U.S. v. Thompson

Summary:

Act May 25, 1900, c. 553, Sec. 4, 31 Stat. 188, incorporated in former section 393 of Title 18, was limited in its application to animals or birds killed in violation of game laws, and animals or birds killed during the open season - "the export of which is not prohibited by law," according to the court.  The court held an indictment would not stand for a failure to mark a package containing game killed during the open season but the export of which was prohibited by the law of the state where the same was killed.

Summary:

Defendant was charged with possession of a spiny lobster during closed season and failure to exhibit his catch as required by a statute. The Supreme Court held that the statute authorizes a warden to demand that a person who is or has recently been fishing or hunting to display his catch; the Fourth Amendment does not preclude a warden from briefly stopping a person. The warden's knowledge that the defendant lied in claiming he had caught nothing established probable cause to search his vehicle. By denying that he had caught anything, defendant failed to display his catch upon demand.

In doing so, the paper answers the question whether one can predict how the migratory, double-crested cormorant population will be managed through international law, when the United States perceives the rise of the cormorant population an economic and biological threat, but where Canada views the cormorant’s comeback a biodiversity success story.

Part I of this paper discusses the Canadian Marine Mammal Regulations, which are the legal-regulatory structure under which the hunt takes place. Part II describes the range and status of the main species targeted in the commercial seal hunt, namely, the harp seals. Part III reviews several several sources of international law as potential candidates to protect and conserve the targeted harp seals. This paper concludes that the Convention on International Trade in Endangered Species of Wild Fauna and Flora(CITES) is the most likely candidate to protect harp seals from unsustainable trade, and that they should be listed as a protected species under Appendix II.
