The existence of an order providing for the care of a pet animal during the course of proceedings for dissolution of marriage or for legal separation of the parties shall not have any impact on the court's final determination of ownership of the pet animal.

Jakubaitis v. Fischer

Summary: This case, as an issue of first impression, considers whether Civil Code section 3051 or 30801 governs a dispute involving a veterinary lien for services rendered to a horse. In 1994, Frank and Tara Jakubaitis took their blood-bay horse to Chino Valley Equine Hospital for emergency medical care. Theodore Fischer is the veterinarian that treated the horse, who was hospitalized from February of 1994 to early March of 1994. A letter was sent to the Jukabaitises stating that they had an outstanding balance due of $9,751 and that the horse would not be released until the balance was paid. The letter also informed them that if no payment was made within 10 days, the horse would be sold. The Jukabaitises did not pay for the veterinary services within 10 days, however, the veterinary hospital’s attempts to sell the horse were unsuccessful and the horse remained in the possession of Fischer. The Jakubaitises then sued the hospital, seeking injunctive relief and alleging conversion, claim, and delivery and negligent infliction of emotional distress. The trial court had ordered Fisher to return the horse to the Jakubaitises upon them posting a $500 bond. Fischer then brought this appeal. The case came down to the interpretation of various sections of California law. The trial court impliedly found section 3080 of the California Code to be controlling and sections 3051 and 3052 to be inapt. Section 3051 recognizes veterinary proprietors’ and veterinary surgeons’ lien rights for compensation in caring for, boarding, feeding, and medically treating animals. Section 3052 permits the lienholder, after giving notice to the debtor, to sell the animal at public auction. Section 3080 and 3080.01 govern liens applying to livestock servicers. Essentially, a veterinarian’s services could fall under either of the sections because the term “livestock service” in section 3080 included the term “veterinary services.” Eventually the legislature revised the definition of livestock services in section 3080 and deleted the reference to veterinary services. The Court concluded that the legislature’s intent was clear. Section 3051 continues to govern veterinarian proprietors’ and veterinary surgeons’ lien rights. Section 3080 governs all other livestock service providers. The Court ultimately reversed the trial court’s decision, ordered the horse to be returned to Fischer, the veterinarian, and discharged the bond that was to be paid by the Jakubaitises.

Theis v. Yuba County Sheriff's Department

Summary: The Plaintiffs allege that their cat, named Pizza, was unlawfully euthanized at Yuba County Animal Care Services shelter in Olivehurst, California on or about February 9, 2018. Pizza went missing on or about February 9, 2018 and Plaintiffs found out later that same day that a neighbor had found the cat and brought it to the Yuba County animal shelter. The Plaintiffs attempted to contact the shelter, but it had already closed for the evening. The next morning around 9:30 a.m., the Plaintiffs arrived at the shelter and learned that Pizza had been euthanized as early as 5:00 p.m. the night before. Defendant Barnhill, the shelter’s supervising officer, informed the Plaintiff’s that Pizza had been injured, however, the neighbor who brought the cat to the shelter without knowing it was the Plaintiffs’ described Pizza as looking healthy. The Plaintiffs contend that Pizza’s euthanization falls within an ongoing pattern and practice of abuse and failure to follow state and federal law. Plaintiffs filed their original complaint on October 1, 2018. The Defendants removed the case to federal court. Plaintiff’s asserted four claims in their First Amended Complaint: (1) the failure to perform mandatory duties in violation of California Government Code section 815.6, (2) petition for a writ of mandate under California Code of Civil Procedure section 1085, (3) violation of the plaintiff’s Fourteenth Amendment substantive due process rights under 42 U.S.C. section 1983, (4) negligence under California common law. The Defendants moved to dismiss Plaintiff’s First Amended Complaint and alleged that the Plaintiff’s did not plead facts sufficient to show that Barnhill engaged in unlawful conduct or to establish a substantive or procedural due process violation. The Court, however, granted the Plaintiffs leave to amend their complaint as to the section 1983 claim. The Court declined to assert supplemental jurisdiction over the state law claims, which were the Plaintiff’s first, second, and fourth claims since the Plaintiff’s had conceded that their federal claim by requesting to amend their complaint. As a result, the Court reviewed remaining claims to determine whether they may be included in any amended complaint or whether leave to amend would be futile. The Court determined that granting Plaintiff’s leave to file a second amended complaint would not be futile on all of their claims except for the petition for writ of mandate claim. California’s Civil Procedure Code section 1085 does not apply to federal courts and, therefore, the Plaintiff’s leave to amend this claim would be futile. Ultimately, the Court ordered Plaintiff’s third cause of action for violations of their Fourteenth Amendment substantive and procedural due process rights be dismissed with leave to amend, the Plaintiff’s state law claims in their first, second, and fourth causes of action be dismissed with leave to amend to the extent consistent with the order, and denied the Defendant's motions to strike Plaintiffs' punitive damages claim. Plaintiffs were required to file a second amended complaint within 21 days of the date the order was filed if they wished to amend their complaint.

Park Management Corp v. In Defense of Animals

Summary: An animal rights activist named Joseph Cuviello appealed the entry of a permanent injunction in a trespass action that prohibited him from demonstrating outside of Six Flags Discovery Kingdom ("The Park") in California. The superior court rejected Cuviello’s federal and state constitutional claims that he had a right to picket there peacefully and his common law defense based on a claimed prescriptive easement. The Park was originally municipally owned and privately operated until 2007 when the Park's management acquired the park from the City of Vallejo. After that acquisition, the Park began to limit free speech until it ultimately banned all expressive activity on the property. Cuviello was one of the many people that protested at the park advocating for animals and he had done so many times in the past. The Park filed a single cause of action for private trespass against several animal advocacy groups. Cuviello argued that he had a First Amendment right to protest there because the park had been dedicated to public use, the park was a public forum under state constitutional law, and given the amount of times he had protested at the park in the past, he had acquired a common law prescriptive easement right to protest there. The trial court denied Cuviello’s cross-motion for summary judgment and granted summary judgment for the Park. It ruled that the First Amendment does not apply to private property and that the property was not a public forum under California’s constitution. It also rejected the prescriptive easement claims. Although the Park was zoned as a public and quasi-public property, the Appeals Court grappled with whether to classify the Park as a private or public forum. The Court applied a balancing test which balanced society’s interest in free expression against the Park’s interests as a private property owner. The Court concluded that the unticketed, exterior portions of the Park was a public forum. Ultimately the Court held that the trial court erred in granting the Park’s summary judgment and in denying Cuviello’s cross-motion for summary judgment. Accordingly, the Court reversed the decision of the trial court and held that on the undisputed facts here, the Park may not ban expressive activity in the non-ticketed, exterior areas of Six Flags.

People v. Smalling

Summary: Defendant was cited for allowing a dog controlled or owned by her to cause injury or death to a service dog in violation of California’s Penal Code. The offense was an infraction. The defendant pled no contest and was fined $157. The service dog’s owner requested a restitution hearing, but the trial court denied the request stating that since the offense was an infraction, a restitution hearing was not permissible. The service dog owner appealed the decision of the trial court. The Court ultimately found that the trial court incorrectly stated that a victim of an infraction is not entitled to restitution. Both the California Constitution and the California Penal Code (the very statute that the Defendant was convicted of violating) entitle the victim to restitution. The California Constitution specifically states that restitution shall be ordered in every case regardless of the sentence or disposition of a crime in which a victim suffers a loss. The Court stated that an infraction is a crime, therefore, a restitution hearing is mandatory. The statute that the Defendant violated (section 600.2 of California’s Penal Code) also stated that a defendant shall be ordered to make restitution. The trial court abused its discretion in erroneously concluding that a crime victim is not entitled to restitution if the offense committed is an infraction and ultimately denying the victim restitution. The Defendant argued that an order for payment of restitution would be improper because she was never advised that victim restitution would be a consequence of her plea and that such an order would violate her plea agreement. She also argued that the trial court found, in good faith, that restitution was unnecessary. The Court, however, found the Defendant’s arguments unpersuasive. The Court reversed the order denying victim restitution and remanded the matter to the trial court with directions to conduct a restitution hearing.

Summary: This California law prohibits any owner or property manager from advertising a requirement, refusing occupancy of, or otherwise requiring a prospective tenant to declaw or devocalize any animal allowed on the premises. A city attorney, district attorney, or other law enforcement prosecutorial entity has standing to enforce this section and may sue for declaratory relief or injunctive relief for a violation of this section. Violation results in a civil penalty of not more than $1,000.
