Liotta v. Segur

Summary: In this unreported Connecticut case, a dog owner sued a groomer for negligent infliction of emotional distress, alleging that the groomer negligently handled her very large dog when he removed it from her vehicle with “excessive force.” This resulted in a leg fracture, that, after lengthy and expensive care, ultimately resulted in the dog's euthanization. The court held that plaintiff failed to adequately plead a case for negligent infliction of emotional distress, but said in dicta that the results might be different for a pet owner who proves intentional infliction of emotional distress. Motion for summary judgment as against plaintiff's count two is granted.

Auster v. Norwalk United Methodist Church (Unpublished)

Summary: In this unpublished Connecticut opinion, the defendant-church owned property and leased a portion of the premises to one of its employees, Pedro Salinas.  The plaintiff was attacked by a dog, owned by Salinas, while lawfully on the defendant's premises.  The plaintiff appealed a summary judgment ruling in favor of defendant.  On appeal, the court found that a genuine issue of material fact existed as to whether defendant-church was a "harborer" of the dog under Connecticut law.  Because Salinas and the church had no formal lease agreement, dispute existed as to the exact parameters of Salinas' exclusive control of the premises where his dog roamed.  There also existed a material fact regarding the church's knowledge of the dog's vicious propensities because it had twice previously attacked a person. (Note the jury trial decision in favor of plaintiff was later overturned in Auster v. Norwalk United Methodist Church , --- A.2d ----, 94 Conn.App. 617, 2006 WL 797892 (Conn.App.)).

Animal Rights Front, Inc. v. Planning & Zoning Com'n of Town of Glastonbury

Summary: The plaintiff, Animal Rights Front, Inc., an environmental intervenor, appeals from a final decision of the defendant that gave subdivision and special permit approval to an application by defendant Rejean Jacques d/b/a Rejean Realty, Inc.  The basic issue of the plaintiff's appeal relates to preservation of the Eastern Timber Rattlesnake, an endangered species common to the Diamond Lake section of Glastonbury, and its migration across the development project, which would inherently lead to mortality.  On appeal, defendants questioned plaintiff's standing because they contended that rattlesnakes do not fall under the category of "natural resources."  Relying on a companion case, the court noted that endangered species are inherently deemed natural resources.  However in dismissing plaintiff's appeal, the court found that the defendant made changes that provided for the protection of the rattlesnake and the commission reasonably relied upon these assertions by the defendant to support its conclusions so it was not required to consider alternatives to the proposed development.

Vargas v. Vargas

Summary: Court awarded custody of rottweiler to wife, after considering testimony adduced (husband was not treating the dog very nicely) and the state of the husband’s home (scrap metal yard and fact 5-year-old child visits regularly).  This decision was made notwithstanding the fact that dog was gift from wife to husband and the dog was registered to husband with AKC.

Housing Authority of the City of New London v. Tarrant

Summary: A mother renting housing alleged that her son was "mentally challenged" and required the companionship of a dog pursuant to Section 504 of the Rehabilitation Act. The court rejected the tenant's allegations that her son had a qualifying mental disability, reasoning that the son received high marks in school prior to the commencing of the eviction proceedings. The court held that without evidence of a mental or physical disability, no reasonable accommodation is required.

Woodside Village v. Hertzmark

Summary: The question in this case is whether federal and state laws outlawing discrimination in housing prohibit the eviction of a mentally disabled defendant from his federally subsidized apartment because of his failure to comply with the plaintiff's pet policy. The plaintiff here had disabilities including schizophrenia and severe learning disabilities. The plaintiff-landlord allowed tenants to keep pets, but required pet care, which included walking the dogs in a designated area and requiring that tenants use a "pooper scooper" to clean up behind their pets. The tenant-defendant here does not dispute that he failed to comply, but claims the plaintiff-landlord, as a recipient of federal funds, failed to reasonably accommodate his disability. The court found that plaintiff-landlord did in fact accommodate the defendant-tenant's disability by either waiving the provisions of its pet policy or permitting the defendant to build a fenced in area for the dog in the rear of the defendant's apartment. The eviction here was not based on the fact that defendant-tenant possesses a dog, but on his "demonstrated inability to comply with the plaintiff's pet policy." This, said the court, put other residents' health, safety and comfort at risk.

State v. Bonilla

Summary: The issue before the court in this case is whether defendant's felony conviction for being a spectator at a cockfight (contrary to General Statutes § 53–247(c)) violates defendant's constitutional rights to assemble and associate, and his equal protection rights. In rejecting defendant's arguments, the court noted first that the right to assemble does not encompass the right to assemble for an unlawful purpose. Further, the right to associate was not infringed because "[a]ttending a cockfight as a spectator is neither a form of 'intimate association' nor a form of 'expressive association' as recognized by our courts or the United States Supreme Court . . ." As to defendant's claim of violation of equal protection, the court found that the aim of § 53–247(c)(4), criminalizing being a spectator at a cockfighting event, is rationally related to the legislative goal of preventing such fights from being staged.

Giacalone v. Housing Authority of Town of Wallingford

Summary: In this Connecticut case, a tenant, who was bitten by a neighbor's dog, brought a common law negligence action against the landlord, the housing authority of the town of Wallingford. The tenant then appealed after the lower court granted the landlord's motion to strike the complaint. On appeal, this Court held that the tenant properly stated a claim under common law negligence against the landlord. Relying on Auster v. Norwalk United Methodist Church, 286 Conn. 152, 943 A.2d 391 (2008) , the court concluded that a common-law negligence action brought against a landlord in a dog bite case should not be striken simply because the landlord was the the owner or keeper of the dog.

State v. Ancona

Summary: Defendant Michael Ancona appealed his conviction of permitting a dog to roam at large in violation of General Statutes § 22-364(a). The defendant claims that (1) the court improperly held him responsible as a keeper of a dog when the owner was present and known to the authorities, and (2) the state adduced insufficient evidence to sustain his conviction. The plain language of the statute § 22-364(a) states that an “owner or keeper” is prohibited from allowing a dog to roam on a public highway. Either the owner or keeper or both can be held liable for a violation of the statute. The court also found sufficient evidence that defendant was the keeper of the pit bull: the dog stayed at his house, he initially responded to the incident and tried to pull the dog away, and defendant yelled at the Officer Rogers that she was not to take "his dog."

Summary: The plaintiff (Mann) brought this action to recover damages for injuries she sustained to her face when she was bitten by a dog owned by the defendant (Regan). The incident occurred when the defendant’s dog was being cared for by the plaintiff at her house while the defendant traveled out of state. With regard to defendant's tacit admission challenge, this court found that defendant’s silence in response to her daughter’s statement, “Well, mom, you know he bit you,” was within the trial court’s discretion to admit as a hearsay exception. As to the jury instructions, this court was not persuaded that there is a meaningful distinction between the words “vicious” and “dangerous” as used in the context of an action stemming from a dog bite.
