Housing Authority of the City of New London v. Tarrant

A mother renting housing alleged that her son was "mentally challenged" and required the companionship of a dog pursuant to Section 504 of the Rehabilitation Act. The court rejected the tenant's allegations that her son had a qualifying mental disability, reasoning that the son received high marks in school prior to the commencing of the eviction proceedings. Woodside Village v. Hertzmark

Summary: The question in this case is whether federal and state laws outlawing discrimination in housing prohibit the eviction of a mentally disabled defendant from his federally subsidized apartment because of his failure to comply with the plaintiff's pet policy. The plaintiff here had disabilities including schizophrenia and severe learning disabilities. The plaintiff-landlord allowed tenants to keep pets, but required pet care, which included walking the dogs in a designated area and requiring that tenants use a "pooper scooper" to clean up behind their pets. The tenant-defendant here does not dispute that he failed to comply, but claims the plaintiff-landlord, as a recipient of federal funds, failed to reasonably accommodate his disability. The court found that plaintiff-landlord did in fact accommodate the defendant-tenant's disability by either waiving the provisions of its pet policy or permitting the defendant to build a fenced in area for the dog in the rear of the defendant's apartment. The eviction here was not based on the fact that defendant-tenant possesses a dog, but on his "demonstrated inability to comply with the plaintiff's pet policy." This, said the court, put other residents' health, safety and comfort at risk.

State v. Bonilla

Summary: <p> The issue before the court in this case is whether defendant's felony conviction for being a spectator at a cockfight (contrary to General Statutes &sect; 53&ndash;247(c)) violates defendant's constitutional rights to assemble and associate, and his equal protection rights. In rejecting defendant's arguments, the court noted first that the right to assemble does not encompass the right to assemble for an unlawful purpose. Further, the right to associate was not infringed because "[a]ttending a cockfight as a spectator is neither a form of 'intimate association' nor a form of 'expressive association' as recognized by our courts or the United States Supreme Court . . ." As to defendant's claim of violation of equal protection, the court found that the aim of &sect; 53&ndash;247(c)(4), criminalizing being a spectator at a cockfighting event, is rationally related to the legislative goal of preventing such fights from being staged. </p>

Giacalone v. Housing Authority of Town of Wallingford

Summary: <p> In this Connecticut case, a tenant, who was bitten by a neighbor's dog, brought a common law negligence action against the landlord, the housing authority of the town of Wallingford. The tenant then appealed after the lower court granted the landlord's motion to strike the complaint. On appeal, this Court held that the tenant properly stated a claim under common law negligence against the landlord. Relying on <em> <a href="/cases/causct2008wl726289.htm"> <em> Auster v. Norwalk United Methodist Church, 286 Conn. 152, 943 A.2d 391 (2008) </em> </a> </em> , the court concluded that a common-law negligence action brought against a landlord in a dog bite case should not be striken simply because the landlord was the the owner or keeper of the dog. </p>

State v. Ancona

The plain language of the statute &sect; 22-364(a) states that&nbsp;an &ldquo;owner or keeper&rdquo; is prohibited from allowing a dog to roam on a public highway. Either the owner or keeper or both can be held liable for a violation of the statute. The court also found sufficient evidence that defendant was the keeper of the pit bull: the dog stayed at his house, he initially responded to the incident and tried to pull the dog away, and defendant yelled at the Officer Rogers&nbsp;that she was not to take "his dog." </p>

Mann v. Regan

Summary: <p> The plaintiff (Mann) brought this action to recover damages for injuries she sustained to her face when she was bitten by a dog owned by the defendant (Regan). The incident occurred when the defendant&rsquo;s dog was being cared for by the plaintiff at her house while the defendant traveled out of state. With regard to&nbsp;defendant's tacit admission challenge, this court found that defendant&rsquo;s silence in response to her daughter&rsquo;s statement, &ldquo;Well, mom, you know he bit you,&rdquo; was within the trial court&rsquo;s discretion to admit as a hearsay exception. As to the jury instructions, this court was not persuaded that there is a meaningful distinction between the words &ldquo;vicious&rdquo; and &ldquo;dangerous&rdquo; as used in the context of an action stemming from a dog bite. </p>

People v. Bergen

Summary: <p> Defendant, a journalist, attempted to film a dogfight for an investigative story on dogfighting following the passage of a Denver ordinance forbidding the ownership of bull terriers (pitbulls).&nbsp;&nbsp;&nbsp; Defendant videotaped two separate fights and dogs "training" by running on treadmills.&nbsp; After the story aired, public outcry lead to a police investigation as to the source of the dogfighting footage, which lead to the arrest of the defendant and her cameramen for dogfighting and perjury. <br/> </p>

Defendant, a journalist, attempted to film a dogfight for an investigative story on dogfighting following the passage of a Denver ordinance forbidding the ownership of bull terriers (pitbulls).    Defendant videotaped two separate fights and dogs "training" by running on treadmills.  After the story aired, public outcry lead to a police investigation as to the source of the dogfighting footage, which lead to the arrest of the defendant and her cameramen for dogfighting and perjury.

Winkler v. Colorado Dept. of Health

Summary: <p> In 1974, the Colorado Department of Health adopted certain regulations,&nbsp;the conceded effect of which is to prohibit importation of pets for resale from states whose licensing laws and regulations for commercial pet dealers are not as stringent as those of Colorado. The regulations exempt from this prohibition persons who import pets not for resale and exclusively for breeding purposes or for personal use. After the regulations were upheld by the Denver district court, the plaintiffs, who are commercial pet importers, brought this appeal. The court found&nbsp;these arguments to be unpersuasive and, accordingly, affirmed the judgment of the trial court. </p>

Lindauer v. LDB Drainlaying, Inc.

Summary: <div> In this Colorado case, the owners of a thoroughbred racehorse brought a negligence action to recover for injuries to his horse against the corporation&nbsp;that &nbsp;installed underground pipe on property leased by plaintiffs. The lower court entered judgment on a verdict awarding damages to plaintiffs. On appeal, this court&nbsp;held that the evidence of negligence and contributory negligence was sufficient for jury where&nbsp;defendant physically&nbsp;left an unfinished project for two months where the horse was injured. Defendant still owed a duty of care&nbsp;that it would have owed as contractor. However,&nbsp;plaintiffs were not entitled to damages for care and feeding of injured horse. </div>

Summary: <p> Cattle owners sued the state and its agricultural commission for negligently performing the duty to use proper steps to prevent the spread of a contagious disease after they bought dairy cows at a sale that subsequently infected their herd. The owners were forced to sell their herd of dairy cows. The Supreme Court held that the owners could recover the difference between fair market value of their herd before and after it contracted the disease, loss of profits due to diminished milk production from cows before sale, value of silage or feed that had been contaminated, and reasonable costs of disinfecting the farm, but not for loss of profits for the dairy operation after they sold the cows, or loss of progeny. </p>
