Central Park Sightseeing LLC v. New Yorkers for Clean, Livable & Safe Streets, Inc.

Summary: This New York cases balances animal right protestors' First Amendment rights against the government's interest in preserving public safety and flow of traffic on public streets. Plaintiff here is a business that operates horse-drawn carriage rides in Central Park. Defendant is an animal rights organization that protests the horse-and-carriage industry, often demonstrating where carriage operators drop off and pick up customers. Finding the injunction was content-neutral, this reviewing court then considered whether the challenged portions of the injunction burden speech no more than is necessary to assert the significant government interest. The court agreed with defendant that the "floating buffer zone" of the original order would be difficult for a protestor to assess and would burden speech more than is necessary. Thus, this court modified the order to prohibit any person from knowingly approaching within nine feet of a person in the loading/unloading carriage zone (a “conversational distance," said the court). The court also noted that the First Amendment does not require that protestors be allowed to interrupt the flow of traffic or endanger the public in the delivery of speech. The court also limited language in the original order that extended the reach of the injunction to “anyone else who becomes aware of this [d]ecision and [o]rder.” The court changed to this to defendants and “those acting in concert with the named parties” The order from the Supreme Court, New York County was modified as specified in this decision.

Eriksson v. Nunnink

Summary: In this case a deceased horse rider's parents (Erikssons) have brought wrongful death and negligent infliction of emotional distress actions against the rider's coach after she fell from her horse in competition and died. Due to a release form signed by the parents, the coach (Nunnink) could only be held liable if he was found grossly negligent. The parents attempted to show that the coach was grossly negligent in allowing the rider to compete after injuries sustained by the horse. This court concluded that the Erikssons failed to establish that Nunnink was grossly negligent. The court affirmed the judgment.

American Wild Horse Preservation Campaign v. Perdue

Summary: This case involves a challenge by plaintiff-wild horse preservationists under the Administrative Procedures Act (APA) to a proposed management plan issued for wild horse territory (WHT) by the Forest Service (FS). Plaintiffs argue that the revision, which changed the borders by removing a middle section so that it was not a contiguous territory, was arbitrary and capricious. After the United States District Court for the District of Columbia granted summary judgment for the Forest Service, plaintiffs appealed. On appeal, FS contends that the unified territory was based on a cartographic error in the 1980s; in essence, FS argues that the 2013 change merely corrects an "administrative error" and returns management to the correct WHT boundary from 1975. However, this Court held that FS' decision to eliminate the middle section of the WHT was arbitrary and capricious because the plan failed to explain the change in policy. Further, FS did not adequately consider whether an Environmental Impact Statement was required under NEPA regarding this change. The Court was unconvinced by the FS's attempts to "shrug off" the inclusion of the Middle Section as an "administrative error" and stated that there is no "oops" exception for federal agencies. There were decades of data that relied on the "error" along with formal published plans that supported management activities and population studies. The court was unwilling to allow the FS to correct a past error by committing a new legal error: "[I]n administrative law, as elsewhere, two wrongs do not make a right." The court noted that FS may change its policies in the future, provided it reasonably supports those changes. Additionally, the Court found the FS' "Finding of No Significant Impact" in the environmental analysis was a "head-in-the-sand" approach that ignored real consequences of the boundary changes. Accordingly, this Court reversed the district court's grant of summary judgment in part and directed the district court to remand to the Service for further consideration.

Coffey v. Bureau of Land Mgmt.

Summary: As the court here states, "Plaintiff Debbie Coffey knows a great deal about wild horses and burros—and how those animals are treated by the federal Bureau of Land Management—but she wants to learn more." As such, Plaintiff, a hose welfare advocate, filed a Freedom of Information Act (FOIA) request to the BLM to obtain communications between its officials and private citizens, namely those with long-term holding contracts, involved in the Wild Horse and Burro Program. In conjunction with her request, the BLM charged plaintiff $1,680 in processing fees, but ultimately refunded her the fees a year and half later because it failed to meet FOIA statutory response deadlines. On appeal, Coffey filed a FOIA suit and both sides moved for summary judgment. Plaintiff first argues that the BLM violated FOIA when it failed to give her interest on her processing fees. The court, however, found that awarding interest here would violate the longstanding "no-interest rule," where there was no congressional intent to award interest in such cases. As to plaintiff's argument that BLM's search for records was inadequate, the court agreed with plaintiff that the words and phrases used by BLM were too limiting to meet plaintiff's request and were thus unreasonable. The court held that BLM must choose a different set of search terms (including those suggested by plaintiff) and conduct the FOIA search again. However, the court found that plaintiff's additional contentions that: (1) the search terms were too vague; (2) the database and software needed to be identified; and (3) BLM needed to also include phone records in its search to be without merit. The parties' motions for summary judgment were granted in part and denied in part.

Friends of Animals v. The United States Bureau of Land Management

Friends of Animals, an animal welfare organization, filed suit for a preliminary injunction against the Bureau of Land Management (BLM). Friends of Animals filed suit after the BLM started organizing a new “gather” which is a a term used for the removal of wild horses. The BLM planned to “gather” wild horses from a range in Utah and the Friends of Animals challenged the decision on three grounds: (1) the decision to gather was not grounded on any National Environmental Policy Act (NEPA) document such as a environmental assessment (EA); the BLM failed to honor its previous commitment to include new EAs for any new gathers; and (3) the gather violates the Wild Horses Act on the basis that the BLM failed to make a excess population determination before authorizing the gather.

The court reviewed the three claims separately and determined that Friends of Animals’ challenges to the gather were not likely to succeed and there was not a sufficient irreparable harm to warrant a preliminary injunction. First, the court found that under NEPA, an agency is able to rely on a previous EA so long as “new circumstances, new information or changes in the action or its impacts not previously analyzed [do not] result in significantly different environmental effects.” The court found that previous EAs were sufficient because they had assessed an “essentially similar” capture method. Additionally, the court determined that although BLM had previously agreed to provide new EAs for any new gathers, the BLM was not legally required to do, so the Friends of Animals argument regarding this issue would not succeed. Lastly, the court found that the BLM had not violated the Wild Horses Act because the BLM had in fact conducted an excess population determination.

Lastly, the court analyzed whether or not the gather created an irreparable harm that would warrant a preliminary injunction. The court found that there was not sufficient evidence to prove any irreparable harm. As a result, the court denied the preliminary injunction and held in favor of the BLM.

Hendrickson v. Grider

Summary:

A car accident occurred and Plaintiffs, Jo Ellen Hendrickson and her husband were injured when her vehicle hit two horses that were on the roadway. Defendant Randall D. Grider owned the horses and Defendant Gartner owned the lot where Grider kept the horses. Defendant Cope is Gartner's son-in-law and acted as an intermediary between Gartner and Grider. The Hendrickson’s filed a complaint against Grider, Cope, and Gartner and alleged that they were owners and/or keepers of horses under statute R.C. Chapter 951 and that they negligently allowed the horses to escape. Hendrickson sought damages for her injuries and a loss of consortium claim on her husbands’ behalf. The Common Pleas Court, granted summary judgment for the Defendants. The Hendrickson’s appealed. The Court of Appeals of Ohio, Fourth District affirmed the Common Pleas Court. The Court of Appeals reasoned that: (1) neither defendant was “keeper” of horses within the meaning of the statute which governed liability for horses running at large on public roads; (2) even if the lot owner breached their duty by allowing the owner of the horses to keep the horses on her property before fencing was installed, such breach was not the proximate cause of plaintiffs' injuries; and (3) the lot owner could not have reasonably foreseen that the horses would escape from a fenced-in lot and injure the motorist and, thus, she could not be held liable in negligence for the motorist's resulting injuries.

Front Range Equine Rescue v. Vilsack

Between 2006 and 2011, Congress prevented commercial equine slaughter by prohibiting the use of funds for inspection of equine slaughterhouses.  In 2012, Congress lifted the ban on funding and the Food Safety Inspection Service  (FSIS) , which is a branch of the United States Department of Agriculture (USDA), issued grants of inspection to two commercial equine slaughter facilities: Valley Meat Company, LLC and Responsible Transportation, LLC. Plaintiffs, Front Range Equine Rescue, the Humane Society of the United States, and several other individuals and organizations (collectively, “Front Range”) sued officials of the USDA (“Federal Defendants”). Plaintiffs were seeking a declaration that the grants of inspection violated the National Environmental Policy Act and requested that the court set aside the grants of inspection.  The United States District Court for the District of New Mexico,  granted Front Range's motion for a temporary restraining order (TRO), which prohibited the Federal Defendants from sending inspectors to the equine slaughterhouses  or providing equine inspection services to them. The district court also ordered Front Range to post injunction bonds for Valley Meat and for Responsible Transportation and denied Front Range's request for a permanent injunction. Front Range appealed but the appeal was dismissed as moot. However, Valley Meat and Responsible Transportation then filed a motion in the district court to recover the injunction bonds. The motion was denied. Valley Meat then appealed the denial of damages on the injunction bond.  The United States Court of Appeals, Tenth affirmed the district court and held that Valley Meat was not entitled to recover. The Appeals Court reasoned that even if Valley Meat suffered damages, it cannot recover against the bond unless it first showed wrongful enjoinment. Valley Meat failed to do so and therefore could not collect damages.

Summary:

This Comment reviews the history of the horse-drawn carriage industry in New York City and details legislative efforts to regulate the business. Many cities in the United States feature horse-drawn carriages as a tourist attraction, but they are most associated with New York. The long-standing controversy over the working and living conditions of the horses that pull the cabs has garnered less national attention than other animal welfare issues, despite the fatalities and injuries suffered by the equines on traffic-choked Manhattan streets. Supporters of the industry defend it as an important contributor to the local economy, an iconic symbol of the city, and a source of livelihood for the operators. They maintain that municipal regulations are sufficient to protect the horses from mistreatment and the public from the perils of accidents involving carriages. However, city regulation has historically proven to be inadequate and ineffective in ensuring that the horses are not exposed to inhumane conditions. Moreover, the inherent hazards and stressors of New York City streets take a toll on the horses’ health and well-being that regulation cannot address. For these reasons, the protection of the horses and the public cannot be assured until the carriage business in the city is abolished. This Comment discusses the movement to ban the industry, including proposals that would replace the carriages with replicas of antique cars. With inadequate regulation and political obstacles to a ban, it may ultimately take a tide of public sentiment to end the suffering of carriage horses.
