack of action by the federal agency, the Animal & Plant Health Inspection Service (APHIS) to adopt a policy on what constitutes appropriate conditions for primates in federally licensed or registered facilities. Specifically, the complaint alleges that the failure of the Animal and Plant Health Inspection Service (APHIS) of the United State Department of Agriculture to make a final decision concerning the defendants' proposed “Policy On Environment Enhancement For Nonhuman Primates.” See 64 Fed. Reg. 38,145 (July 15, 1999) (Policy). APHIS determined at least seven years ago that APHIS enforcement officials and the regulated community urgently need such a policy to insure that primates are housed in “physical environments adequate to promote the[ir] psychological well-being,” as required by the Animal Welfare Act (AWA). 7 U.S.C. § 2143. By failing to make a final decision on the proposed Policy, defendants are violating the Animal Welfare Act, 7 U.S.C. § 2143, and are unreasonably delaying and/or unlawfully withholding agency action in violation of the Administrative Procedure Act, 5 U.S.C. § 706(1).

In Cambridge, Massachusetts, research institutions that perform experiments on animals must do so in conformity with all federal, state and local statutes, ordinances and regulations, as well as maintain or establish an autonomous animal care and use committee with the power to disapprove or restrict research, experiments or regarding the care and use of laboratory animals. This ordinance also establishes a Commissioner of Laboratory Animals (CLA) for the purpose of overseeing research institutions and their committees. Penalties for violating these provisions are also provided.

In this action, the New Jersey Society for the Prevention of Cruelty to Animals, sought recovery against the Board of Education of the City of East Orange of penalties of the rate of $100 per alleged violation arising out of cancer-inducing experiments conducted by a student in its high school upon live chickens. By permission of the court, defendants, New Jersey Science Teachers’ Association and National Society for Medical Research Inc. were permitted by the court to participate as amicus curiae. The court found that because the board did not obtain authorization from the health department, an authorization which the health department did not think was needed, it was not thereby barred from performing living animal experimentation. The court concluded that the experiment at issue was not per se needless or unnecessary, and that such experiment did not fall within the ban of N.J. Stat. Ann. § 4:22-26 against needless mutilation, killing, or the infliction of unnecessary cruelty.

Harvard College v. Canada (Commissioner of Patents)

Summary:

The respondent applied for a patent on an invention entitled “transgenic animals”.  In its patent application, the respondent seeks to protect both the process by which the "oncomice" are produced and the end product of the process, i.e. the founder mice and the offspring whose cells contain the oncogene.  The process and product claims extend to all non‑human mammals.  The process claims were allowed by the Patent Examiner, while the product claims were rejected.  The appellant Commissioner confirmed the refusal of the product claims.  The Federal Court, Trial Division, dismissed the respondent’s appeal from the appellant’s decision.  At the Supreme Court of Canada, the Court held the appeal should be allowed. A higher life form is not patentable because it is not a “manufacture” or “composition of matter” within the meaning of “invention” in s. 2 of the Patent Act .

Students for Ethical Treatment of Animals (SETA) v. Institutional Animal Care and Use Committee of University of Oregon (IACUC)

Summary:

Appeal of a circuit court decision finding a summary judgment that plaintiffs lacked standing to bring suit where a state university student organization and other parties brought suit against the university committee that supervised animal research, including a research proposal for cranial surgery on Macaque monkeys. On appeal, the Court of Appeals held that plaintiffs had an interest in the governmental decisions of the committee, had established a denial of access related to that interest, thus had standing to bring the suit.

In Defense of Animals v. Oregon Health Sciences University

Summary:

A nonprofit corporation petitioned the trial court for injunctive and declaratory relief regarding fees charged by a state university primate research center for document inspection.  The circuit court dismissed the action with prejudice, reasoning it lacked subject matter jurisdiction over the fee issue and, assuming jurisdiction existed, the fees were in compliance with law.  The Court of Appeals reversed and remanded, holding the circuit court had jurisdiction to review the basis, reasonableness and amount of fees charged by the university.

Citizens for Alternatives to Animal Labs, Inc. v. Board of Trustees of State University of New York

Summary:

Citizens wanted access to University records dealing with biomedical research using cats and dogs.   These records were created, as required by federal Law, but access to the records was requested under state law.   According to the New York Freedom of Information Act (FOIL), documents held by an “agency” should be disclosed.   The lower Appellate Division held that s ince the University did not fall under the definition of “agency" under New York Public Officers Law, it was not required to turn over such documents.  The New York Court of Appeals, however, found that the Appellate Division's rationale for denying FOIL disclosure was inconsistent with precedent, and that the legislative goal behind FOIL of was liberal disclosure, limited only by narrowly circumscribed specific statutory exemptions.  Thus, in reversing the Appellate Division's decision, the Court of Appeals held that the records were subject to disclosure.
