Natural Resources Defense Council v. Evans

Summary:

Plaintiffs, various environmental organizations and a concerned individual, sought a preliminary injunction against federal officials to prevent the United States Navy's peacetime use of a low frequency sonar system for training, testing and routine operations. The defendants temporarily enjoined from deploying Low Frequency Active Sonar until a carefully tailored preliminary injunction can be issued which would permit the use of Low Frequency Active Sonar for testing and training in a variety of ocean conditions, but would provide additional safeguards to reduce the risk to marine mammals and endangered species.

Save the Pine Bush, Inc. v. Common Council of City of Albany

Summary:

An Organization dedicated to the protection of the Karner Blue Butterfly and other species that live in an area of land used as a nature preserve brought challenge against the City Common Council’s; (“Council”) approval of a Developer’s rezoning application for the land.   The Supreme Court, Appellate Division, Third Department, New York, held that the Organization had standing to bring suit, because the Organization showed the existence of an actual injury different from that of the general public, due to the Organization’s regular use of the preserve, at least one member’s nearby residency to the preserve, and the Organization’s historic involvement in the protection and preservation of the preserve. (2010 - Order Reversed by Save the Pine Bush, Inc. v. Common Council of City of Albany, 13 N.Y.3d 297, 918 N.E.2d 917, 890 N.Y.S.2d 405, 2009 N.Y. Slip Op. 07667 (N.Y. Oct 27, 2009) (NO. 134)).

In re New Jersey Pinelands Com'n Resolution

Summary:

This case concerns the approval of a settlement agreement for a residential development project that contained habitat critical to the survival of a local population of timber rattlesnakes, an endangered species in New Jersey.  The court's review of the record found that there is no reason to interfere with the determination by the Commission, since there was ample evidence to support the Commission's decision to approve the settlement.  The court also agreed with the lower court that the environmental organizations lacked standing to bring an endangered species counterclaim before the lower court.  Specifically, the court found that the Department of Environmental Protection and the Commission did not fail to act in implementing the endangered species act; thus, no standing was conferred upon the groups.  The court also noted that the DEP and the Commission acted in their requisite complementary roles in effecting the Act.

ARFF, Inc. v. Siegel

Summary:

Resort developer and president of an animal performance company received an injunction against an animal rights group limiting their ability to both picket the resort and distribute pamphlets claiming that the big cats were abused.  Appellate court reversed, finding that the picketing regulations burdened more speech than necessary and that the restriction on distributing pamphlets was a prior restraint not justified by a compelling state interest.

Caribbean Conservation Corp., Inc. v. Florida Fish and Wildlife Conservation Com'n

Summary:

The petitioners' challenge is whether the Legislature can require the newly created Florida Fish and Wildlife Conservation Commission (FWCC) to comply with the requirements of the Administrative Procedure Act (APA), when adopting rules or regulations in respect to those species of marine life that are defined as endangered, threatened, or species of special concern. The petitioners are not-for-profit groups and individuals who allege several statutory sections unconstitutionally usurp the constitutional authority of the FWCC to regulate marine life.  The FWCC and the Attorney General (respondents) disagree and argue that the Legislature can require the application of the APA and that the statutes that delineate power to the Department of Environmental Protection (DEP) are constitutional.  The issue was whether the creation of the FWCC also gave it power to regulate endangered, threatened, and species of special concern or whether that power remained with the DEP.  The court found that such power remained with the DEP regarding endangered and threatened species of marine life.  However, it could discern no statutory basis in effect on March 1, 1998, for the DEP having regulatory or executive power in respect to a category of marine species designated "of special concern" so that portion of the challenged statutes was held unconstitutional.

Summary:

The Wyoming Farm Bureau, amateur researchers, and environmental groups appealed an agency to introduce experimental population of gray wolves in a national park and central Idaho. After ruling on the various standing issues, the court held that the ESA section allowing experimental population to be maintained only when it is "wholly separate geographically" from nonexperimental populations includes overlap even with individual members of nonexperimental species.   However, the defendants' treatment of all wolves found within boundaries of designated experimental population areas as nonessential experimental animals was contrary to law as provided in their own regulations.   Therefore, the court ordered that Defendants' Final Rules establishing a nonessential experimental population of gray wolves in Yellowstone National Park in Wyoming, Idaho, Montana, central Idaho and southwestern Montana was unlawful.   Further, that by virtue of the plan being set aside, defendants must remove reintroduced non-native wolves and their offspring from the Yellowstone and central Idaho experimental population areas.  This decision was reversed in 199 F.3d 1224.

United States of America v. Victor Bernal and Eduardo Berges

Summary:

Victor Bernal and Eduardo Berges were convicted of various crimes in connection with an attempt to export two endangered primates--an orangutan and a gorilla--from the United States to Mexico in violation of the Lacey Act Amendments of 1981 and the Endangered Species Act of 1973.  While the main issue before the court was a downward departure in sentencing guidelines, the court found the purpose of the Lacey Act is protect those species whose continued existence is presently threatened by gradually drying up international market for endangered species, thus reducing the poaching of those species in their native countries.

Defendants (USFWS and rancher owners) filed a motion to dismiss the 'Alala bird and strike its name from the plaintiffs' complaint as well a motion for Rule 11 sanctions. The District Court held that, as a matter of first impression, the endangered 'Alala bird was not a 'person' within the meaning of the Endangered Species Act's (ESA) citizen suit provision. However, the Court declined to impose Rule 11 sanctions on the ground that plaintiffs' counsel acted improperly in filing a complaint that named the ‘Alala  as a party, finding that there is no evidence plaintiffs named the ‘Alala for an improper purpose. Defendant's motion for a more definite statement was granted to provide greater specificity to pinpoint those areas within the essential habitat locations that may be affected.

Summary:

The court first concluded that venue was proper for the smuggling charges and the conspiracy charge. Turning to the convictions, the court found that his convictions of felony conspiracy and smuggling were supported by sufficient evidence. The court rejected his argument that the general smuggling law was inapplicable to the acts for which he was convicted because Congress had separately criminalized this conduct as a misdemeanor under the Endangered Species Act.

Summary:

In this appeal, the Humane Society of the United States (HSUS) challenged a series of actions by the Fish and Wildlife Service to allow hunting on some of America's national wildlife refuges. The District Court held that HSUS failed to satisfy the Supreme Court's requirements for associational standing because the 'recreational' interest of Society members was not germane to the group's self-described mission of insuring the humane treatment of animals and other wildlife. The Court of Appeals reversed the district court's finding that the Humane Society had no standing to challenge the hunt openings, and remanded the action to allow HSUS to pursue its challenge to the introduction of hunting. This Court did affirm the district court's finding on the merits that the Wildlife Service complied with NEPA when it permitted hunting at the Chincoteague preserve. Affirmed in part and reversed in part.
