Test Drilling Service Co. v. Hanor Company

Summary:

Owner of oil and gas mineral rights sued the operators of commercial hog confinement facilities for negligence, claiming that the operator's allowed hog waste to escape the confines of the facility and flow into the mineral rights.   The District Court held that plaintiff's alleged damages were not barred by a rule prohibiting recovery of economic loss in tort actions; that defendant's alleged violations were evidence of negligence, but not negligence per se; and that defendant's owed a duty of ordinary care to plaintiff.

Supreme Beef Processors, Inc. v. U.S. Dept. of Agriculture

Summary:

The Fifth Circuit United States Court of Appeals affirmed the district court's decision that the Federal Meat Inspection Act focuses on the processes used by a manufacturer and not the product itself, and that the presence of Salmonella bacteria in the meat does not necessarily make a product "adulterated" because the act of the cooking meat normally destroys the bacteria.

The Fifth Circuit United States Court of Appeals affirmed the district court's decision that the Federal Meat Inspection Act focuses on the processes used by a manufacturer and not the product itself, and that the presence of Salmonella bacteria in the meat does not necessarily make a product "adulterated" because the act of the cooking meat normally destroys the bacteria.

Farm Sanctuary, Inc. v. Veneman

Summary:

Plaintiffs Farm Sanctuary, Inc. and Michael Baur filed this action seeking a declaratory judgment holding that the Secretary of Agriculture Ann Veneman and the United States Department of Agriculture must classify all downed livestock as adulterated pursuant to 21 U.S.C. § 342(a) and an injunction prohibiting the USDA from allowing non-ambulatory animals to be used for human consumption. Defendants have moved to dismiss the complaint, inter alia, on the grounds that plaintiffs lack standing to sue. For the reasons discussed, the Government's motion is granted.

Texas Beef Group v. Winfrey

Summary:

Cattle ranchers in Texas sued the  The Oprah Winfrey Show and one of its guests for knowingly and falsely depicting American beef as unsafe in the wake of the British panic over “Mad Cow Disease.” The matter was removed from state court to federal court. The federal district court granted summary judgment as a matter of law on all claims presented except the business disparagement cause of action, which was eventually rejected by a jury. The court alternately held that no knowingly false statements were made by the appellees. This court affirmed on this latter ground only, finding that the guest's statement and the producers' editing of the show did not violate the Texas False Disparagement of Perishable Food Products Act.

Association des Eleveurs de Canards et d'Oies du Quebec v. Harris

Summary:
Prior to California's Force Fed Birds law—which bans the sale of products that are the result of force feeding birds to enlarge their livers beyond normal size—coming into effect, two non-California entities produced foie gras that was sold at a California restaurant. When the law came into effect, all three entities sought to enjoin the state of California from enforcing the law; they argued the law was unconstitutionally vague and violated the Commerce Clause of the U.S. Constitution. The district court, however, denied their motion for preliminary injunction. On appeal, the 9th Circuit affirmed the lower court’s decision to deny the preliminary injunction.

Animal Legal Defense Fund v. U.S. Dept. of Agriculture

Summary:

The matter before the court concerns Plaintiffs' Motion for Summary Judgment and Defendants' Motion for Judgment on the Pleadings with respect to subject-matter jurisdiction. Plaintiffs (ALDF and others) petitioned the USDA and FSIS to promulgate regulations condemning force-fed foie gras as an adulterated food product under the Poultry Products Inspection Act (“PPIA”). FSIS refused to do so, concluding that foie gras was not adulterated or diseased; Plaintiffs then filed the instant lawsuit claiming that decision was arbitrary, capricious, and in violation of the APA. The Court determined that the instant action is not about promulgating rules, but about banning force-fed foie gras. Such a decision falls under the USDA's discretion by law.

The Supreme Court held that the Federal Meat Inspection Act (FMIA) preempted the California Penal Code provision prohibiting the sale of meat or meat product of “nonambulatory” animals for human consumption and requiring immediate euthanization of nonambulatory animals.

Allendorf v. Redfearn

Summary:

After a farm employee was injured in an all terrain vehicle (ATV) while trying to round up a bull, he sued the farm owners under the Domestic Animals Running at Large Act. The Appellate Court held that the employee could not recover under the Act, which protects members of the general public who cannot be expected to appreciate the risk posed by an animal. Because the employee was not an innocent bystander but rather was attempting to exercise control over the bull at the time he was injured, he fell within the Act's definition of an “owner” of the bull.

Plaintiff environmental advocacy organization sued the Bureau of Land Management (BLM) for revisions to nationwide grazing regulations for federal lands, arguing that the revisions violated the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Federal Land Policy and Management Act (FLPMA). The Court of Appeals held that BLM violated NEPA by failing to take a “hard look” at the environmental consequences of the proposed changes, and violated the ESA by failing to consult with Fish and Wildlife Service (FWS) before approving the revisions. Opinion Amended and Superseded on Denial of Rehearing en banc by: Western Watersheds Project v. Kraayenbrink, 632 F.3d 472 (9th Cir., 2010).

Summary:

This is an interlocutory appeal brought by the State of California and defendant-intervenors The Humane Society, et al., from a preliminary injunction prohibiting the enforcement of California Penal Code § 599f, which bans the slaughter and inhumane handling of nonambulatory animals, against federally regulated swine slaughterhouses. The district court granted the preliminary injunction. On appeal, the Ninth Circuit held that Federal Meat Inspection Act (FMIA) did not expressly preempt California statute banning slaughter of nonambulatory animals. On the humane handling requirement of section 599f, the court did find that Section 599f(e) prohibits dragging of unconscious downer animals which the federal law does not. However, NMA failed to show a likelihood of irreparable injury or that the balance of the equities and the public interest tip in its favor for this provision. This court found that the lower court abused its discretion in granting a preliminary injunction, and the injunction was vacated. This case was later vacated by: National Meat Ass'n v. Harris , 680 F.3d 1193 (9th Cir., 2012).
