Allen v. Pennsylvania Society For The Prevention of Cruelty To Animals

Summary: <p> This is a &sect; 1983 civil rights action brought by Robert Lee Allen against certain state actors arising from their search of his property, seizure of his farm animals, and prosecution of him for purported violations of Pennsylvania's cruelty-to-animals statute. The animals Allen typically acquires for his rehabilitation farm&nbsp;are underweight, in poor physical condition, and suffer from long-standing medical issues. After&nbsp;receiving a telephone complaint regarding the condition of the horses and other livestock on Allen's farm, humane officers visited Allen's property to investigate allegations. Subsequently,&nbsp;a warrant to seize eight horses, four goats, and two pigs was executed&nbsp;on a day when&nbsp;the officers&nbsp;knew Allen would be away from his farm with&nbsp;"twenty five&nbsp;assorted and unnecessary individuals."&nbsp;&nbsp;The court held that the farmer's allegations that state and county humane societies had a custom, policy or practice of failing to train and supervise their employees stated &sect; 1983 claims against humane societies. Further, the defendants were acting under color of state law when they searched and seized farmer's property. <br/> </p>

U.S. v. Zak

Summary: <p> Defendant pleaded guilty to three counts under the MBTA after agents determined that he killed 250 great blue herons; he then went to trial on the remaining counts under the MBTA and BGEPA&nbsp;related to his killing of a juvenile bald eagle on his commercial fish growing operation. On appeal, defendant contended that he cannot be found guilty under the MBTA unless the government proved beyond a reasonable doubt that he knew the bird he was shooting was protected and intentionally shot it with that knowledge (defendant stated that he shot a "big brown hawk'). The court disagreed, finding the overwhelming authority requires no such specific scienter on the part of the actor. With regard to defendant's contention that the government failed to prove the "knowingly" prong of the BGEPA, the court was equally unpersuaded. The evidence demonstrated beyond a reasonable doubt that defendant knowingly shot the eagle as it sat perched on the dead pine tree on the edge of his property,&nbsp;regardless of whether he knew the juvenile bird was an eagle or, as he said, &ldquo;a big brown hawk.&rdquo; </p>

Center for Biological Diversity v. Lohn

Summary: <p> This case questions&nbsp;whether the federal government's policy for listing killer whales under the Endangered Species Act is invalid. The Fish and Wildlife Service initially issued a proposed ruling that listing the Southern Resident was &ldquo;not warranted&rdquo; because the Southern Resident was not &ldquo;significant&rdquo; to its taxon. The district court set aside the Service's &ldquo;not warranted&rdquo; finding, and ordered the Service to reexamine whether the Southern Resident should be listed as an endangered species and to issue a new finding within twelve months.&nbsp;After again being challenged by plaintiff, the Service issued a final rule listing the Southern Resident as an endangered (as opposed to threatened) species. The Service contends that this case is now moot because it has, since the district court's decision, issued a proposed rule that recommended listing the Southern Resident as a threatened species and ultimately has issued a final rule listing the Southern Resident as an endangered species. This court agreed, and thus vacated the&nbsp;district court's order and remanded the case&nbsp;with instructions to dismiss the case as moot. </p>

Humane Society of U.S. v. Johanns

Summary: <p> In this case, plaintiffs alleged that by creating a fee-for-service ante-mortem horse slaughter inspection system without first conducting any environmental review under the National Environmental Policy Act (NEPA), has violated NEPA and the Council on Environmental Quality's (CEQ's) implementing regulations, abused its discretion, and acted arbitrarily and capriciously in violation of the Administrative Procedure Act (APA). At the time Plaintiffs filed their Complaint, horses were slaughtered at three different foreign-owned facilities in the United States to provide horse meat for human consumption abroad and for use in zoos and research facilities domestically. The instant case pertains to the web of legislation and regulations pertaining to the inspection of such horses prior to slaughter. Based on the Court's finding of a NEPA violation, the Court declared the Interim Final Rule to be in violation of the APA and NEPA, vacated the Interim Final Rule, permanently enjoined the FSIS from implementing the Interim Final Rule, and dismissed this case. This present action&nbsp;is defendant-intervenor Cavel International, Inc's Emergency Motion for a Stay of the Court's March 28, 2007 Order. The Court notes that as of the Court's March 28, 2007 Order, Cavel was the only facility still in operation processing horsemeat for human consumption. The Court finds that a stay of its March 28, 2007 Order would not be in the public interest, and particularly in light of Cavel's failure to demonstrate a likelihood of success on the merits and adequately demonstrate irreparable injury, the Court finds that a balancing of the factors enumerated above supports denying Cavel's request for a stay.&nbsp; </p>

Ouderkirk v. People for Ethical Treatment of Animals, Inc.

They&nbsp;filed a complaint alleging&nbsp;that&nbsp;PETA lied to them to gain access to their farm, took video footage of their farm operation, and then published an expos&eacute; on PETA's website that put the plaintiffs in an unfavorable false light. The court ultimately granted&nbsp;defendant-PETA's motion for summary judgment on all the issues. The court observed that the Ouderkirks gave permission for the taping in an email that makes no reference to any restriction on that consent. Further, the primary use made of the plaintiffs' likenesses by the defendant was to advocate against the chinchilla trade; thus, PETA had a right under the First Amendment to disseminate the information containing the plaintiffs' likenesses. </p>

Creekstone Farms Premium Beef v. United States Department of Agriculture

Summary: <span> Creekstone Farms Premium Beef (Creekstone) sought to independently test their slaughtered cows so they could more safely provide meat to consumers. Creekstone requested testing kits from the USDA, the same kits that USDA inspectors use to test for BSE. <span> The district court ruled that Creekstone could perform the tests. </span> </span>

Diercks v. Wisconsin

Summary: <p> An owner of a greyhound kennel was suspected of giving her dogs illegal steroids because an informant told the government agency this was happening. The particular steroid used was impossible to detect using urine samples, so the government agency, without a warrant, installed covert video cameras in the kennel and that way determined that the owner was injecting her dogs. The owner claimed this violated her Fourth Amendment search and seizure rights, and the court agreed; however, the agency actors were not liable because the state of the law on this issue was not clear and it was reasonable for them to think they could legally install the video surveillance system. </p>

The United States Department of Agriculture investigated and said that the plaintiff needed to get an exhibitor's license to show the cats, but that was not possible unless the cats were enclosed. Plaintiff sued the government in order to avoid the $200 per cat per day fines assessed, but the court held that the government has sovereign immunity from being sued. </p>

Summary: <p> Defendants were caught illegally over-fishing off the coast of South Africa and selling the fish in the United States, in violation of the Lacey Act. The United States Government could not seek compensation for South Africa under the Mandatory Victims Restitution Act because the fish were not property belonging to South Africa. However, the United States Government may be able to seek restitution for the South African Government under the discretionary Victim and Witness Protection Act.&nbsp; <strong> Opinion Vacated and Remanded by: <a href="/cases/causfd631f3d33.htm"> <em> U.S. v. Bengis, 631 F.3d 33 </em> (2nd Cir., 2011). </a> </strong> </p>

Summary: <p> A government agency was killing mute swans, because of their impact on the environment, and the plaintiffs sued, alleging that this action violated the Migratory Bird Treaty Act (that implements international treaties the United States has with Canada and Mexico). The Court found that the government agency may kill mute swans because the Migratory Bird Treaty Reform Act, implemented in 2004, modified the Migratory Bird Treaty Act to allow for&nbsp;the killing of non-native birds. Mute swans are non-native to the United States because they were brought over from Europe. </p>
