Summary: This 2017 New York set of laws is known as the “safety in agricultural tourism act." The activities defined as agricultural tourism are broad, and include equine therapy, u-pick Christmas trees, touring farms, and hunting on farms. The act requires that operators of agricultural tourism areas post at every point of sale or distribution of tickets a conspicuous “Warning to Visitors” relative to the inherent risks of participating in activities on working farms and to provide written information based on requirements from the commissioner of agriculture. Wolff v. State

Summary: This Indiana case addresses the status of animals seized in conjunction with a criminal animal cruelty case. Specifically, the appeal addresses whether the trial court erred in granting a local animal rescue the authority to determine disposition of the seized animals. The animals were seized after county authorities received complaints of animal cruelty and neglect on defendant's property in late 2016. As a result of the charges, five horses, two mules, and two miniature donkeys were impounded and placed with a local animal rescue. Following this, the state filed a notice with the court that estimated costs of continuing care for the impounded animals. About a month later, the state filed an Amended Motion to Determine Forfeiture/Disposition of Animals, requesting the trial court issue an order terminating defendant's ownership rights in the animals. Alternatively, the state requested that defendant could seek to have his posted bond money apportioned to cover the costs associated with the animals' care. The court ultimately entered an order that allowed the rescue agency full authority to determine disposition of the animals after defendant failed to respond. In his current appeal of this order, defendant first claims that the trial court erred in giving the animal rescue such authority because defendant paid $20,000 in bail. The appellate court found that this money was used to secure defendant's release from jail and he did not request that the jail bond be used for the care of the animals. The court found that the legislature clearly intended the bail and bond funds are used for "separate and distinct purposes," so there was no way for the trial court to automatically apply this money to the animal care costs. Defendant had to affirmatively exercise his rights concerning the disposition of the animals pending trial, which he failed to do. As to defendant's other issue concerning an investigation and report by a state veterinarian, the appellate court found defendant waived this issue prior to appeal. The decision was affirmed.

Central Park Sightseeing LLC v. New Yorkers for Clean, Livable & Safe Streets, Inc.

Summary: This New York cases balances animal right protestors' First Amendment rights against the government's interest in preserving public safety and flow of traffic on public streets. Plaintiff here is a business that operates horse-drawn carriage rides in Central Park. Defendant is an animal rights organization that protests the horse-and-carriage industry, often demonstrating where carriage operators drop off and pick up customers. At issue, is the manner in which defendants conduct their protests in the designated horse-drawn carriage zones. Plaintiff's claim defendants harass and threaten customers and drivers, and create a public safety issue by chasing after carriages. The court granted a preliminary injunction that enjoined defendants from things like physically blocking or impeding persons from riding or disembarking from carriages, physically touching associated persons or horses, yelling or shouting at persons or horses, obstructing the progress of a carriage ride, and handing literature to a person situated within a horse carriage. The court found the plaintiffs also established a likelihood of success on an action for public nuisance and a showing of a "special injury" aimed at plaintiff's business. Finding the injunction was content-neutral, this reviewing court then considered whether the challenged portions of the injunction burden speech no more than is necessary to assert the significant government interest. The court agreed with defendant that the "floating buffer zone" of the original order would be difficult for a protestor to assess and would burden speech more than is necessary. Thus, this court modified the order to prohibit any person from knowingly approaching within nine feet of a person in the loading/unloading carriage zone (a “conversational distance," said the court). The court also noted that the First Amendment does not require that protestors be allowed to interrupt the flow of traffic or endanger the public in the delivery of speech. The court also limited language in the original order that extended the reach of the injunction to “anyone else who becomes aware of this [d]ecision and [o]rder.” The court changed to this to defendants and “those acting in concert with the named parties” The order from the Supreme Court, New York County was modified as specified in this decision.

Safari Club International v. Zinke

Summary: This case dealt with an action brought by an organization of safari hunters and firearm advocacy association under the Administrative Procedures Act (APA) and the Endangered Species Act (ESA) against the U.S. Fish and Wildlife Services (FWS), challenging the decision to suspend imports of sport-hunted African elephant trophies from Zimbabwe. The U.S. District Court for the District of Columbia entered summary judgment in FWS's favor, and the organization and association appealed. Under the ESA, sport-hunted African elephant trophies may only be imported into the United States if, among other things, the FWS makes “[a] determination ... that the killing of the trophy animal will enhance the survival of the species”. The Court of Appeals held that 1) FWS's interpretation of Special Rule forbidding import of sport-hunted elephant trophies was permissible; 2) FWS could base finding that killing of African elephants did not enhance species' survival on absence of evidence that sport hunting enhanced survival of species; 3) FWS's conclusion that it lacked evidence to make finding that killing African elephants in Zimbabwe would enhance survival of species rebutted any presumption that importation did not violate any provision of ESA or regulation issued pursuant to ESA; 4) removal of enhancement requirement from Convention on International Trade in Endangered Species of Wild Fauna and Flora did not require FWS to reconsider Special Rule; 5) finding constituted rule rather than adjudication; and 6) FWS's failure to engage in notice-and-comment prior to finding was not harmless error. Affirmed in part and reversed in part, and remanded so the FWS can initiate rule making to address enhancement findings for the time periods at issue in this case.

United States v. Wallen

Summary: Defendant appeals his conviction for unlawfully killing three grizzly bears in violation of the federal Endangered Species Act (ESA). The killing of the bears occurred on May 27, 2014 at defendant's residence in Ferndale, Montana ("bear country" as the court described). In the morning, defendant discovered bears had killed over half of his chickens maintained in a coop. Later that evening, the bears returned, heading toward the coop. Defendant's children, who were playing outside at the time, headed inside and defendant proceeded to scare the bears away with his truck. Later that night, the bears returned and were shot by defendant. According to testimony by enforcement officers, defendant gave two different accounts of what happened that night. Ultimately, defendant was charged for killing the bears in violation of the ESA and convicted by a magistrate judge after raising an unsuccessful self-defense argument. On appeal, defendant argued: (1) he should have been tried by a jury; (2) the magistrate judge did not correctly identify the elements of his offense, and that error was not harmless; and (3) the case should be remanded for a trial by jury in the interest of justice. With regard to (1), that he was entitled to a jury trial because the offense was serious, rather than petty, the appellate court rejected the argument. The possibility of a five-year probation term and $15,000 restitution did not transform the crime, which had a maximum 6-month imprisonment, into a serious offense. On the second and third arguments, the court agreed that magistrate erroneously relied on a self-defense provision from a federal assault case that required the "good faith belief" to be objectively reasonable. The court held that the "good faith" requirement for § 1540(b)(3) should be based on a defendant's subjective state of mind. Then, the ultimate question becomes whether that subjective good faith belief was reasonably held in good faith. Said the Court, "[u]nder the Endangered Species Act, the reasonableness of a belief that an endangered animal posed a threat is likewise strong evidence of whether the defendant actually held that belief in good faith." As a result, the appellate court found the error by the magistrate in rejecting defendant's self-defense claim was not harmless. As to whether defendant is entitled to a jury trial on remand, the court found that the outcome of the prior proceedings conducted by a magistrate do not constitute a showing of bias or partiality. Thus, he is not entitled to trial by jury. The conviction was vacated and proceedings remanded.

People v. Richardson

Upon entry by consent, police found, in plain view, a wounded dog in a cage, several modified treadmills for use by dogs, blood on a water heater, and apparent dogfighting paraphernalia. After seeking a search warrant, the items were photographed and other evidence (supplements, training sticks, etc.) was collected. On appeal, the court rejected defendant's argument that the trial court erred by refusing to suppress all of the physical evidence as fruit of the poisonous tree. The court noted that the dogfighting paraphernalia were observed in plain view by responding policy officers. Additionally, police officers remaining at the house after the protective sweep to prevent the destruction of evidence while the search warrant was issued did not render the search unlawful. Viewing the evidence in the light most favorable to the prosecution, the court concluded that the evidence was sufficient to establish that defendant intended to engage in dogfighting and that the dogs were deprived of medical treatment. In addition to the paraphernalia and collection of literature on dogfighting, defendant's dogs had extensive scarring and healing consistent with dogfighting and inconsistent with defendant's proffered "cat-scratch" and "broken window" explanations. Defendant's convictions and judgment of sentence were affirmed.

The Commonwealth elected to proceed against the juvenile under the state's youthful offender statute. The grand jury returned two youthful offender indictments for cruelty to animals and bestiality. The juvenile contends that the youthful offender indictments are not supported because "serious bodily harm" described in the law only relates to human beings and not animals. The juvenile court judge granted the juvenile's motion to dismiss and the Commonwealth appealed. On appeal, this court first examined the phrase "serious bodily harm" by looking at its plain meaning and other related statutes. In doing so, the court held that Legislature did not intend "serious bodily harm" language of the youthful offender law to apply to animal victims. When looking at the legislative history, the court found that the inclusion of the language reflected a growing concern about juveniles committing violent crimes (specifically, murder) and did not touch upon animals. The court noted while the crime here raises "grave concerns about the juvenile's mental health," the juvenile's conduct toward an animal did not meet the statutory requirements. The order granting the motion to dismiss was affirmed.

Defendant was charged with 13 counts of animal cruelty stemming from maltreatment of 13 dogs at his property. Evidence at the preliminary hearing showed that two of the dogs were chained to small, metal shelters, and 11 were individually penned, all in 100 degree heat. No dogs had adequate water and rotting carcasses were found within reach of the dogs. According to responding veterinarians, all dogs were extremely dehydrated and in need of immediate medical care and one dog had gone into shock (it later died). Most of the dogs were malnourished and poorly conditioned with parasite-infested wounds. At district court, defendant argued that he could only be charged with a single count of Cruelty to Animals because the dogs were found all in one location and had been abandoned for approximately the same time period. The district court acquiesced and granted defendant's motion to quash, finding no caselaw on point. On appeal, the Supreme Court found the district court's interpretation of 21 O.S.2011, § 1685 wrong as a matter of law. The section repeatedly use the phrase "any animal" to show that the intent to address acts of abuse against any particular animal. The Court observed that the state filed a count for each of the dogs at defendant's property because each dog needed to be separately fed and watered. "Gilchrist deprived all thirteen dogs of the food, water and shelter necessary to avoid the grotesque suffering observed at the scene." Thus, the Court found the district court abused its discretion in granting defendant's motion to quash.

The Court of Appeals agreed, and held that as a federal court, it was barred from hearing the claim under the Rooker–Feldman doctrine, which prevents lower federal courts from exercising jurisdiction over cases brought by state court losers challenging state court judgments rendered before the district court proceedings commenced. Additionally, the district court held that it should exercise Younger abstention because the proceeding was ongoing and because the plaintiff had an adequate opportunity to raise her federal claims about her dog in state court, but the Court of Appeals held that "Younger is now a moot question because there is no ongoing state proceeding for [the Court of Appeals] to disturb." As a result, the district court's dismissal for lack of subject matter jurisdiction was AFFIRMED.

Presidential Village, LLC v. Phillips

Summary: In this case, a landlord brought a summary process action against a tenant who lived in the federally subsidized apartment, based on tenant's keeping of “emotional support dog” in violation of a pet restriction clause in the tenant's lease. The trial court entered judgment in favor of tenant, based on equity, and the landlord appealed. The appeal was transferred to the Supreme Court of Connecticut. The Court held that: 1) appeal was not rendered moot by landlord's commencement of second summary process action against tenant, which was dismissed; 2) trial court could not rely on “spirit” of Department of Housing and Urban Development in exercising equitable discretion to enter judgment in favor of tenant; 3) trial court abused its discretion in applying doctrine of equitable nonforfeiture; and 4) summary process action was “civil action” to which medical treatment report exception to hearsay rule could be applied to allow for admission of letter from physician and social worker of tenant's niece concerning dog's benefit to niece. Reversed and remanded.

The Court held that: 1) appeal was not rendered moot by landlord's commencement of second summary process action against tenant, which was dismissed; 2) trial court could not rely on “spirit” of Department of Housing and Urban Development in exercising equitable discretion to enter judgment in favor of tenant; 3) trial court abused its discretion in applying doctrine of equitable nonforfeiture; and 4) summary process action was “civil action” to which medical treatment report exception to hearsay rule could be applied to allow for admission of letter from physician and social worker of tenant's niece concerning dog's benefit to niece. Reversed and remanded.
