MN - Trust - 501C.0408. Trust for care of animal

Summary:

This Minnesota law enacted in 2016 allows for the creation of a pet trust. A trust may be created to provide for the care of an animal alive during the settlor's lifetime. The trust terminates upon the death of the animal or, if the trust was created to provide for the care of more than one animal alive during the settlor's lifetime, upon the death of the last surviving animal. Interestingly, the trust may not be enforced for more than 90 years.

MN - Disaster Planning - Minnesota Emergency Operations Plan (MEOP)

Summary:

The Minnesota Emergency Operations Plan contains references to both household pets and service animals. The plan defines "household pet" as "[a] domesticated animal, such as a dog, cat, bird, rodent (including a rabbit), or turtle that is traditionally kept in the home for pleasure rather than for commercial purposes and can travel in commercial carriers and be housed in temporary facilities. Household pets do not include reptiles (except turtles), amphibians, fish, insects/arachnids, farm animals (including horses), and animals kept for racing purposes"

MN - Liens - § 514.93. Summary sale of unclaimed animal; notice; proceeds; record

Summary:

Under Minnesota statute, a veterinarian may lawfully sell an animal if it is left unclaimed with the veterinarian for ten or more days following a procedure that is provided by the veterinarian. Prior to sale, the veterinarian must provide notice to the owner of the animal. The veterinarian is also required to follow all necessary procedures before and after the sale of the animal that is listed in the statute.

MN - Lien, veterinay - Chapter 514. Liens Against Property. Agricultural Liens.

Summary:

These Minnesota statutes relate to agricultural liens on livestock. Under these sections, an “agricultural lien” includes a veterinarian's lien, breeder's lien, livestock production input lien, temporary livestock production input lien, and feeder's lien. In section 514.966 entitled, "Agricultural lien on livestock," a licensed veterinarian performing emergency veterinary services in the ordinary course of business that cost more than $25 for animals at the request of the owner or a person in possession of the animals has a lien on the animals for the value of the services. Additionally, a veterinarian's lien, breeder's lien, livestock production input lien, temporary livestock production lien, or feeder's lien attaches to the livestock serviced by the agricultural lienholder, and products and proceeds thereof to the extent of the price or value of the service provided. To perfect the lien, a financing statement must be filed within the time periods established in the law.

Detailed Discussion of Minnesota Great Ape Laws

Summary:

The following article discusses Great Apes law in Minnesota. While there is no direct law governing who may own a great ape in Minnesota, there are, however, laws in various parts of the Minnesota code that have some limited application to great apes. On the upside, the state's anti-cruelty law applies to all animals, and there is a law specifically protecting companion animals which applies to apes kept for that purpose. On the other hand, the structure of the state's endangered species law - that it neither references apes nor the federal endangered list - makes it a particularly lacklustre protection. Moreover, the state's affirmative decision to address the ownership and possession of Great Apes as a "regulated" animal, along with a number of exceptions and exemptions to the general ban against possessing such animals, is a window into how the state views these animals.

Holt v. City of Sauk Rapids

Summary:

Sauk Rapids, Minnesota passed a city ordinance limiting the number of dogs that could be kept in a residential home. The appellants were dog owners, breeders, and Ms. Holt, who also rescued Newfoundland dogs help find new homes for them. The lower court held that the ordinances were unconstitutional, but the city appealed and on appeal the court reversed the finding. Minnesota law granted the municipality the authority to regulate public and private property, including regulating the keeping of dogs on residential property. City Hall received many complaints concerning dogs, so the Sauk Rapids ordinance was introduced by the mayor to address issues with dog odor and noise. Because limiting the number of dogs can reduce odor and noise, the court found that there was a rational relationship between the ordinance and reducing the problems associated with the dogs. The dog owners failed to show that the ordinance was unreasonable. The constitutionality was upheld because the ordinance was rationally related to the health, safety, and general welfare of the community as affected by dogs.
