NY - Food Service - § 1352-e. Companion dogs at food service establishments

Summary: This statute allows for companion dogs in an outdoor dining area at a food service establishment in the state of New York. The companion dogs are allowed at an outdoor dining area if the owner of the establishment allows companion dogs, a separate outdoor entrance is available for the companion dog to enter the dining area, and the outdoor area where the companion dog is allowed is not used for food or drink preparation. The statute also outlines a number of other requirements that the owner of the establishment and owner of the companion dog must follow in order to be in compliance with this statute.

Summary: Under Maryland law, any person who owns or operates a livery stable or other establishment who gives care or custody to livestock will have a lien on the livestock for any reasonable charge relating to: board and custody, training, veterinarian and blacksmith service, and other maintenance expenses. If the lien is not paid within 30 days after payment is due, the owner of the livery stable is entitled to sell the livestock.

Summary: This statute deals with the sale of unclaimed animals after an animal is left with a licensed veterinarian after providing care to the animal. Swanson v. Tackling

Summary: This is an interlocutory appeal by the dog owners (the Swansons) in a personal injury lawsuit for a dog bite. The court in this case overruled the lower court’s ruling that the defendant was not entitled to summary judgement after defendant’s dog bit a child but the dog had never shown a propensity to injure anyone prior to the incident. Plaintiff was suing defendant after defendant’s dog bit plaintiff’s child on the arm and head. Plaintiff argued that defendant is responsible for the injuries caused by the dog because the defendant neglected to properly restrain the dog. The court reversed the lower court’s decision and held in favor of defendant, stating that there was no evidence that was presented to indicate that defendant could have or should have known that the dog would act in this way towards the child. In order to prevail, the plaintiff needed to present evidence that the dog had acted in a similar way in the past.

The district court denied the petition for a writ of mandamus because the court held that there was “a plain, speedy and adequate remedy in the ordinary course of the law.” Also, the court held that because the city’s program did not result in any unconstitutional action, the writ of mandamus was not appropriate. The court affirmed the district court’s ruling, looking only at whether or not there was “a plain, speedy and adequate remedy in the ordinary course of the law.” The court did not address the issue of whether or not the city’s population control effort was appropriate and should continue. The district court's order denying Petitioner's application for a writ of mandamus is affirmed.
