In addition, they contended that the park was acting in accordance to the law and had all the permits required by the authorities to keep the animals. After thorough examination of the case and careful consideration of applicable laws and jurisprudence, the judge granted the habeas corpus. This ruling acknowledges the significant impact on the rights of exotic, endemic, and even the farm animals under the park's care. Grounded in Article 89 of the Constitution of Ecuador, as well as jurisprudence from the Inter-American Court of Human Rights and Judgment No. 253-20-JH/22, the judge arrived at this conclusion. However, attending to the recommendations issued by the experts, the court decided to let the animals stay at the park, instructing the enhancement of the enclosure and diets of all animals within a three-month period after the judgment. By nature, circuses, carnivals, and other traveling shows require the animals that are property to travel regularly and to perform for the public regularly. Researchers have found that this lifestyle is problematic for animals, in general, due to the living and traveling conditions that animals are subjected to as well as the pressures of performance of unnatural acts in unnatural environments.

Mogensen v. Welch

Summary: Plaintiffs owned and operated a zoo containing about 95 animals. Following complaints about suspected abuse and neglect of these animals, defendant executed a search warrant of the zoo. The search led to the seizure of many of these animals, including a tiger in such poor health that it needed to be euthanized. Following the seizure of these animals, plaintiffs filed a motion to argue that their due process rights were violated because a civil forfeiture hearing must be held no more than ten business days after the state seized the animals, and plaintiffs argue that ten days is too little time to prepare for the hearing. To succeed on the claim, plaintiffs must show that they are likely to suffer irreparable harm in the absence of preliminary relief, which they were unable to do because plaintiffs still have the right to appeal if the hearing does not go in their favor. Therefore, the court denied plaintiff's motion for a preliminary injunction.

The cat’s owners, who were witnesses to this event, watched as the pit bulls mauled their pet cat. When the witnesses asked defendant to stop his dogs, defendant attempted to flee with his dogs still carrying the cat’s body in its mouth. The witnesses pursued and eventually, the dog dropped the deceased cat’s body. Defendant was charged with aggravated cruelty to animals and overdriving, torturing and injuring animals, and failure to provide proper sustenance. Defendant was convicted, and appealed the aggravated animal cruelty charge. Defendant argues that the verdict was not supported by sufficient evidence. The court here found that defendant was well aware that the dogs were aggressive, even keeping them separate from his young son because of their propensity to attack smaller animals. There was also testimony from another neighbor of defendant allowing his dogs to chase feral cats off her porch without stopping them, and testimony regarding defendant’s dog previously mauling a smaller dog without defendant intervening to stop them. Defendant was warned by animal control to muzzle them, but refused to do so. Defendant also bragged to co-workers about how he let his pit bulls go after other dogs and attack wild and old animals. Accordingly, the court found that defendant was aware of the dogs’ aggressive behavior and affirmed the holding of the lower court.

CÓDIGO PENAL PARA EL ESTADO LIBRE Y SOBERANO DE TLAXCALA

Summary: In 2022, Decreto No. 160 modified the Criminal Code by adding Title XX, “Of the Crimes Committed Against Animals.” it has only one title: “Crimes Against the Life, Integrity, and Dignity of Animals,” which comprises articles 435, 436, 437, 438, 439, 440, 441, and 442. Article 435 considers acts of mistreatment and animal cruelty: unjustifiably causing the death of an animal; killing an animal using methods other than those established in official Mexican standards or depriving an animal of life using any means that causes excessive or unnecessary suffering or prolongs its agony; any mutilation, injury, or permanent mark for nonmedical purposes; inflicting injuries that endanger the life of an animal, that generate permanent partial or total disability, that reduce any of its faculties, or that affect the normal functioning of an organ or member; causing the ingestion or application of any toxic substance or object that endangers the life of an animal or causes its death; depriving an animal of air, light, food, water, space, mobility, medical care, or adequate shelter appropriate to its species, with the purpose of causing harm; abandoning an animal or neglecting it for prolonged periods that compromise its well-being; or inciting animals to attack each other or being neglectful when the animals' aggressiveness or physical power could potentially result in harm or death. Under this modification, animal cruelty is punishable with imprisonment ranging from six months to five years. If the injuries inflicted on the animal put the animal's life at risk, the punishment will be increased by half. If the animal dies as a result of the cruel behavior, the penalty will imprisonment from two to four years, and if the methods utilized caused excessive or unnecessary suffering or prologue the animal’s agony, the punishment will be increased by half. Sexual conduct with vertebrate animals is punishable with jail time ranging from six months to two years. Dog fighting is also proscribed as a criminal offense. Lastly, under Article 497, certain exemptions apply, such as the death of an animal resulting from cultural activities, the death or mutilation of an animal considered a pest, justified death or mutilation of an animal under the care and supervision of a specialist, marking or shoeing of vertebrate animals for the purpose of distinguishing livestock, and the slaughter of animals for human consumption in accordance with Norm NOM-033-SAG/ZOO-2014. With this amendment, the state takes a step toward enhancing animal protection. The next steps should focus on implementing this law, Investing in training government employees, and promoting awareness and education about animal cruelty laws and their implications within the state. Through these efforts, trust in a government capable of conducting investigations into animal cruelty and enforcing sanctions will encourage citizens to report such cases.
