The Post-Conviction Remedy for Pit Bulls: What Today’s Science Tells Us About Breed-Specific Legislation

Summary: This Article examines the pseudo-science used in the past, the science we have today, and how “pit bulls” are among the more popular breeds adopted from animal shelters safely living in communities nationwide, yet are targeted with specific legislation in many municipalities. Distinguished from criminal eyewitness identification cases, this Article looks at the breed-specific legislation issue in terms of the entire breed being convicted on eyewitness testimony, not on a case-by-case basis like we see in criminal cases. Because breed-specific legislation targets an entire population of family pets based on breed, this Article argues for a better examination of the reliability of breed identification and the science used to uphold the constitutionality of the legislation.

Summary: District Court ruled City of Payette's pit bull ordinance's procedural aspects were unconstitutional, finding that the lack of hearing provisions for a dog that was impounded due to an attack or bite violated procedural due process. The court also found that forcing the dog owner to bear the burden of proving his or her dog's innocence violated due process. The court, however, found no constitutional infirmity with the notice procedure employed by Payette's pit bull ordinance, provided Payette adhered to Idaho Code § 25-2804. The court ordered Plaintiff Douglas’ Motion for Partial Summary Judgment to be granted in part and denied in part; the claims asserted against the city of Payette by Plaintiffs Monica Newman and Ruby Judine Malman to be dismissed without prejudice; and all claims asserted by Plaintiffs against the city of Fruitland to be dismissed without prejudice.

Warren v. Delvista Towers Condominium Ass'n, Inc.

Summary: In its motion for summary judgment, Defendant argues Plaintiff’s accommodation request under the Federal Fair Housing Act (the “FHA”) to modify Defendant's “no pet” policy was unreasonable because Plaintiff's emotional support animal was a pit bull and pit bulls were banned by county ordinance. In denying the Defendant’s motion, the District Court found that changing a no pets policy for an emotional support animal was a reasonable accommodation under the FHA. The court also found that enforcing the county ordinance would violate the FHA by permitting a discriminatory housing practice. However, in line with US Department of Housing and Urban Development notices, the court found genuine issues of material fact remained as to whether the dog posed a direct threat to members of the condominium association, and whether that threat could be reduced by other reasonable accommodations.

The circuit court's decision ordering that Tinkerbell be destroyed relied on a presumption that pit bull dog breeds are inherently vicious. Because extensive debate exists over whether scientific evidence and social concerns justify breed-specific presumptions, the court concluded that courts may not, upon judicial notice, rely solely upon a breed-specific presumption in ordering the destruction of a dog pursuant to West Virginia's vicious dog statute. The adoption of breed-specific presumptions with regard to this statute is the prerogative of the Legislature, not the judiciary, the court stated. In the absence of a breed-specific presumption, the court determined that neither the remaining findings of fact in the circuit court's destruction order nor the facts presented in the record provided satisfactory proof that Tinkerbell must be euthanized. Consequently, the court reversed the circuit court's destruction order.

Summary: This document lists the states that prohibit the regulation of dogs by local governments based on breed, commonly known as breed-specific legislation. The laws are divided into two general categories: (1) states that prohibit breed-specific legislation (BSL) in all animal regulation (10 states); and (2) states that prohibit BSL in dangerous/vicious dog laws (15 states). In total, there are approximately 21 states with some sort of anti-BSL legislation (combining both (1) and (2) together, and not counting DE, IL, and VA twice because they have both such laws). These entities must also submit statistical information to the State Public Health Veterinarian on a quarterly basis.
