RI - Shark - § 20-1-29. Trade in shark fins

Summary: This Rhode Island law, effective in 2017, prohibits the possession, sale, offering for sale, trading, or distribution of shark fin. “Shark fin” means the raw, dried, or otherwise processed detached fin or the raw, dried, or otherwise processed detached tail of a shark. Even if a person holds a license to take sharks, he or she must immediately destroy any shark fin separated from the shark unless used by the person for the purposes of taxidermy and subsequent display. Violation incurs a fine or not less than $500 nor more than $1,000 imprisonment of up to 90 days, or both.

OH - Restaurant - 3717.14 Dogs in outdoor dining area of retail food establishment or food service operation

Summary: This Ohio law, enacted in 2018, allows a retail food establishment or food service operation to allow patrons to bring dogs to outdoor dining area of the establishment or operation in accordance with this section. The establishment who allows dogs must do the following: (1) adopt a policy that requires patrons to control their dog, whether with a leash or otherwise, while the dog is in the outdoor dining area; (2) not allow the person to take the dog into the outdoor dining area through any of the establishment's or operation's indoor areas; and (3) comply with sanitation and other standards of Ohio codes. Dogs brought to outdoor dining areas must be properly vaccinated in accordance with state and local laws.

LA - Vehicle, animal - § 1738.1. Immunity from liability; gratuitous emergency care to domestic animal

Summary: This 2018 Louisiana law states that there shall be no liability on the part of a person for property damage or trespass to a motor vehicle, if the damage was caused while the person was rescuing an animal in distress. The person must first do the following: (1) make a good-faith attempt to locate the owner before forcibly entering the vehicle (based on the circumstances); (2) contact local law enforcement/911 before forcibly entering; (3) determine the vehicle is locked and has a good-faith belief there is no other reasonable means for the animal to be removed; (3) believe that removal of the animal is necessary because the animal is in imminent danger of death; (4) use no more force than necessary to rescue the animal; (5) place a notice on the windshield providing details including contact information and the location of the animal; and (6) remain with the animal in a safe location reasonably close to the vehicle until first responders arrive. For purposes of the law, "animal” means any cat or dog kept for pleasure, companionship, or other purposes that are not purely commercial.

Smith v. Meyring Cattle Co., L.L.C.

Summary: Harley Smith worked for Meyring Cattle Company. Smith was injured when a herd dog allegedly nipped at the hoof of one of the cows and the cow charged forward trampling Smith. Smith sustained substantive injuries. Smith sued Meyring under negligence theories and under strict liability as set forth under Nebraska law. The district court found for Meyring. Smith appealed asserting that the district court erred by finding as a matter of law that strict liability did not apply to the facts of the case and for granting Meyring’s motion for partial directed verdict. as matter of first impression, the Supreme Court of Nebraska stated that the element that a dog be vicious or have dangerous propensities is implicitly part of the strict liability statute. The Court concluded that there was no evidence that the herd dog bit, worried, or chased Smith. There was also no evidence that the herd dog’s actions were directed toward Smith. The language of the strict liability statute was never understood as encompassing bodily hurt to a person by way of a dog worrying or chasing “any sheep or other domestic animals” that collided with that person. The Court affirmed the judgment of the district court.

ZOOLOGICAL SOCIETY OF CINCINNATI v. THE GORILLA FOUNDATION

Summary: In 1991, the plaintiff, Zoological Society of Cincinnati, transferred a western lowland Gorilla named Ndume who had been living at the Zoo to The Gorilla Foundation (TGF) in Northern California. Ndume was sent to TGF in hopes that he and another gorilla there, named Koko, would mate and produce offspring. That never happened. In 2015, the Zoo and TGF entered into a new written agreement which expressly superseded any prior agreements. The agreement provided that upon the death of Koko, Ndume was to be placed at an institution that is accredited by the Association of Zoos and Aquariums (AZA). TGF is not an AZA accredited institution. KoKo died and the Zoo now wants to transfer Ndume back to the zoo. TGF has not made arrangements for a transfer to be carried out. The Zoo brought this suit seeking specific enforcement of the 2015 agreement and contends that it is entitled to summary judgment in its favor. TGF argued that the agreement was illegal and unenforceable because the transfer would harm Ndume. TGF identified a number of potential risks, particularly, that Ndume has a Balantidium Coli infection. TGF contended that stress could trigger an outbreak which could be fatal. The court was unpersuaded and stated that TGF signed the 2015 agreement less than 3 years before the present dispute arose and that all of the circumstances that TGF contends makes compliance with the agreement risky existed when the agreement was negotiated. TGF also contended that the agreement is impracticable due to unreasonable (non-monetary) costs. However, the Court again stated that TGF knew these facts and circumstances when it entered into the agreement. The Court granted the Zoo's motion for summary judgment and denied TGF's request for a continuance to permit it to take discovery. The parties were ordered to confer and attempt to reach a consensus on as many aspects of the protocol for transporting Ndume to the Zoo as possible. If within 30 days of the date of the order the parties cannot reach a consensus, they will have to file a joint statement setting out any issues on which they have reached a stalemate.

WildEarth Guardians v. United States Fish & Wildlife Service

Summary: In 2007, the U.S. Fish and Wildlife Service (The Service) issued regulations implementing the CITES Program for certain Appendix II species that are in the United States which include bobcats, gray wolves, river otters, Canada lynx, and brown grizzly bears. Under the regulations, certain requirements must be met prior to the species exportation from the Unites States. The Service annually distributes export tags to approved states and tribes which are then distributed to trappers, hunters, and other individuals seeking to export furbearer species. The Service drafted an incidental take statement setting a cap on the amount of Canada lynx that are allowed to be killed or injured while bobcats are hunted. Plaintiffs brought this action claiming that the U.S. Fish & Wildlife Service violated the National Environmental Policy Act (NEPA) by not adequately analyzing the direct, indirect, and cumulative effects of the CITES Program and by not preparing an Environmental Impact Statement (EIS). It is further alleged that the 2001 and 2012 Biological Opinions and Incidental Take Statement referenced and incorporated in the Environmental Assessment that the Service conducted is deficient under the Endangered Species Act (ESA). The Center for Biological Diversity filed a separate action raising similar NEPA claims. The two actions were consolidated into one and the WildEarth case was designated as the lead case. The Service and the intervenors challenged the Plaintiff's standing to bring their claims. The District Court found that the plaintiffs have standing to bring their claims. As for the NEPA claims, the Court held that the only time an EIS is necessary is when a specific agency action alters the status quo. In this case, the Court found no identifiable agency action that would alter the status quo. The Service has administered the CITES Export Program since 1975 and it does not propose "any site-specific activity nor call for specific action directly impacting the physical environment." As for the EPA claims, in the Incidental Take Statement drafted by the Service, the authorized level of take is set as follows: "two (2) lynx may be killed and two (2) injured annually due to trapping over the 10-year term of th[e] biological opinion." The Plaintiffs argued that the use of the word "and" in the "Two and Two" standard was ambiguous. The District Court agreed and held that as currently worded, the "two and two" fails to set an adequate trigger for take because it is not clear whether one or both are necessary to exceed the trigger. The Plaintiffs also argue that the terms "annually" and "injury" are ambiguous. The District Court held that "annually" was ambiguous, however, it was not enough to independently make the statement arbitrary and capricious. The Court also held that the Service's use of the word "injury" was both overbroad and underinclusive. The Service's interpretation and use of the term is arbitrary and capricious in the context of this case. The Court found that the reporting requirements were arbitrary and capricious and that the take statement does not set forth reasonable and prudent measures to minimize the impact of incidental taking on the species. The Service provides states and tribes with a brochure with information on lynx identification and other information every time bobcat tags are issued, however the brochures are not required to be given out by states and tribes, it is merely recommended. The District Court ultimately Denied the Plaintiff's motion for summary judgment as to their NEPA claims and granted it as to their ESA claims. The incidental take statement was remanded to the Service for further review and clarification.

Summary: The Legislature passed Assembly Bill 96 which took effect July 1, 2016 as Fish & Game Code section 2022. The bill imposed new restrictions on the sale and importation of ivory and rhinoceros horn. The Ivory Education (the Institute) sued the California Department of Fish and Wildlife (the Department) in order to block implementation of the law. The institute alleged that the statute was unconstitutional on multiple grounds including vagueness, federal preemption, the takings clause, and the commerce clause. The trial court entered judgment for the Department and the intervenor defendants (the Natural Resources Defense Council, the Center for Biological Diversity, the Humane Society of the United States, the International Fund for Animal Welfare, and the Wildlife Conservation Society). The Institute appealed and abandoned all other issues raised and limited its challenge to the void-for-vagueness doctrine. "The Institute contend[ed] that section 2022 [was] unconstitutionally vague for two reasons: 1) while it allows for the sale or import of ivory insofar as it is allowed by federal law, differences in what federal law allows make it nearly impossible to tell what would qualify for the exemption provided by section 2022(c)(c); and 2) there are no guidelines by which to determine the permissible volume of ivory in either musical instruments or antiques." The Court of Appeals stated that a statute is not vague if its meaning can be determined by looking at other sources of information. Those who wish to comply with section 2022 have a duty to locate and examine statutes or whatever else necessary to determine the scope of the exemption provision. "Section 2022 has a single purpose—to prevent the sale or importation of ivory and rhinoceros horn. Both of those terms are defined. The Institute has 'not demonstrated that attempts to give substance and meaning' to the three disputed exceptions 'would be fruitless.'" As for the Institute's second contention, the Court of Appeals stated that because musical instruments and antiques are tangible objects that occupy a verifiable amount of three-dimensional space, the percentage of any such object that has ivory in it can be readily determined. The Court of Appeals held that the statute was not vague. The Court affirmed the holding of the trial court.

Baughman v. City of Elkhart, TX

Summary: Plaintiff Tammy Baughman filed a complaint on May 31, 2017 seeking relief pursuant to 42 U.S.C. § 1983, alleging a violation of her Fourteenth amendment rights; the Americans with Disabilities Act (ADA), alleging that she was discriminated against; the Fair Housing Amendments Act (FHAA), alleging a failure to make reasonable accommodations; and 42 U.S.C. § 3613. Plaintiff asserts that she is disabled due to a failed back surgery. She also has fibromyalgia, depression, and other health issues. Plaintiff has a seven pound ring tail lemur that she claims is an emotional support animal that improves her quality of life. Plaintiff's lemur bit a mail carrier on December 5, 2012 which left lacerations on the carrier's hand and wrist. Plaintiff then moved to Elkhart, Texas in December 2014 where her lemur bit another person on June 25, 2015. In both instances the lemur was quarantined for 30 days and then returned to Plaintiff. The City of Elkhart enacted an ordinance on October 5, 2015 that bans all non-human primates from the city. Plaintiff claims she requested an accommodation form the City to keep her lemur as an emotional support animal, but her request was denied. The defendants, which include the mayor and city council members, claim the plaintiff never requested an accommodation. Plaintiff further alleges that the defendants "showed deliberate indifference in refusing to give [her] a hearing and defend her lemur,' which violates the FHAA and ADA. On February 15, 2018, Defendants filed a Motion for Summary Judgment seeking a dismissal of all of Plaintiff's claims. Defendants claim that Plaintiff's lemur was involved in two documented attacks in Houston County, Texas and a third in Elkhart. Defendants assert that Plaintiff runs a retail resale shop out of her home and that in the third attack on June 25, 2015, the lemur jumped on a customer in plaintiff's store. Defendants assert that the ordinance was enacted as a legitimate exercise of the City's legislative power and police power. The District court concluded that the defendants are entitled to absolute judicial immunity for their conduct because the act of voting in favor of an ordinance is an undeniable legislative action. As for Plaintiff's 1983 claim, the District Court concluded that she had not shown a genuine issue of material fact concerning whether her due process rights were violated nor does she have a basis for a procedural due process claim. The ordinance is rationally related to the City's legitimate interest in the safety and welfare of its citizens. The ordinance does not violate the equal protection clause of the Fourteenth Amendment. As for Plaintiff's ADA claim, the District Court concluded that the Plaintiff had not shown that the reasonable accommodation that she requested - an exemption from the animal control ordinance - did not place an undue burden on the City of Elkhart. No facts were provided by the Plaintiff that would show that her interest in keeping her lemur outweighs the interest of the City in protecting its citizens. As for Plaintiff's ADA claim, in order to succeed on an ADA claim, there must be some evidence that set the animal apart from an ordinary pet. The Plaintiff failed to show any evidence that her lemur is specifically trained to perform tasks that help her in her daily life. The District Court held that the Defendant's motion for summary judgment is granted and the Plaintiff's complaint is dismissed with prejudice.

Warren v. Commonwealth

Summary: Warren, the defendant in this case, videotaped on his cell phone sexual encounters he had with K.H. and her dog. The videos showed the dog's tongue penetrating K.H.'s vagina while K.H. performed oral sex on Warren. In March of 2017, Deputy Sheriff Adam Reynolds spoke to Warren about an unrelated matter.
