Virginia Barnes and Jan Swearingen appealed a trial court's decision in favor of the City of Anderson, Ind., granting a permanent injunction enjoining the women from keeping and maintaining Swearingen's pet Vietnamese pot-belly pig, Sassy, and ordering Sassy's removal from the residence. Appeals Court found for pig owner, holding that the phrase "raising or breeding" in an Anderson livestock ordinance refers to a commercial enterprise and not to the keeping of pigs as pets.  

Defendant was charged with criminal mischief and cruelty to an animal after dragging it with his car. The court concluded that, although some of the photos admitted were gruesome, the municipal court validly admitted the photos of the dog that defendant injured into evidence because the photos clearly aided the jury in understanding the nature of those injuries and the veterinarian's testimony as to the medical attention that the dog received.

Cattle breeders sued veterinarian who negligently vaccinated two cows leading to slaughter of one and quarantine of the herd was quarantined. The Court of Appeals held that breeders: (1) could not recover lost profits from unborn and future unborn calves; (2) could not recover damages for injury to business reputation; (3) could not recover for default in payment of financial obligations or collection procedures brought against them; (4) were properly allowed to present evidence as to the loss of net profits as result of cancellation of spring production sale and subsequent delay in selling animals; and (5) interest expense was not a variable cost for purposes of action.

A neighboring landowner brought a nuisance claim against a dairy farm when the dairy farm decided to expand its operations; the dairy farm, however, used Indiana’s Right to Farm Act as an affirmative defense. Agreeing with the dairy farm, the trial court granted the dairy farm’s motion for summary judgment.  Upon appeal, the appeals court affirmed the lower court’s decision.

An attendant of a dog fight was convicted of a Class A misdemeanor under section 35-46-3-4 of the Indiana Code. On appeal, the defendant-appellant argued that the statute was unconstitutionally vague and that the statute invited arbitrary law enforcement, which violated the Due Process clause of the U.S. Constitution. Though the appeals court found the defendant-appellant had waived her constitutional claims by not filing a motion at the bench trial, the appeals court found her claims lacked merit. The defendant-appellant’s conviction was therefore upheld.

Dog attack victim sued city and its animal control department, seeking damages for injuries he sustained from a dog attack in his neighborhood. The victim claimed that the city failed to enforce its animal control ordinance. The Supreme Court held that city and its animal control department had law enforcement immunity because the Tort Claims Act provided immunity to governmental entities for any loss due to failure to enforce a law.

Defendant Lee Carroll appealed his sentence after the trial court accepted his plea of guilty to two counts of class A misdemeanor dog bite resulting in serious bodily injury. While the court noted that Defendant's lack of criminal history was a mitigating factor, the "great personal injury" suffered by the victim far exceeded any mitigation. On each count, the trial court sentenced Carroll to 365 days, with four days suspended, and ordered “both” to “run consecutive to one another.” On appeal, Defendant argued that any consideration of the his dogs' breed was improper. However, the court found that the other evidence was sufficient to support his sentence (in a footnote the court addressed it directly: "We need not address whether the trial court erred to the extent it found the breed of his dogs to be an aggravator..."). The court was not persuaded that the nature of the offenses or the character of the offender justified revising his sentence.

In this Indiana case, appellant-defendant appealed his conviction for misdemeanor Cruelty to an Animal for beating his 8 month-old dog with a belt. Price contended that the statute is unconstitutionally vague because the statute's exemption of “reasonable” training and discipline can be interpreted to have different meanings. The court held that a person of ordinary intelligence would also know that these actions are not “reasonable” acts of discipline or training. Affirmed.
