AGENDA: Biodiversity Protection: Implementation and Reform of the Endangered Species Act

Summary: In 1996, the Endangered Species Act was up for reauthorization, and with it, a variety of reform proposals were debated in the Biodiversity Protection Conference at the University of Colorado—Boulder. The following conference proceeding -- which included natural resource scholars, experts from the private and nonprofit sectors, and government officials--examined the rationale for biodiversity protection, the legal framework of the Endangered Species Act, and examples of implementation of the Act from across the West. Special attention was given to major issues raised by the Act that cut across all regions, including: consultations and recovery planning; habitat conservation plans; the ESA and water rights; the ESA and state programs; the ESA and tribal rights; economic impacts of the ESA; and ESA reform proposals.

AU - Wildlife Protection- Queensland Nature Conservation Act 1992

Summary: The object of this Act is the conservation of nature.The conservation of nature is to be achieved by an integrated and comprehensive conservation strategy for the whole of Queensland that involves, among other things, the following— (a) Gathering of information and community education; (b) Dedication and declaration of protected areas; (c) Management of protected areas;(d) Protection of native wildlife and its habitat; (e) Use of protected wildlife and areas to be ecologically sustainable; (f) Recognition of interest of Aborigines and Torres Strait Islanders in nature and their cooperative involvement in its conservation; and (g) Cooperative involvement of land-holders.This Act is to be administered, as far as practicable, in consultation with, and having regard to the views and interests of, land-holders and interested groups and persons, including Aborigines and Torres Strait Islanders.

South Africa - Biodiversity - National Environmental Management

Summary: The objectives of this Act are, within the framework of the National Environmental Management Act, to provide for the management and conservation of biological diversity within the Republic and of the components of such biological diversity; to provide for the use of indigenous biological resources in a sustainable manner; and to provide for the fair and equitable sharing among stakeholders of benefits arising from bioprosgecting involving indigenous biological resources. Other objecitves of this Act are to give effect to ratified international agreements relating to biodiversity which are binding on the Republic; to provide for co-operative governance in biodiversity management and conservation; and to provide for a South African National Biodiversity Institute to assist in achieving the objectives of this Act.

South Africa - Biological Diversity - Regulations

Summary: These South African regulations were made relating to listed threatened and protected species of the National Environmental Management: Biodiversity Act, 2004. The purpose of these regulations is to further regulate the permit system set out in Chapter 7 of the Biodiversity Act insofar as that system applies to restricted activities involving specimens of listed threatened or protected species; to provide for the registration of captive breeding operations, commercial exhibition facilities, game farms, nurseries, scientific institutions, sanctuaries and rehabilitation facilities and wildlife traders; to provide for the regulation of the carrying out of a specific restricted activity, namely hunting; to provide for the prohibition of specific restricted activities involving specific listed threatened or protected species; to provide for the protection of wild populations of listed threatened species; and to provide for the composition and operating procedure of the Scientific Authority.

First national report for the Convention on Biological Diversity - BRAZIL

Summary: This is Brazil's first national report for the Convention of Biological Diversity. The report explains the balance between the interests of countries, which are sources of, and conserve, biological diversity (Brazil and other tropical countries) and the nations that are principally users of such biodiversity (the industrialised countries, consumers of the products of biodiversity and of genetic resources for their biotechnological development).

Central Asia’s Need for Regional Reform of its Resource Management System

Summary: In every region of the world, disputes arise between nations over the use of transboundary water sources. In order to ensure sustainable and conservative use of those sources, this Note will discuss the role that non-State actors must play to resolve transboundary water conflicts, looking specifically at the resource use conflicts that exist in Central Asia. Non-state actors, such as regional and international organizations, have the credibility, information, non-political agenda, and passion necessary to ensure adequate resources to resolve transboundary water conflicts. As stated in several environmental treaties, there is a need for greater access to information among the public about environmental concerns, which non-state actors have the resources to provide.
