Summary: This Illinois law states that a person commits unlawful use of an elephant in a traveling animal act when he or she knowingly allows for the participation of an African elephant (Loxodonta Africana) or Asian elephant (Elephas maximus) protected under the federal Endangered Species Act of 1973 in a traveling animal act. Violation is a Class A misdemeanor. This Section does not apply to an exhibition of elephants at a non-mobile, permanent institution, or other facility.

Center for Biological Diversity v. U.S. Fish & Wildlife Service

Summary: Center for Biological Diversity ("CBD") filed an action for declaratory and injunctive relief under the Endangered Species Act, seeking protection for the Pacific fisher (a medium-sized brown mammal in the weasel family found only in North America). All parties moved for summary judgment. The CBD was the party that submitted the original petition to list this distinct population segment as endangered in 2000 (after various petitions were filed since 1990 with no action). In 2014, the U.S. Fish & Wildlife Service (the "Service") publicly proposed to list the Pacific fisher as threatened and sought public comment. In April 2016, the Service withdrew the proposed listing, finding that: populations will persist in the future; wildfires will have beneficial consequences; there "may be" breeding and interchange with other populations; and there were only a small number of confirmed deaths due to toxicosis from anticoagulant rodenticides. Plaintiffs now challenge that listing reversal as arbitrary and capricious, and seek an order requiring the Service to publish a new rule within 90 days based on “the best scientific and commercial data available." This court first examined the effect of anticoagulant rodenticides on the Pacific fisher. The court found the Service's assessment of the increase of the emerging threat from toxicosis was arbitrary and capricious, and that the Service "cherry picked" the Gabriel study to say that the study was uncertain. As to population trends, the court found that the Service based its conclusion on limited and inconclusive trend data and ignored the studies' conclusions. In fact, the court stated, "[h]ere, the absence of conclusive evidence of Pacific fisher persistence does not stand alone. The Service does not dispute that the Pacific fisher population has declined dramatically." In the end, the court granted plaintiff CBD motion for summary judgment and denied defendant Service's motion. The court directed the Service to prepare a new rule by March 22, 2019 (which denied plaintiff's motion for a 90-day rule and also denied the Service's request to "brief the timeline in order to evaluate staffing and budget constraints").

Rowley v. City of New Bedford

Summary: This opinion concerns the City of New Bedford, Massachusetts' motion to dismiss plaintiff Rowley's (formerly plaintiff "Friends of Ruth & Emily, Inc.") citizen suit for injunction under the federal Endangered Species Act. Plaintiffs allege that two Asian Elephants, Ruth and Emily, were mistreated by the Buttonwood Park Zoo in New Bedford by chaining their legs, housing them in inadequate facilities, failing to provide proper socialization, and failing to provide adequate veterinary care, which gives rise to a "taking" under Section 9 of the ESA. Rowley claims that she is a member of the zoological society there and visits the elephants on a "near daily basis," resulting in “an aesthetic, emotional, and spiritual relationship with Ruth and Emily over the years.” The United States District Court for the District of Massachusetts asked both parties to brief on the issue of standing for the instant action. The court first noted that the ESA expressly authorizes citizen suits for injunctive relief. To survive a motion to dismiss, Rowley must, through facts, clearly demonstrate standing, and then the court must analyze those facts under a multi-pronged approach. To begin, the court distinguished cases that established the proper "animal nexus" for injury in fact with those that did not meet that finding. Here, Rowley's complaint established injury in fact because she lives in New Bedford, is a member of the Zoo's Zoological Society, and observes the elephants on a near daily basis. Rowley alleges that the maltreatment of Ruth and Emily injures this ability because she observes their ongoing suffering while in substandard captivity. The court was not persuaded by New Bedford's claim that Rowley has not established injury in fact because she has no specialized training in wildlife or animal welfare. In fact, this claim ignored precedent from this very circuit that "aesthetic injury" can be established by viewing animals in inhumane conditions. In addition, the court rejected New Bedford's "nonexistent requirement into the injury in fact analysis" that Rowley must have observed or will observe Asian elephants in their native habitats. As a result, the court found Rowley properly established injury in fact. As to the next requirement of causation, the court found that Rowley sufficiently alleged that the Zoo's actions caused the harm complained of for purposes of surviving a motion to dismiss. Finally, as to redressability, the court found that Rowley's request for a declaratory judgment as to the Zoo's treatment of Ruth and Emily, and an injunction prohibiting the Zoo from euthanizing the elephants met this prong. New Bedford's contention that Rowley's further suggestion of moving the elephants to a sanctuary in Tennessee impaired her redressability argument because Rowley did not propose how the cost of relocation would be funded was also rejected. At this stage, the court does not need to determine whether this solution is necessary or feasible. The District Court ultimately held that Rowley demonstrated sufficient standing to pursue her claims. Hence, New Bedford's motion to dismiss was denied.

United States v. Charette

Summary: Defendant Charette was convicted by bench trial of taking a grizzly bear behind his home in Montana in violation of the federal Endangered Species Act. On appeal, defendant challenges his conviction on three grounds: (1) there was insufficient evidence to infer that he did not have a permit to take the grizzly bear; (2) his request for a jury trial was improperly denied; and (3) the lower court incorrectly analyzed his self-defense claim under an objective standard as opposed to the correct subjective standard. On appeal here, the court observed that the plain language of the ESA and legislative history makes it clear that permits and exceptions under the ESA are affirmative defenses, and not elements of the crime. In this case, Charette had the burden of proving the existence of a valid permit, which he did not do at trial. The court also quickly dispensed with the Sixth Amendment jury trial issue, finding that the taking of a grizzly bear is a petty offense. As to defendant's last argument on his self-defense claim, this court did find that the trial court erred in applying an objectively reasonable standard. This error was not harmless because it affected defendant's decision to testify as to his subjective belief in the need for self-defense. As a result, this court reversed the district court's decision, vacated defendant's conviction, and remanded the case for further proceedings.

Kuehl v. Sellner

Summary: Plaintiffs, including advocacy organization Animal Legal Defense Fund (ALDF), brought suit against defendants the Sellners and the Cricket Hollow Zoo to enjoin defendants' mistreatment of their animals in violation of the Endangered Species Act, 16 U.S.C. § 1531 et seq. Defendants ran a zoo with over 300 animals, including lemurs, tigers, cougars, monkeys and birds, among others. Several of the plaintiffs visited defendants' zoo and witnessed care that raised concerns about the animals' mental and physical well-being, including lemurs kept in isolation with insufficient climbing structures, and tigers kept in feces-filled cages with inadequate care/enrichment. The district court denied plaintiffs' requests for attorney fees and costs and also transferred the animals to a facility that was not proposed by plaintiffs. On appeal, defendants argued that plaintiffs lack standing, and, even if they had standing, defendants contend that they did not violate the ESA. Plaintiffs also appealed, challenging the district court's placement decision for the animals, as well as the court's denial of their request for attorney fees. The Court of Appeals disagreed with defendants that plaintiffs lacked standing because "[they] visited the Cricket Hollow Zoo for the purpose of looking for claimed violations." The court noted that "it is the violation itself" and not the search for it that has caused injury to the plaintiffs. As to defendants' argument that they could not have violated the ESA because the Animal Welfare Act (AWA) provides a "safe harbor" for licensed facilities, the court found that the AWA does not provide a blanket immunity to the ESA. Here, the defendants harassed the lemurs under the ESA by keeping them socially isolated with insufficient enrichment. The defendants also harassed the tigers under the ESA by failing to provide appropriate veterinary care and keeping them in unsanitary conditions. With regard to the placement of the animals at a facility chosen by defendants, this court found no clear error by the district court and, thus, there was no abuse of discretion in the placement decision. Finally, as to denial of plaintiffs' request for attorney fees and costs, the court found that plaintiffs were seeking fees to serve "as a vehicle to close Cricket Hollow." The court was concerned that the use of the ESA as a "weapon" to close small, privately-owned zoos was not envisioned by the Act. Hence, those circumstances justified the district court's decision to deny the motion for attorney fees. The lower court's decision was affirmed.

Ley 25.463, 2001

Summary: This law declared the Panthera onca, also known as yaguareté, Jaguar, overo tiger or painted onca, a natural monument. Ley 25.463/01 instructs the National Park Administration and the Directorate of Wildlife and Flora of the Nation to work together on the management plan for the species in the areas of its jurisdiction, making sure it is in accordance to the national faunal policy. The Enforcement Authority will guarantee the planning and execution of preventive measures in cases in which a specimen becomes circumstantially harmful to humans or their productive activities.

Missouri Primate Foundation v. People for Ethical Treatment of Animals, Inc.

Summary: This matter is a motion of counterclaim by defendants Missouri Primate Foundation to dismiss PETA's (the counterclaim plaintiff) assertion that two chimpanzees were being held in conditions that deprived the chimpanzees of adequate social groups, space, and psychological stimulation, putting them at risk of and causing physical and psychological injury, such as deteriorated cardiovascular and musculoskeletal health, stress, anxiety and depression. PETA also alleges that the chimpanzees were denied a sanitary environment, proper ventilation, a healthy diet, and adequate veterinary care. PETA claimed that the Missouri Primate Foundation (MPF) (the counterclaim defendants) were holding the two chimpanzees in conditions that “harm” and “harass” the chimpanzees, thus violating the “take” prohibition of the Endangered Species Act (ESA). MPF's motion contends that PETA’s counterclaim is based on allegations that they failed to comply with the Animal Welfare Act, not the ESA. MPF further contends that because the chimpanzees at its facility were lawfully in captivity and under the auspices of the AWA as administered by the USDA–APHIS, so the chimpanzees cannot be subject to a “take” under the ESA. They further argued that PETA lacked standing as the AWA preempts or supersedes the ESA as to animals held at USDA licensed facilities. Because the AWA does not allow citizen suits, MPF argued, the case must be dismissed. After examining similar cases, this court concluded that claims under the AWA and ESA are complementary and do not conflict, and that the ESA protects captive animals regardless of whether the alleged violator is an AWA licensed entity. The court found that the allegations by PETA are sufficient at this stage of the case and issues of proof are reserved for trial. As such, the court denied the motions of the counterclaim defendants.

After the Service made a threshold “90–day” determination that Buffalo Field's petition failed to present sufficient scientific evidence that listing the bison may be warranted, Buffalo Field brought suit under the Administrative Procedure Act, alleging that the Service's determination was arbitrary and capricious. The United States District Court for the District of Columbia ruled that the Service applied an improper standard when evaluating Buffalo Field's petition, granted Buffalo Field's motion for summary judgment, denied the Service's cross-motion, and remanded the case for the agency to conduct a new 90–day finding using the proper standard. In particular, the court observed that the Service "simply picked a side in an ongoing debate in the scientific community," thereby in inappropriately heightening the standard of evaluation for a 90-day petition. Because of that, the court agreed with the Service that remand is the appropriate remedy as opposed to to directing the Service to begin a 12-month review.
