Flathead-Lolo-Bitterroot Citizen Task Force v. Montana

Summary: This case was brought by several environmental organizations against the Montana Fish and Wildlife Commission to challenge the approval or regulations that authorize the trapping and snaring of wolves within grizzly bear habitat in Montana. The grizzly bear is listed as threatened under the Endangered Species Act (ESA), and the Montana trapping regulations allow wolf hunters to use foothold traps large enough to capture grizzly bears. Grizzly bears rely heavily on their front and back paws to hunt for food, so crippling their limbs with these traps will lead to the incidental killing of grizzly bears from starvation. Plaintiffs contend that allowing the trapping of wolves in grizzly bear territory is in violation of § 9 of the ESA, as it will lead to the incidental unlawful taking of grizzly bears. Plaintiffs sought a preliminary injunction to enjoin the start of the wolf trapping season, and raised questions on the merits and established a reasonable threat of harm to grizzly bears if the trapping and snaring of wolves is allowed in their habitat. On the merits of the claim, slthough defendants could prove that no grizzly bears had been killed with such traps in Montana for several years, the court found that plaintiffs succeeded on the merits as there was evidence of grizzly bears being killed by such traps in adjacent states. Plaintiffs also showed that there was a likelihood of harm to grizzly bears, with evidence that these traps will lead to the death of grizzly bears. The court granted plaintiff’s motion for preliminary injunction in part and denied in part, and enjoined the Montana Fish and Wildlife Commission from authorizing wolf trapping and snaring.

Hines v. Pardue

Summary: Plaintiff and veterinarian Ronald S. Hines brings this action to challenge a Texas law that mandates a veterinarian conduct a physical examination of an animal before practicing veterinary medicine on the grounds that the law violates his First Amendment right to free speech. Plaintiff, who was unable to maintain a veterinary practice in person due to medical issues, began providing veterinary advice to animal owners via a website without first examining their animals. Plaintiff was disciplined by the Texas State Board of Veterinary Medical Examiners for doing this, and was fined $500 and sentenced to a year of probation. Plaintiff then sued the members of the Board on two separate occasions, with the second appeal being remanded by the Fifth Circuit with instructions to determine whether the requirement for a physical examination before issuing veterinary advice regulates speech incidentally to the regulation of non-expressive professional conduct, or is a regulation of non-expressive conduct. Here, the district court first examined multiple instances of plaintiff providing veterinary advice to animal owners via the internet. Next, the court asserts that plaintiff has standing to pursue his claims against the board. Lastly, the court examines plaintiff’s First Amendment argument. Plaintiff argues that his email exchanges with animal owners constitutes speech, and the court agrees that this is speech and that the Examination Requirement regulates this speech. However, the court finds that this regulation of plaintiff’s speech is content neutral, because the requirement for a physical examination of the animals before issuing advice applies neutrally to all forms of veterinary care and veterinary speech regardless of content. Therefore, the court held that defendants may enforce the Examination Requirement without violating plaintiff’s free speech rights.

Summary: This case is brought by a farm in the business of raising and breeding pigs. Plaintiff brought suit against a veterinarian and veterinary clinic for several claims, including malpractice. Plaintiff alleges defendant failed to oversee and perform testing for Mhp, leading plaintiff to unknowingly transfer infected pigs to other farms resulting in monetary damages. Defendants moved for summary judgment and were denied, with the court holding that the two year statute of limitations for veterinary malpractice claims does not apply, and the five year statute of limitations for unwritten contract applies.

Moreland v. Lowdermilk

Summary: This case concerns the untimely death of a female racehorse, whose owners brought this veterinary malpractice action against the veterinarians that treated this mare. Her owners sought reimbursement for her future potential racing earnings, her future potential earnings as a brood mare, and recovery of monies owed for veterinary services rendered. However, the court held that the sole cause of the condition that led to the mare's death was the owner's failure to administer a proper worming program to the mare, not the actions of the veterinarians. The court held that the veterinarians could not have administered treatment to save the mare, and therefore had not committed malpractice.

Cramer v. Harris

Summary: Plaintiff William Cramer filed this lawsuit in federal district court to challenge the constitutionality of California’s Proposition 2, which requires California egg farmers to house egg laying hens in less restrictive enclosures. Plaintiff argued that, because Proposition 2 did not specify a minimum cage size for egg laying hens, a reasonable person could not discern whether the enclosures being used were compliant with Proposition 2 and that the law is void for vagueness as a result. The district court dismissed the lawsuit. On appeal, the court reasoned that Proposition 2 did not need to specify a minimum amount of space per bird, and that the space requirements mandating that each hen be able to extend its limbs fully and turn around freely can be discerned using objective criteria. Accordingly, the court of appeals affirmed the judgment of the lower court and dismissed the lawsuit.

Summary: After California passed Proposition 2 to mandate more humane housing standards for egg laying hens, the state then passed Assembly Bill 1437 to extend the applicability of Proposition 2’s standards to out of state egg producers. In response, six states, Missouri, Nebraska, Oklahoma, Alabama, Kentucky, and Iowa, filed suit against the Attorney General of California seeking to block enforcement of the regulations before they went into effect. The states asserted parens patriae standing on behalf of the egg producers within their borders that would face increasing production costs as a result of compliance with the requirements of Proposition 2 and Assembly Bill 1437. The district court dismissed the case with prejudice, finding that plaintiffs lacked standing. On appeal, the court found that plaintiffs failed to establish an interest apart from those of private egg producers within their borders, and acknowledged that those private egg producers could file a claim themselves. The allegations about the potential economic impact of the regulations were also found to be speculative, since the regulations had not yet gone into effect. Lastly, the court held that the regulations themselves are nondiscriminatory, since they apply to in state egg producers as well. However, because plaintiffs could file an amended complaint after the regulations go into effect that may be sufficient to establish standing, the case was dismissed without prejudice.

North American Meat Institute v. Becerra

Plaintiffs acknowledged that Proposition 12 was not facially discriminatory, and that Proposition 12 did not have a discriminatory purpose, because there was a lack of evidence that the state had protectionist intent when enacting Proposition 12. The district court dismissed the case, and the court of appeals affirmed the judgment of the lower court.

Summary: The Iowa Pork Producers Association, an organization that represents Iowa-based industrial pig farmers, filed a lawsuit in federal district court alleging that California’s Proposition 12 is unconstitutional. Proposition 12, a ballot measure that California voters passed in 2018, mandates that pregnant pigs must be housed with a certain amount of space in order for products made from such livestock to be sold in California. Proposition 12 also bans the sale of pork meat from producers that do not comply with the housing requirements, including sales from out of state producers. Plaintiff contended that Proposition 12 violates the dormant commerce clause in that it discriminates against interstate commerce, directly regulates extraterritorial conduct, and that even if it regulates evenhandedly to effectuate a legitimate local public interest, the burden imposed on commerce is clearly excessive in relation to the putative local benefits. The court looked to the purpose of Proposition 12, which is intended to prevent animal cruelty by phasing out extreme methods of farm animal confinement, which also threaten the health and safety of California consumers, and increase the risk of foodborne illness and associated negative fiscal impacts on the state of California. The court found that this purpose is not discriminatory, and that there is no hint of economic protectionism. The court also found that there is no discriminatory effect, as the statute treats all producers the same by imposing the same requirements. The court also denied the extraterritoriality claim because Proposition 12 is not a price control or price affirmation statute and, therefore, does not directly regulate extraterritorial economic conduct. The court also found that the burden imposed on commerce was not clearly excessive in relation to the putative local benefits. The court’s precedent states that even if producers will need to adopt a more costly method of production to comply with Proposition 12, such increased costs do not constitute a substantial burden on interstate commerce, and higher costs to consumers do not qualify as a substantial burden on interstate commerce. The district court dismissed the case, holding that plaintiffs failed to raise serious questions as to the merits of the claims.

Ctr. for Biological Diversity v. Haaland

Summary: A small porpoise called the vaquita is on the verge of extinction, largely due to gillnet fishing of the totoaba fish that commonly traps and kills vaquitas as well. This fishing takes place in waters in Mexico’s territory, where the last few vaquitas live. In 2020, under the Marine Mammal Protection Act (MMPA), the United States banned the importation from Mexico of seafood products caught with gillnets inside the vaquita’s range. The Center for Biological Diversity, the Animal Welfare Institute, and the Natural Resources Defense Council, Inc. (Plaintiffs) brought this lawsuit in 2022 against the Secretary of the U.S. Department of the Interior Deb Haaland and the U.S. Department of the Interior (Defendants). Plaintiffs argue that Defendants caused an unlawful delay responding to a 2014 letter requesting that Secretary of the Interior certify the embargo against Mexico in order to curb the fishing of the totoaba, as doing otherwise diminished the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) by furthering the extinction of the vaquita. Plaintiffs also requested an order enjoining defendants from further delay in responding to the petition to certify Mexico, and costs and attorneys’ fees associated with the lawsuit. After settlement negotiations took place, parties reached a conditional settlement, and Secretary Haaland certified to the President that the fishing of totoaba by Mexican nationals and related killing of vaquita diminishes the effectiveness of CITES. It remains unclear whether Mexico has made progress in implementing the plan to save the vaquita, whether CITES is being implemented effectively by Mexico, and whether the President will act on the Secretary’s certification. After confirming that the Secretary of the Interior certified Mexico pursuant to the settlement agreement, parties entered into a voluntary dismissal and the court dismissed the lawsuit.
