Never Enough: Animal Hoarding Law

Summary: ABSTRACT Animal hoarding, a disorder that causes sufferers to acquire animals compulsively despite the inability or unwillingness to provide them with adequate care, is a widespread, costly, often underestimated problem that causes more animal suffering than all acts of intentional cruelty combined. Not only are animals harmed, but humans are as well, from dependents that live with hoarders to members of the surrounding communities to the hoarders themselves. Current laws do not address the issue effectively, and recidivism rates are close to 100%. This Article seeks to increase awareness of the animal hoarding problem and offers suggestions as to how the law might evolve to better manage and resolve these complex cases.

ANIMAL VIOLENCE COURT: A THERAPEUTIC JURISPRUDENCE-BASED PROBLEM-SOLVING COURT FOR THE ADJUDICATION OF ANIMAL CRUELTY CASES INVOLVING JUVENILE OFFENDERS AND ANIMAL HOARDERS

Summary:

Cases involving cruelty to animals are currently handled by the traditional criminal courts. These courts, however, are not effective at punishing animal abusers or protecting animal victims. Although all states have laws criminalizing various forms of animal cruelty, the reality is that most cruelty cases are not prosecuted; even when cruelty cases are successfully prosecuted, punishments are weak. This Comment proposes the creation of an Animal Violence Court, using juvenile animal abusers and adult hoarders as ideal candidates for a pilot animal cruelty justice system. The Animal Violence Court will provide for the ongoing safety and care of animal victims, will work to rehabilitate offenders, and will require long-term monitoring of offenders by the court. Modeled after similar problemsolving courts, the Animal Violence Court will improve upon the current criminal justice system, rehabilitate offenders, and protect innocent animals, sending a clear message that animal abuse will not be tolerated.

Chimps, Inc., International Primate League, and Marguerite Gordon v. Primarily Primates, Inc.

Summary: Plaintiffs Chimps, Inc., International Primate Protection League, and Marguerite Gordon (collectively known as the plaintiffs) file this Complaint for declaratory relief, quantum meruit, and a lien for services against Defendant Primary Primates, Inc. (PPI). In this complaint, plaintiffs allege that PPI had over 700 animals, most of them nonhuman primates, living in abusive, substandard and dangerous conditions.

Plaintiffs Chimps, Inc., International Primate Protection League, and Marguerite Gordon (collectively known as the plaintiffs) file this Complaint for declaratory relief, quantum meruit, and a lien for services against Defendant Primary Primates, Inc. IL - Cruelty Generally - Consolidated Cruelty Statutes (Humane Care for Animals Act)

Summary: This comprehensive Humane Care of Animals Act from Illinois gives the requisite anti-cruelty provisions. "Animal" means every living creature, domestic or wild, but does not include man. Notably, the Act includes a provisions for psychological counseling for a person convicted of violating this section. An individual is guilty of a Class B misdemeanor for the first offense and a second or subsequent violation is a Class 4 felony with every day that a violation continues constituting a separate offense. The Act includes special provisions for juveniles and "companion animal hoarders" (510 ILCS 70/2.10). The cruelty provisions are listed at 510 ILCS 70/3.01, 3.02, and 3.03. The statute also prohibits the marketing and distribution of depictions of animal torture or cruelty for entertainment purposes (510 ILCS 70/3.03-1).

Summary: Under this set of Hawaii laws, a person commits the misdemeanor offense of cruelty to animals if the person intentionally, knowingly, or recklessly overdrives, overloads, tortures, torments, cruelly beats or starves any animal, deprives a pet animal of necessary sustenance, mutilates, poisons, or kills without need any animal other than insects, vermin, or other pests, or engages in animal fighting enterprises. Dog fighting constitutes a felony where the person owns or trains the dog to fight. The section has enhanced penalties for cruelty to guide or service animals or interference with their duties.

Summary: This set of laws lists various animal-related actions and conditions that are considered nuisances per se because of their significant public health risks. In addition, it addresses the methods by which such nuisances may be abated, up to and including the destruction of property without compensation.

In the Matter of a Protective Order for Jean Marie Primrose - Cat Champion Corporation, Appellant v. Jean Marie Primrose, Respon

Summary: This series of actions stemmed from the seizure of 11 cats from Jean Marie Primrose from her Linn County, Oregon home. The cats were neglected, thin, and missing patches of hair when they were removed from Ms. Primrose's home and placed in the custody of Cat Champion, a non-profit rescue organization. Ms. Primrose was charged with criminal animal neglect in the second degree, but the trial court dismissed those charges because she was found incompetent due to a cognitive impairment. Because the case was dismissed, the cats were not forfeited by law and Primrose remained the rightful owner. Further, Cat Champion had incurred a $32,510 debt in caring for the animals. In lieu of returning the cats to Ms. Primrose, who Cat Champions felt was incapable of adequately caring for them, Cat Champions filed a petition for a limited protective order as a fiduciary for the care and placement of the cats. The probate court ruled against Cat Champions, finding that nothing in the relevant chapter allowed the court to permanently divest Ms. Primrose of her personal property (the cats). On appeal, the Oregon Court of Appeals overturned the lower court's order and held that the probate court did indeed have authority to enter a limited protective order under ORS 125.650 as a "fiduciary necessary to implement a protective order."

They seek preliminary and permanent injunctions pursuant to N.C. Gen. Stat. Secs. 19A-1 through 19A-4 against Defendant Janie Conyers, who was found to have 106 animals living in her house under deplorable conditions. Specifically, plaintiffs seek to enjoin Defendant from acquiring any animals for 10 years after entry of judgment in this action. Plaintiffs also moved for an order pursuant to N.C. Gen. Stat. 19A-4 terminating all possessory interests in the animals seized and awarding custody and possessory rights to the ALDF. Most of the animals suffer from severe chronic oral and skin conditions due to neglect. Included in the documents are affidavits from veterinary professionals and the director of Wake County Animal, Care, Control, and Adoption Center concerning both the conditions of the animals seized and the estimated costs of care for those animals during the pendency of the litigation.
